Description
JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1.Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 2.Description of Action: The proposed action is for a firm-fixed price delivery order to be issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC) for brand name Canon certified hardware maintenance coverage of existing scanners for the VA Office of Information and Technology, Service Delivery and Engineering, Enterprise Operations (EO). 3.Description of Supplies or Services: The proposed action is for brand name Canon certified scanner hardware maintenance coverage. The hardware maintenance coverage will consist of hardware maintenance to repair or replace systems equipment components to restore full operation and accessibility to the original redundant component configuration. Hardware maintenance services will be provided 24 hours a day, seven days a week, 365 days a year. The initial response to all requests for maintenance shall be within one hour of the initial notification from VA, and the contractor shall respond to all requests for on-site maintenance support by sending a qualified technician/engineer to the affected site within four hours of the initial notification from VA. The maintenance is required to ensure currently fielded Cannon scanners remain operational. The period of performance is 12 months from October 1, 2015 through September 30, 2016. The total estimated price of the proposed action is 4.Statutory Authority: The statutory authority permitting an exception to fair opportunity is 41 U.S.C. 4106(c)(2) as implemented by Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B) entitled, "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5.Rationale Supporting Use of Authority Cited: The current EO infrastructure is based on existing Canon scanner hardware and VA requires support compatible with the existing infrastructure protocols and functionality for continued operational availability. VA requires scanner hardware upgrades and updates to include major releases, point releases, service releases of applicable hardware on a quarterly basis, or within 48 hours in cases where a high risk vulnerability fix becomes available. Only Canon or its authorized resellers can provide the necessary scanner hardware maintenance support because of the propriety firmware source code required to develop and implement hardware updates. No other source is capable of providing the required hardware maintenance that meets VA's unique functional requirements. In addition, a prior implementation of Canon scanner hardware licenses already exists within EO. As a result, only brand name Canon scanner hardware maintenance meets all of the Government's requirements. 6.Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D), the resulting contract award will not be announced on the Federal Business Opportunities Page, and this Justification for an Exception to Fair Opportunity will not be made publicly available since the estimated value of this action is less than $150,000. This Justification for an Exception to Fair Opportunity will be posted on the NASA SEWP V website with the solicitation. 7.Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government will continue to perform market research to determine if there are any new maintenance services available that will enable future requirements to be competed. 8.Market Research: Market Research was conducted by the Government's technical experts in April 2015 by reviewing similar maintenance support for Canon desktop scanners. Specifically, the Government's technical experts conducted web-based research on web sites such as CDW-G, NASA SEWP V, and the General Services Administration Advantage catalog. Based on reviews of these websites, the Government's technical experts have confirmed that only Canon scanner hardware maintenance support will meet VA's requirements due to interoperability and compatibility requirements for hardware updates and patches. Although no other brand scanner maintenance can meet the Government's needs, market research has verified that there are multiple resellers on the NASA SEWP V GWAC with the capability to provide Canon certified maintenance. 9.
