- JUSTIFICATION FOR SINGLE SOURCE AWARDS IAW FAR 13.106-1 (OVER MICRO-PURCHASE THRESHOLD($3K) BUT NOT EXCEEDING THE SAT ($150K)) IAW FAR13.104, COs must promote competition to the maximum extent practicable to obtain supplies and services from the source whose offer is the most advantageous to the Government, considering the administrative cost of the purchase. When competition is not practicable, IAW FAR13.106-1(b), COs solicit from a single source for purchases not exceeding the simplified acquisition threshold. COs may solicit from one source if the CO determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). IAW FAR13.106-3(b)(3),COs are required to include additional statements explaining the absence of competition (see 13.106-1 for brand name purchases) if only one source is solicited and the acquisition does not exceed the simplified acquisition threshold (does not apply to an acquisition of utility services available from only one source) or supporting the award decision if other than price-related factors were considered in selecting the supplier. This template when completed can be used to document single source awards IAW FAR13.106-3(b)(3). Note: Statements such as "only known source" or "only source which can meet the required delivery date" are inadequate to support a sole source purchase. 1. PURCHASE REQUEST OR REQUISITION NUMBER: 501-15-4-123-04151A. PROJECT/TASK NUMBER N/A1B. ESTIMATED AMOUNT: $19,492.00 - Total 2. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE: The Amarillo VA Healthcare System is requesting the sole source purchase of EMERGENCY repair/rebuild for the Government-owned Olympus Endoscope units (2 each URF-V, RMA # 15128031 and RMA # 15128040) at the Amarillo VAHCS. This equipment is used for Gastro Intestinal scope check-ups (i.e., check/cancer prevention); includes surgical/OR support systems, products, services and technologies therein of surgical equipment/devices currently on-hand at the Amarillo VAHCS. 3. UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED: Olympus America, Inc. is the original equipment manufacturer (OEM) and has proprietary rights on software (microchips) therein for the Olympus Endoscopes (currently used at the Amarillo VA Healthcare System), Texas. The GI scope/equipment has software available that Olympus has proprietary rights to and do not allow third party access. Without these services utilizing Olympus Endoscopes GI techniques accordingly, all facility appointments would be potentially delayed, or worse yet, cancelled entirely - potentially various forms of cancer would go undetected or spread worse to the Veteran population. Additionally, potential of infection/death could ultimately be a result. The VHA OAL website for scope repair, POC Steven Kaufman, also provided the local Bio Medical personnel (Daniel Higgins) a phone call stating that they only work on small parts and tubing - NOT microchips or camera. Also, Olympus does not share proprietary software with any third party vendors. 4. REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE, WHICH CAN PROVIDE THE SUPPLIES OR SERVICES: A search was made against current FSS contracts, NAC Contract search tool, GSA Advantage and VetBiz - resulting in zero sources. Additionally, VHA OAL Scope Repair personnel were contacted, to include review of prior special notice/sources sought was posted to FBO website (https://www.fbo.gov/), and zero interested parties provided feedback and/or response upon. 5. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND RESULTS OR STATEMENT WHY IT WAS NOT CONDUCTED: Thorough market research, as well as contacting Olympus America, Inc. POC, Stephen Maynard, occurred. They do not share the proprietary software with VHA OAL or any third party vendors. An internet search for any potential vendors did not reveal anything beyond the new VHA OAL Repair website for basic Olympus repairs. Prior Sources Sought postings provided no responses of any vendor capable of performing these services. Please see #4 above. 6.
