Description
THIS IS A NOTICE OF INTENT TO AWARD AS A SOLE SOURCE, NOT A REQUEST FOR PROPOSAL. A SOLICITATION DOCUMENT WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. This notice is being published by the National Institute of Environmental Health Sciences (NIEHS) in accordance with Federal Acquisition Regulation (FAR) Part 5.201 and 5.204 requiring notice of a proposed contract action. This notice of intent is NOT a request for competitive proposals. The statutory authority for this sole source action is 41 U.S.C. 253(c) (1) as implemented by FAR 6.302-1: only one responsible source and no other supplies or services will satisfy agency requirements. Award is subject to Justification for Other Than Full and Open Competition (JOFOC) approval. DESCRIPTION: The National Toxicology Program (NTP), within the Division of the National Toxicology Program (DNTP), uses the commercial proprietary Hosted Provantis Toxicology Data Collection & Reporting System (hereafter termed Provantis). Access to the Provantis database is provided by Instem, LLS, the sole owner and distributor of Provantis. The NIEHS Office of Acquisitions (OA) intends to negotiate and award on a non-competitive basis a sole source contract with Instem, LSS to provide expanded access to their proprietary Provantis database Instem, LSS is the incumbent for the existing NIEHS Contract Number HHSN273201300004C, which was competitively awarded on February 27, 2013 with a period of performance from March 1, 2013 through February 28, 2014, with additional annual option years through February 28, 2023. The current contract provides access to Provantis through a specified number of annually purchased facility and user licenses The NTP now requires access to the Provantis software in a greater capacity than the current contract allows for. This new contract shall replace the current contract in order to obtain expanded services and continued access to Provantis which the NTP needs to maintain critical data collection services. The period of performance is anticipated to be one year with options for 9 additional years, with an estimated start date of March 1, 2016. The new contract shall: A. provide a perpetual license to use Provantis software for 200 users and 3 laboratory facilities; B. provide annual support for Provantis including access to the Instem helpdesk, hosting service, installation of security patches, and installation of and assistance with GLP validation of routine Provantis upgrades; C. provide additional optional annual facility licenses and annual user licenses for use of Provantis in the following quantities: • 20 options for additional blocks of 25 annual user licenses for access to Provantis for NTP staff and/or NTP contract laboratories • 20 options for additional annual facility licenses for access to Provantis for NTP contract laboratories D. provide an option not to exceed 5,000 labor hours over the life of the contract, provided by Instem to implement new functionality required by the NTP. JUSTIFICATION: Instem is the sole owner and distributor of Provantis software. Access to and the use of Provantis cannot be obtained from any other source. Additionally, as owner of the product, Instem, LSS is the only vendor capable of providing annual support services or making alterations to Provantis as required by the NTP. ADDITIONAL INFORMATION: This notice of intent is NOT a request for competitive proposals. However, the Government shall consider all responses received within ten (10) days of this posting. Interested parties may identify their interest and capability to respond to the requirement. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government. Written responses to this synopsis shall contain sufficient documentation to establish a bonafide capability to fulfill this requirement. NIEHS will not be responsible for any costs incurred by interested parties in responding to this notice.
