- This is a NOTICE OF INTENT, NOT A REQUEST FOR PROPOSAL. A SOLICITATION DOCUMENT WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. This notice is being published by the National Institute of Environmental Health Sciences (NIEHS) in accordance with Federal Acquisition Regulation (FAR) Part 5.201 and 5.204 requiring notice of a proposed contract action. This posting is NOT a request for competitive proposals. The statutory authority for this sole source action is 41 U.S.C. 253(c) (1) as implemented by FAR 13.106-1(b). Only one responsible source and no other supplies or services will satisfy agency requirements. Award is subject to Sole Source Justification approval. The National Institute of Environmental Health Sciences (NIEHS) intends to issue a sole-source purchase order to FEI, 5350 N.E. Dawson Creek Drive, Hillsboro, Oregon, 97124-5793 pursuant to 41 U.S.C. 253(c)(1)----Only one responsible source and no other supplies or services will satisfy Agency requirements. This requirement will provide a service maintenance agreement for a one year for the FEI 12 Bio-Twin Transmission Electron microscopy equipment. The anticipated performance period will be from October 1, 2015, to September 30, 2016. This product's unique electron source is conducted via a lanthanum hexaboride (Lab6) crystal and provides exceptional performance, versatility, and high-level production. It encompasses a eucentric goniometer stage which can be tilted at an angle of ±80 degrees. Additionally, user instruments include, but are not limited to, electron and optical microscopy, spectroscopy and electronic measurements, surface analysis and characterization, soft matter/polymer analysis, x-ray and diffraction analysis and mechanical properties testing and analysis to name a few. Therefore, this service maintenance agreement requires that the high-resolution, high-contrast, thermoelectrically (TE) cooled Gatan Orius 1000 dual-scan CCD camera and other components be expertly maintained by exceptionally trained and skilled certified FEI technicians in direct support of the pivotal mission of the Cellular Molecular Pathology Branch (CMPB). The CMPB provides crucial diagnostic pathology support services essential to the critical mission of the NIEHS. This unique requirement is typically operational at either 80KV or 120KV and historically, FEI's preventative maintenance solutions coupled with access to the latest service and maintenance information justifies the anticipated selection of this vendor for this requirement. Previously, federal contract#: HHSN273201500003P furnished a service maintenance agreement for the FEI 12 Bio-Twin Transmission Electron microscopy at the NIEHS from October 1, 2014 - September 30, 2015 in support of the CMPB and this anticipated action will provide a seamless and fluid transition in terms of maintenance for this critical equipment. This contract action is anticipated in FY 2016. This notice of intent is NOT a request for competitive proposals. However, the Government may consider responses received within fifteen calendar(15) days of this posting. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government. Written responses to this synopsis shall contain sufficient documentation to establish a bonafide capacity to fulfill this requirement. NIEHS will not be responsible for any costs incurred by interested parties in responding to this notice.
