- Justification and Approval for Exception to Fair Opportunity On October 21, 2015, the General Services Administration, FEDSIM on behalf of U.S. Department of Agriculture, Risk Management Agency (RMA) awarded a directed 8a task order pursuant to the exception to fair opportunity process of the underlying 8(a) STARR II Government Wide Acquisition Contract. Please see attached justification and approval for exception to fair opportunity for the applicable authorities. This order falls under STARS II Functional Area 1 (NAICS541511). The task order was awarded as a labor hour contract type. FAR 16.601 states that a labor hour contract type may be used only if the Contracting Officer determines that no other contract type is suitable. The work to be performed is such that it is not possible at the time of placing the order to accurately estimate the extent or duration of the work or to anticipate costs with any reasonable degree of certainty. The full extent of the level of effort required for the development requirements cannot be defined for multiple reasons, including the number of complexities of the application development, testing, and pilot processes associated with the RMA CIO application environment and their required use of RMAgile processes for rapid releases. The applications development environment is dynamic and requires an iterative process, multiple reviews, and constant changes and updates. Additionally, there are numerous uncertainties that are associated with transitioning applications from the development phase to an operations and maintenance environment managed by another party. The highly flexible solution needed to support the unpredictability in the requirements, makes a labor hour the only suitable contract type. Therefore, the Contracting Officer determined that no contract type other than labor hour is suitable for the services on this task order. Award was made to EOOC Select Inc located at 4100 N.
