- 1. Contracting Agency: This Justification and Approval to request authority for Other Than Full and Open Competition supports requirements generated for the US Army Aviation and Missile Life Cycle Management Command (AMCOM). The contracting authority for this requirement is Defense Logistics Agency (DLA) Strategic Acquisitions Program - Huntsville, Redstone Arsenal, Huntsville, Alabama 35898-7340 (DLA-AH). The Procurement Request Order Number (PRON) D15H6603D1 will be initiated as Request for Proposal (RFP) SPRRA2-15-R-0015. 2. Nature and/or description of the action being processed : Due to the circumstances described herein, this activity requests authority to acquire the spares listed in this document using Other Than Full and Open Competition as prescribed by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. This action will result in the award of a new contract, which will be a firm-fixed price, type contract. Army Working Capital Funds, (Reparable) - will be utilized. This sole source requirement will be purchased from the following company: The Raytheon Company DBA Raytheon 350 Lowell St Andover, Ma 01810-4000 CAGE: 05716 NAICS: 334415 Large Business 3. Description of the supplies/services required to meet the agency's needs: The Government proposes to acquire the following item, applicable to the Patriot Missile System. Under the contemplated contract, the proposed vendor will provide the following: Noun: Circuit Card Assembly; Quantity: 35 each; National Stock Number: 5998-01-603-5546 Part Number 13659485-2; Unit Price $23,568.68; Estimated contract range value is $824,903.80. AMRC: 3C (Sole-source - acquire directly the manufacturer). Contractor Tested First Article has been waived. Production Lead-time without First Article Testing is a quantity of 35 each, 510 DACA. 4. Statutory authority permitting other than full and open competition 10 USC 2304(c) (1), as implemented by FAR 6.302 -1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. 5. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above: The item in paragraph 3 requires engineering source approval by the design control activity in order to maintain the quality of the part. The Aviation and Missile Research, Development and Engineering Center (AMRDEC) Breakout Engineers have assigned the Acquisition Method Reason Code (AMRC) " 3C " thereby restricting the manufacture of the item from only approved sources. The approved sources have the unique design capability, engineering skills, and manufacturing knowledge to produce this item. Breakout Engineering has assigned Acquisition Method Code " 3 ", which states, " Acquire, for the second or subsequent time, directly from the actual manufacturer," and the Acquisition Method Suffix Code (AMSC) " C " states, " This part requires engineering source approval by the design control activity in order to maintain the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures. " Accordingly, The Raytheon Company is the only firm capable of providing the supplies and services described in Paragraph 3 above without the warfighter experiencing substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements." 6. Description of efforts made to ensure that offers are solicited from as many potential sources as deemed practicable: This requirement will be synopsized on Federal Business Opportunities (FedBizOpps) as required by FAR 5.201 as a synopsis. The extent of competition anticipated is the source identified in paragraph 2. In an effort to obtain maximum competition, the synopsis will encourage firms that recognize and can produce the item described in paragraph 3 to identify themselves. The synopsis encourages firms to seek source approval in order to compete for future solicitations by accessing the AMCOM Competition Management Office website and looking under Standardized Aviation and Missile Source Approval Request (SAMSAR). Improving the competitive status of acquisition include review and screening under the procedures of the DOD Spare Parts Breakout Program, Defense Federal Acquisition Regulation Procedures, Guidance and Information (PGI) 217.7506. Although the Government does not own data to support acquisition of this item from any other source, any source who responds to the Government as a result of this synopsis will be identified to the prime contractor as a potential for subcontracting possibilities. Any additional sources identified through the synopsis procedure will receive due consideration as prescribed by law. The action plans for improving or enhancing the competitive status of the acquisition include review and screening under the procedures of the DoD Spare Parts Breakout Program, Defense Federal Acquisition Regulation Supplement (DFARS) PGI 217.75, publication in the AMCOM Competition Advocate's Shopping List (CASL) of proposed acquisitions in accordance with FAR 5.404 and publication in the FedBizops in accordance with FAR 5.201. Contractors are encouraged to submit Qualification Requests to the Command in accordance with Qualification Procedures identified in AMCOM Pamphlet 702-1, which is published on the World Wide Web at the Competition Advocate's homepage for items identified in the CASL. Currently, there are no outstanding qualification requests on these items; however, this is a continuous method of identifying potential new sources of supply. All interested sources identified through the synopsis and/or market research will receive due consideration as required by law. To date, no other sources have expressed an interest in writing. Re-screening will occur on the item identified in paragraph 3 above prior to the expiration date of the AMC/AMRC which expires on 20 November 2015. No new orders will be issued after that date until the AMC/AMRC has been re-validated. 7. Determination by the contracting officer that the anticipated cost to the government will be fair and reasonable: The overall cost of this acquisition will be fair and reasonable to the Government. In accordance with FAR 15.403-4, the contractor will be required to provide certified cost and pricing data to be used in supporting the Government's evaluation of the proposed cost. The proposed skill mix of labor, labor hours, types and quantities of material, other direct costs and direct and indirect rates will be negotiated by the Government based on recommendations from the Defense Contract Audit Agency(DCAA) and expert technical personnel supporting the program. The contract price will be negotiated in accordance with procedures in FAR Part 15 ensuring the ultimate cost to the Government is fair and reasonable. 8. Description of the market research conducted and the results, or statement of the reasons market research was not conducted: Due to the non-competitive nature of the required item, no external survey was conducted. Market research as defined in far 10.001 was conducted. This item does not appear in the latest Competition Advocate Shopping List (CASL). It has been determined that the government's needs cannot be met by an item available in the commercial marketplace; therefore, FAR Part 12 will not be used. 9. Any other facts supporting the use of other than full and open competition: The technical factors supporting the recommendation for other than full and open competitive acquisition are based on review and analysis information residing in the commodity command standard system national stock number maintenance data record and the aviation acquisition engineering part number files. •a. Procurement history - SPRRA2-14-C-0009, CLIN 0001AA, for a quantity of 5 each at a unit price of $23,568.68 b. The qualified and approved source of supply has been identified. This source has been placed on the Restricted Source List and there have been no significant changes. c. To ensure that the contractor obtains competition in subcontracting, the applicable FAR and DFARS clauses will be included in the solicitation and resulting contract. 10. List of sources, if any that expressed interest in the acquisition: The Procurement is Sole Source to The Raytheon Company. See section 6 above. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies: Firms are encouraged to seek source approval in order to compete for future solicitations by accessing the website www.redstone.army.mil/cmo/ and looking under Standardized Aviation and Missile Source Approval Request (SAMSAR). Currently, there are no outstanding qualification requests on this item; however, this is a continuous method of identifying potential new sources of supply. 12.
