Description

JUSTIFICATION FOR NON-COMPETITIVE PROCUREMENT for Chinook and Steelhead Monitoring for Elwha River Ecosystem Restoration Olympic National Park OVERVIEW For over 100 years, the Elwha Dam and Glines Canyon Dam on the Elwha River, Washington, blocked the upstream migration of anadromous salmon into Olympic National Park (ONP). Removal of the dams, as authorized by the Elwha River Ecosystem and Fisheries Restoration Act (Elwha Act), Pub. L. 102-495, 106 Stat. 3173 (Oct. 24, 1992), will restore anadromous fish passage to the Elwha River watershed and represents a major step in recovery efforts for a variety of fish stocks listed under the Endangered Species Act (ESA), including Puget Sound Chinook salmon (Oncorhynchus tsawytscha) (NMFS, 2007), Puget Sound steelhead (O. mykiss) (NMFS, 2012), and Pacific eulachon (Thaleichthys pacificus) (NOAA, 2011). The Secretary of the Interior delegated his discretionary authority under the Elwha Act to mitigate for the adverse impacts of dam removal, and to restore the Elwha River ecosystem, to the National Park Service (NPS) under Secretarial Order No. 3212, as amended. NPS's mitigation activities and its efforts to restore the Elwha River are commonly referred to as "the Elwha River Restoration Project" or "Elwha Project." Removal of both dams began in September 2011. By May 2012, demolition of the Elwha Dam was completed. Shortly afterwards, steelhead had migrated past the Elwha Dam site and were observed spawning in Little River and Indian Creek. On September 5, 2012, Chinook salmon were observed spawning in ONP for the first time since construction of Elwha Dam began in 1910. Removal of the Glines Canyon Dam was completed on August 26, 2014. Chinook and bull trout were observed to migrate above the former location of the dam shortly thereafter. The National Marine Fisheries Service (NMFS) issued an amended Biological Opinion (BiOp) for the Elwha Project on November 30, 2012. Paragraph 6 of the Terms and Conditions (T&Cs) section and the Reasonable and Prudent Measures (RPMs) section of the amended BiOp require the NPS to implement a monitoring plan for the Elwha Project (hereafter, "monitoring plan"). The monitoring plan, approved by NMFS, describes the specific steps the NPS must undertake to document dam removal impacts to listed salmon species and guide adaptive management actions which may be necessary to ensure preservation these species. AUTHORITY Federal Acquisition Regulations Subpart 6.3 provides for circumstances permitting other than full and open competition. In this procurement, Subpart 6.302-1 (a) (2) is hereby incorporated into this justification; "Supplies or services may be considered to be available from only once source." The requirement is met under paragraph 6302-1 (b) (1) (i): "Unique supplies or services available from only one source or only one supplier with unique capabilities." JUSTIFICATION 6.303-2 (a)Facts and Rational (b)(1) Identification of Agency National Park Service, Dept. of Interior Olympic National Park (b)(2) Nature or Description of Action Being Approved. Contract to implement specific actions identified in the monitoring plan, required by paragraph 6 of the Terms and Conditions (T&Cs) and Reasonable and Prudent Measures (RPMs) sections within the July 2, 2012 National Marine Fisheries Service (NMFS) Biological Opinion (BiOp) for the Elwha Restoration Project (Project), as amended by letter dated November 30, 2012, from NMFS to ONP (see Stelle 2012) (hereafter, "monitoring plan"). The monitoring plan describes the specific steps the National Park Service (NPS) intends to undertake to document dam removal impacts to listed salmon species and meet the requirements of the BiOp. (b)(3) Description of supplies or services required As described in (a)(2) above. 1) operation of a SONAR unit in the lower Elwha River to enumerate returning adult salmon; 2) operation of a rotary screw trap(s) and/or weir-type smolt traps in the lower Elwha River; 3) relocation and enumeration of adult Chinook in excess of hatchery needs and all natural origin adult steelhead that return to the WDFW or Tribal hatchery facility. Other species may also be relocated depending upon timing, river conditions, species, etc., and; 4) salmon habitat assessments. Total award: $430,280.00. (b)(4) Identification of Authorities permitting other than full and open competition FAR 6.302-1 Only One Responsible Source. (b)(5) Demonstration that proposed contractor's unique qualifications or nature of the acquisition requires the use of the authority cited. Much of the work described in the monitoring plan must take place on lands of the Lower Elwha Klallam Tribe (Elwha Tribe). The Elwha Tribe possesses all lands of the lower Elwha River on the east bank from the river mouth upstream approximately 2.5 miles. They also possess lands on the west bank of the river for much of that same distance. For the following reasons, the Elwha Tribe is the only entity which can perform certain tasks identified in the monitoring plan: 1)The Elwha Tribe is the only entity that has the legal authority to relocate (or permit the relocation of) Chinook and Steelhead from the Tribe's hatchery facility, or from lands within the Elwha Tribe's reservation boundaries. 2)By design, operation of the SONAR and smolt traps must occur near the river mouth in order to maximize the proportion of the population observed. The Elwha Tribe is the only entity that has the legal authority to install and operate (or permit installation and operation of) any monitoring equipment (e.g. SONAR or smolt traps) on the Tribe's lands. Further, the Elwha Tribe has developed expertise in conducting smolt trapping in the Elwha River and tributaries during high sediment and debris concentrations associated with dam removal. These extreme conditions are unique to the Elwha River and other entities could not be expected to be able to handle listed fish species under these conditions. 3)The Elwha Tribe is the only entity that has legal authority to conduct habitat surveys on their lands. (b)(6) Description of efforts made to ensure that offers are solicited from as many potential sources as is practical, including whether a CBD notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. Justification to be published in accordance with FAR 5.202. (b)(7) Contracting Officer's determination that cost is fair and reasonable. The Park Fisheries Biologist and Elwha Project Manager have reviewed the Tribe's proposal in combination with previous estimates prepared by the park and NOAA fisheries and recommend the Tribe's proposal as fair and reasonable. (b)(8) Description of market survey conducted. Not Applicable (b)(9) Other facts supporting use of other than full and open competition.
