Senior Law Enforcement Advisor Kyiv, Ukraine Issuance Date: 11/19/2015 Closing Date: 12/03/2015 SOLICITATION NUMBER: PSC-16-006-INL SUBJECT A solicitation for a Personal Services Contractor (PSC), Department of State (DOS), Bureau for International Narcotics and Law Enforcement Affairs (INL) The United States Government (USG), represented by the DOS, seeks applications from US citizens interested in providing PSC services as described in this solicitation. PRE-AWARD ETHICAL RESPONSIBILITIES OF PSC (JUN 2011) This solicitation may result in the award of one or more personal services contracts as defined in FAR 2.101. Prior to contract award, all offerors or quotes must advise the cognizant Contracting Officer if they have a personal conflict of interest, such as a financial conflict, that would prevent them from either meeting the requirements of the clause entitled, "Post-Award Ethical Responsibilities of Personal Services Contractors," or otherwise objectively performing their contractual duties upon contract award. HOW TO APPLY Offerors proposal shall be in accordance with the requirements stated in this solicitation at the place and time specified. A proposal will be determined non-responsive and ineligible for consideration unless all required documents and information are included in the submission. Offerors shall ensure their resume demonstrates their possession of the minimum qualifications outlined in this Solicitation, as well as their ability to fulfill all required duties. PLACE OF PERFORMANCE: Kyiv, Ukraine 9. JOB DESCRIPTION: See below GENERAL STATEMENT OF THE PURPOSE OF THIS CONTRACT AND RESPONSIBILITIES OF THE CONTRACTOR: The U.S. Department of State (DOS) Bureau of International Narcotics and Law Enforcement Affairs' (INL) mission is to minimize the impact of international crime and illegal drugs on the United States and its citizens through global cooperation and by building the capacity of the criminal justice sectors in the countries where we work around the world. The principal goal of the INL program in Ukraine is to assist the host country in meeting European and international law enforcement standards in preparation for eventual integration into the European Union (EU). This involves providing assistance to modernize and increase capacity of Ukrainian law enforcement and criminal justice institutions, fight corruption, combat organized transnational crime, and uphold the primacy of the rule of law. Successful delivery of assistance to Ukraine requires coordination and collaboration among other donors and development partners in the law enforcement and criminal justice sectors. INL takes a leadership role in ensuring effective coordination between the different stakeholders working in Ukraine. Purpose: This personal services contract (PSC) Senior Law Enforcement Advisor (SLEA) position is located within the US Department of State's (DOS), Bureau of International Narcotics and Law Enforcement Affairs (INL) section of the US Embassy in Kyiv, Ukraine. The Advisor shall: (1) Assess immediate Ukrainian law enforcement reform needs and survey the landscape of Government of Ukraine (GOU), civil society, and international donor efforts to reform law enforcement, especially with regard to reforming the Special Weapons And Tactics (SWAT)-type units falling under the Ministry of Interior Affairs (MOI) authority; (2) Assist the INL team with developing, implementing, monitoring, and evaluating ongoing and new law enforcement assistance initiatives; (3) Provide the MOI and the State Border Guard Service (SBGS) with guidance on standard operating procedures, staffing standards, management skills and development and reform of special units, including by providing some training; (4) Assist and advise the GOU in developing, implementing, and promoting systemic, organizational, legal, and regulatory reform in the law enforcement and criminal justice sectors. The Advisor will provide advice and support to the INL Director and INL Section in Embassy Kyiv. The Advisor will also work closely with officials at the Ukrainian MOI, and will be expected to develop meaningful relationships with counterparts in the GOU. The Advisor will serve as an in-country law enforcement assistance consultant and senior training coordinator, and will provide advice pertaining to development and implementation of the INL law enforcement assistance program. The Advisor will provide substantive guidance for the projects including law enforcement training development, Ukrainian police in-service training and equipment assessments, implementation of required training by appropriate subject-matter experts and practitioners, and technical advice on procurement of appropriate equipment. Relationships: The Advisor will work under the direct supervision of the INL Director who is an FS-02. The Advisor will initiate law enforcement projects and execute approved programs under general supervision. The INL Director will review the timeliness and effectiveness of the Advisors work. The COR is delegated the authority to act for the Contracting Officer in matters concerning technical clarification, inspection and, after concurrence by the Contracting Officer, acceptance of Contractor performance under the contract, including preparation of receiving reports, and the authorization of progress payments when appropriate. The COR will coordinate all work with the Contractor and review Contractor's performance at significant stages of its development. In no instance, however, shall the COR be authorized to alter or modify the specifications or the contract terms and the conditions or waive the government's requirement, price, delivery, or other terms and conditions. Such changes must be authorized, in writing, to the Contracting Officer Deliverables Deliverables are required under this PSC and shall include; quarterly status reports, quaterly evaluation of contractor performance, special reports when required and "Completion of assignment report," which shall be a compressive review of the projects in which the contractor was involved. Each report shall include a critique of and recommendations for the various projects. The completions of assignment reports are due no later than fifteen (15) days prior to the expiration of this contract. The Personal Service Contractor shall submit two (2) copies of each report as required to the following; (1) INL/ Kyiv Director(s) and; (2) INL/EA Program Officer Duties and Responsibilities: a. Review the host country's law enforcement needs; manage, prioritize, and evaluate USG-sponsored law enforcement assistance projects under the guidance and direction of the INL Director and INL/EA in Washington; while informing all stakeholders of the details of such implementation, including progress and problem areas. b. Coordinate with other components of the host country's criminal justice system to ensure system-wide integration and functionality. c. Survey the landscape of Government of Ukraine (GOU), civil society, and international donor efforts to reform law enforcement. d. Provide strategic planning and development in all phases of the law enforcement program. This includes project execution from the study and assessment period to development through acquisition and implementation; planning, scheduling, budgeting, monitoring, and coordinating among vendors, contractors, and GOU officials; and conflict resolution. e. Provide some training to MOI and SBGS on tactical and other subject matter as requested and appropriate. f. Communicate and coordinate with other donors to avoid waste and duplication of effort. g. Draft reports and assessments, provide input to strategy and other briefing papers, and provide oral and written briefs to the INL Director, the INL Program Manager in DC, and leadership at the Embassy and in Washington. h. Liaise with US Embassy agency representatives involved in law enforcement, including but not limited to, the Department of Justice (DOJ), the Export Control and Related Border Security (EXBS) Program, the US Agency for International Development (USAID), the Department of Defense (DOD) and others. i. Advise and assist in preparing documentation for procurement of systems and equipment, including drafting of electronic Purchase Request (PRs), statements of work (SOWs), requests for source-origin waivers, sole-source justifications, and delivery and acceptance of systems, supplies and equipment procured. j. Draft and provide advice and assistance in the preparation of required reports, including to the US Congress, INL, and Principals at the State Department and other US federal agencies. k. Attend and report on general law enforcement meetings, national and international conferences and seminars, and meetings with Ukrainian government officials. l. Provide advice and assistance in end-use monitoring of U.S. government-supplied commodities and draft annual end-use monitoring reports. m. Provide advice and assistance in the formulation of the Mission Performance Plan and other strategy and planning exercises undertaken by Embassy Ukraine, EUR Bureau and INL Bureau. n. Participate in visits by senior officials and serve as an escort or control officer. Arrange itineraries and logistical support for official visitors. o. Brief DOS, Congressional, Embassy staff, and other visiting officials on the INL's role and the status of US-Ukraine law enforcement projects and related initiatives. Complexity: The Advisor must be able to review host country law enforcement needs; develop and manage law enforcement programs in coordination with host-country officials; draw upon experience to suggest, design, advise and implement projects; ensure sustainability of projects through provision of appropriate training and maintenance; and have the ability to integrate the competing needs of US law enforcement, development, and security agencies, and GOU entities involved in law enforcement. Physical Demands: • The Advisor's work is both physical and sedentary in nature and involves activity at the US Embassy in Ukraine and in field locations. • The Advisor must be able to demonstrate tactical skills and other physical techniques used by law enforcement officers, especially tactical skills. Training activities at weapons ranges, simulated weapons training systems, and obstacle physical training courses will be expected. • Travel to the United States and regions throughout Ukraine will be required, especially for end-use monitoring of USG-donated property. Work Environment: The Advisor's work occurs primarily in the Embassy and in wider Kyiv, though will also take place in other locations around Ukraine, with visits to GOU facilities for police and other law enforcement training and operations activities. The Advisor must be able to work independently in remote areas for short periods when conducting field visits or program oversight. Government -Furnished Equipment The PSC shall be able to use a furnished with office space, a computer, office telephone, and other supplies needed for job requirements. This property will be owned and maintained by the Department of State. Minimum Qualifications: 1. US citizen; able to obtain/maintain a DOS secret security and medical clearance. 2. A Bachelor's degree from an accredited institution with ten (10) years demonstrated experience in law enforcement. 3. Proven ability to manage programs, including budget preparation, the procurement of goods and services, and implementation and oversight of projects, preferably involving law enforcement and training initiatives. 4. Demonstrated ability to follow guidance and instructions on law enforcement program implementation; analyze and determine true requirements; and propose feasible solutions for problems in program implementation. 5. Demonstrated fitness to provide some psychical, hands-on tactical training to MOI and SBGS officers as requested and appropriate. 6. Demonstrated ability to advise Ukrainian law enforcement administrators and managers on tactical and/or SWAT-type training techniques. 7. Proven ability to complete the FSI Contracting Officer's Representative (COR) course within the first 120 days of assignment successfully. 8. Proficient in Microsoft Office Suite. 9. Demonstrated ability to communicate clearly and effectively in English, both orally and in writing. Proven experience in preparing well-written reports. Writing samples will be requested. 10. Ability to physically and medically live in Ukraine and travel within the country and the wider region when required. 11. Proven ability to complete Distance Learning (DL) FSI Introduction to Working in an Embassy (PN113) courses within six (6) months of assignment successfully. 12. Proven ability to complete the FSI Managing INL Projects course within six (6) months of assignment successfully. 13. Demonstrated ability to work with senior level managers. Mentorship of Ukrainian law enforcement managers at the General rank level will be common. 14. Proven ability to instruct tactics and other law enforcement topics. 15. Demonstrated ability to develop Standard Operating Procedures (SOP's) for a police unit. Preferred Qualifications: • A minimum of five (5) years of experience with Special Weapons and Tactics (SWAT) units, either in establishing these units, overseeing the work of these units or as a member of a SWAT-type unit. • A Master's degree in project management, public administration, law enforcement, international relations, or related field. • Demonstrated interpersonal and communications skills with extensive experience liaising with officials of foreign governments. • Previous experience working in countries undergoing security crises, and/or in Eastern Europe, Eurasia, or Ukraine. • Demonstrated experience working overseas and maintaining positive working relationships in a cross-cultural setting, especially with foreign officials. • Two (2) years demonstrated experience in procurement and acquisition procedures in a government setting, Federal, State, County, or City. • Previous experience as a lead investigator or overseeing investigations. Evaluation Criteria: Factor 1 Law Enforcement/Training Experience (40 points) Demonstrated experience and expertise in rule of law, law enforcement, and/or related training programs. Individual should demonstrate ability to understand and convey complex criminal justice sector and/or training issues. These include, but are not limited to, law enforcement operations, justice sector issues, financial crimes, drug demand reduction, procurement of commodities and equipment, training development and implementation, and logistics support. Factor 2 Liaison and Communication (25 points) Demonstrated experience building and maintaining relationships with host nation officials, U.S. government agencies, international organizations, and non-governmental organizations. Demonstrated ability to communicate complex issues in a timely and concise manner, both verbally and in writing. Factor 3 International Experience (15 points) Demonstrated experience of working/operating in foreign environments; to include ability to live, work, and travel in difficult conditions with limited support, manage programs in a complex and fluid environment, and show good judgment in challenging security situations. Factor 4 Program Management and Administration (10 points) Demonstrated knowledge and experience in the application of sound management and program management practices, especially in international programs involving multiple agencies that include foreign government entities. Experience in program management should include familiarity with procurement guidelines, budget development, and program planning, execution, and monitoring and evaluation. Factor 5 Past Performance (10 points) Past performance evaluation of applicant's ability to perform under a same or similar contract. In conducting the evaluation, the Government reserves the right to utilize all evaluation information available at the time of evaluation, whether provided by the applicant or obtained from other sources. COMPENSATION (BASE PAY) For award, INL will negotiate for this contract based on the market value as outlined above and overall experience relevant to the solicitation requirements.
