- GENERAL SERVICES ADMINISTRATION North Branch, Real Estate Acquisition Division MEMO TO FILE Justification for Other than Full and Open Competition 4NJ0157 Geological Survey Trenton, NJ 1. Nature and/or description of the action being approved. The purpose of this justification is to obtain a ten year, five years firm succeeding lease at the current location utilizing sole source leasing procedures. Approval is requested to pursue a succeeding lease action with the incumbent lessor without full and open competition, for continued occupancy at this location. 2. Description of the supplies or services required to meet the agency's needs (including estimated value). XXXX Redacted currently occupies 10,205 ABOA/RSF of warehouse and related space along with ten parking spaces at the XXXXX Redacted in Trenton, New Jersey. The space is primarily used for storage of boats, supplies, and other items for the XXXXX Redacted which supports their water study efforts in New Jersey. The proposed rental rate for this lease extension is the current rental rate of $11.25/RSF The estimated value for this leasing action is: $11.25/RSF x 10,205 RSF = $114,806.25 X years 1- 5=$574,031.25 $11.30/RSF x 10,205 RSF=$115,316.50 X years 6-10 = $576,582.50 Total Contract Value: $1,150,613.75 3. Identification of the statutory authority 41 U.S.C. 3304(a) (1). Only one responsible source and no other supplies or services will satisfy agency requirements. 4. Demonstration that the proposed contractor's unique qualifications or nature of the acquisition requires use of the authority cited. In accordance with 41 U.S.C. 3304 (a) (1), the agency's minimum needs can only be satisfied by unique supplies or services available from only one responsible source and no other type of property or services will satisfy the needs of the agency. 5. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. In accordance with GSAM 570.106, an advertisement was placed on Fed Biz Opps on December 1, 2014. In addition, the Contracting Officer completed a thorough search of the market utilizing multiple real estate search engines. See Market Research Report. 6. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. Based on the market research for Trenton, New Jersey a fair and reasonable market range for this area is $12.00-13.20/RSF. 7. Description of the market research conducted An online market survey was conducted on using the real estate website CoStar on October 27, 2014. The results from this research are attached and further detailed in the "Market Research Report" 8. Other facts supporting the use of other than full and open competition None 9. List of any sources that expressed in writing an interest in the acquisition No other source has expressed in writing an interest in the acquisition. 10. Statement of actions the agency may take to remove or overcome any barriers to competition Prior to expiration of the lease extension, if there is a continuing need, GSA will conduct a new search of the market to locate potential space that will satisfy the agency's future space requirements.
