November 24th, 2015 Requisition #: 16-002159 Notice of Intent to Sole Source THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute of Health Office of Purchasing and Contracts intends to negotiate a contract to Remel Inc., 12076 Santa Fe Trail Drive, Lenexa, KS 66215 to provide Trek Sensititre custom/non custom panels for which the government intends to solicit and negotiate with only one source The North American Industry Classification System (NAICS) code for this acquisition is 325413, and the size standard is 500 Employees REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-84, September 3, 2015. This acquisition is conducted under 41 U.S.C. 1903, the simplified acquisition procedures authorized in this subpart may be used for acquisitions that do not exceed $13 million when the acquisition will be treated as an acquisition of commercial items in accordance with 12.102(f)(1). STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.500 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplifeid Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. This notice of intent to award is not a request for competitive quotations. Interested concerns capable of providing the same or similar products or services as described in this notice may submit a capability statement outlining their capabilities. No solicitation is available. Information received will be evaluated for the purpose of determining whether to conduct a competitive procurement. Capability Statements must be received within the time set forth in this synopsis to be considered by the Government. A determination to compete this proposed contract based on responses to this notice is solely within the discretion of the Government. GENERAL INFORMATION *Please see attached for a detailed Statement of Work Introduction: The Bacteriology Section of the Service requests TREK Sensititre supplies. These are used in an instrument for the detection of antibiotic susceptibility of bacterial pathogens growing in cultures of NIH patient samples and will provide continued support for on-going protocols. The Trek Sensitire is the only known manufacture that allows automatic reading of panels that contain any RUO drugs and is an open system that allows manual review/verification of results, or the ability to re-incubate a panel for slow growing organisms. These panels are specifically designed to work directly with the Trek Sensitire instruments that are located at the National Institute of Health Background: The marketplace offers a wide variety of automated and semi- automated instruments. Most provide commercially available panels of standard antibiotics and or identification schema. Organisms isolated from our population of patients often require testing additional antibiotics not on commercially available panels, or testing for longer periods, not allowed by many automated systems. The subject award will be a continuation to previous testing conducted by the subject contractor. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include a proposal, the period of performance, the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by December 11, 2015 07:30 AM Eastern time and must reference solicitation number 16-002159.
