  Section SF 1449 - CONTINUATION SHEET ITEM NO SUPPLIES/SERVICES QUANTITY UNIT UNIT PRICE AMOUNT 0001 1 Job HELAMS Electrical Connection FFP The Contractor shall furnish continuous uninterrupted electrical power service for 24 hours a day, 7 days a week during the period outlined in the contract for HELAMS operations. The Contractor shall provide commercial power as the primary source of electrical power. All work shall be done in accordance with the specifications listed in the Statement of Work. FOB: Destination NET AMT ITEM NO SUPPLIES/SERVICES QUANTITY UNIT UNIT PRICE AMOUNT 0002 1 Job On-Call Technician FFP The Contractor shall provide an on call maintenance technician for the HELAMS 42,000 BTU environmental control unit (ECU) during contract period in accordance with section 1.2 (Scope of Work) of the Statement of Work. FOB: Destination NET AMT ITEM NO SUPPLIES/SERVICES QUANTITY UNIT UNIT PRICE AMOUNT 0003 1 Each Back-up Generator FFP The contractor shall provide a 30 kW back-up generator with an automatic transfer switch (ATS) and associated installation material to ensure electrical power is provided to the HELAMS if there is a loss of power to the commercial power grid. The Contractor shall be responsible for providing fuel, parts, maintenance, associated installation material and cost to provide and operate the backup generator and ATS in accordance with section 1.2 (Scope of Work) of the Statement of Work. FOB: Destination NET AMT ITEM NO SUPPLIES/SERVICES QUANTITY UNIT UNIT PRICE AMOUNT 0004 1 Job Optional Meter / Consumption Charges FFP As an optional item, the Contractor shall establish an account with the local electrical power company, install a meter and any other associated equipment and parts, and pay for the electrical power consumed by the HELAMS operation during the period of performance. FOB: Destination NET AMT ITEM NO SUPPLIES/SERVICES QUANTITY UNIT UNIT PRICE AMOUNT 0005 1 Each Contractor Manpower Report FFP The Contractor is required to report ALL contractor manpower (including subcontractor manpower) required for the performance of this contract. The contractor is required to completely fill in all the required fields in the reporting system using the following web address: https://cmra.army.mil/. The requiring activity will assist the Contractor with the reporting requirement as necessary. The Contractor may enter reports at any time during the reporting period, which is defined as the period of performance not to exceed 12 months ending 30 September of each government fiscal year. Reporting must be completed no later than 31 October for every year or part of a year for which the contract is in place. Failure to comply with this reporting requirement will result in contract termination. FOB: Destination NET AMT ITEM NO SUPPLIES/SERVICES QUANTITY UNIT UNIT PRICE AMOUNT 0006 1 Each DBA Workers Compensation Insurance FFP Before commencing performance under this contract the Contractor shall provide workers' compensation insurance or security as required by the Defense Base Act and maintain it until performance is completed. The amount listed by the offeror on this CLIN is the estimated DBA insurance premium. The actual amount paid by the government under this CLIN will be based on the amount of the insurance paid invoice. The amount listed by the offeror on this CLIN is the estimated DBA insurance premium (estimated payroll of the offeror and its subcontractors times the applicable rate(s)). The actual amount paid by the government under this CLIN will be based on the amount of the Agent/Broker's invoice submitted by the offeror after contract award. In the event of recalculation of the premium by the Insurance Carrier based on actual payroll amounts, the contracting officer will adjust this CLIN by contract modification to reflect actual premium amounts paid. FOB: Destination NET AMT NOTICE TO OFFERRORS By submitting a quote for this solicitation, Offerors are certifying that their products and/or services meet/exceed the minimum requirements of the Statement of Work and are able to meet the delivery schedule listed in the solicitation. (a) The Government does not anticipate any questions regarding this solicitation. However, if prospective Offerors wish to submit general or technical questions, all questions shall be addressed to the Contract Specialist. Questions must be submitted via email to Hubert.m.cacho.civ@mail.mil and catherine.t.johnson4.mil@mail.mil no later than one day prior to the date listed on Block 8 of the SF 1449. The following factors shall be used to evaluate offers: (i) Technical capability of the service offered to meet the Government requirement; Contractor shall provide to the Government proof that the work force possesses the skill, knowledge, experience, proficiency, training and certifications to satisfactorily perform the services required by this contract in accordance with paragraph 1.2, 1.2.1, 1.2.2, 1.2.3, 1.2.4, 1.2.5, 1.2.6, 1.2.7, 1.2.8 of the Statement of Work. (ii) Equipment/Material Listing - The Contractor shall provide a list of Equipment and materials to be used ibased on the works required in paragraph 1.2, Scope of Work of the Statement of Work; (iii) Price. Evaluation factors (i) and (ii) will be rated on Acceptable, Unacceptable basis. (b) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of provision) 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (OCT 2015) ALTERNATE I (OCT 2014) The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.acquisition.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (p) of this provision. (a) Definitions. As used in this provision-- "Economically disadvantaged women-owned small business (EDWOSB) concern" means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees. "Inverted domestic corporation," means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c). "Manufactured end product" means any end product in product and service codes (PSCs) 1000-9999, except- (1) PSC 5510, Lumber and Related Basic Wood Materials; (2) Product or Service Group (PSG) 87, Agricultural Supplies; (3) PSG 88, Live Animals; (4) PSG 89, Subsistence; (5) PSC 9410, Crude Grades of Plant Materials; (6) PSC 9430, Miscellaneous Crude Animal Products, Inedible; (7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products; (8) PSC 9610, Ores; (9) PSC 9620, Minerals, Natural and Synthetic; and (10) PSC 9630, Additive Metal Materials. "Place of manufacture" means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture. "Restricted business operations" means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate- (1) Are conducted under contract directly and exclusively with the regional government of southern Sudan; (2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization; (3) Consist of providing goods or services to marginalized populations of Sudan; (4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization; (5) Consist of providing goods or services that are used only to promote health or education; or (6) Have been voluntarily suspended. Sensitive technology- (1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically- (i) To restrict the free flow of unbiased information in Iran; or (ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and (2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)). "Service-disabled veteran-owned small business concern"- (1) Means a small business concern- (i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and (ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran. General: This is a non-personal service to provide commercial electrical power with backup generator services to the Hard-side Expandable Light Air-Mobile Shelter (HELAMS) at Howard Panama Pacifico, Panama. Enclosure 1 illustrates the HELAMS with required power service. Enclosure 2 provides details on the HELAMS site at Howard Panama Pacifico between Hangar 2 and Fire Station Building 250. The Government will not exercise any supervision or control over the subcontract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government 1.1 Description of Services/Introduction: The Contractor shall provide all personnel, fuel equipment, maintenance, supplies, facilities, transportation, tools, materials, supervision, and other items necessary to perform this service as defined in this SOW except for those items specified as government furnished property and services. The Contractor shall perform to the standards in this contract. 1.2 Scope of work: The Contractor shall furnish continuous uninterrupted electrical power service for 24 hours a day, 7 days a week during the period outlined in the contract for HELAMS operations. The Contractor shall provide commercial power as the primary source of electrical power. The Contractor shall be responsible for providing equipment, parts, maintenance, associated installation material and cost to provide commercial power to the HELAMS. The contractor shall provide a 30 kW back-up generator with an automatic transfer switch (ATS) and associated installation material to ensure electrical power is provided to the HELAMS if there is a loss of power to the commercial power grid. The Contractor shall be responsible for providing fuel, parts, maintenance, associated installation material and cost to provide and operate the backup generator and ATS. The Contractor shall provide on call maintenance for the HELAMS 42,000 BTU environmental control unit (ECU) during contract period. The Government will appoint a Contracting Officer's Representative (COR) in writing. After award of contract, coordination of progress and submission of all submittals shall be submitted to the COR for review before approval by the Contracting Officer. Only the Contracting Office has authority to make changes to any contract resulting from the solicitation of this project, including but not limited to increases, decreases, time extensions, and changes in prices. As an optional item, the Contractor shall establish an account with the local electrical power company, install a meter and any other associated equipment and parts, and pay for the electrical power consumed by the HELAMS operation during the period of performance. The Contractor shall perform all electrical work with certified electricians. All electrical work shall be in compliance with the latest National Electrical Code (NEC) standards, the Unified Facilities Criteria (UFC) Series 3-500 (including UFC 3-540-01, Engine Driven Generator Systems for Backup Power Applications (www.wbdg.org/ccb/browse_cat.php?c=4), and applicable Panamanian standards. 1.2.1 The Contractor shall provide a 208volt 60amp 3phase/3-PH-Y commercial power source from the rear of Fire Station Building 250 and connect the HELAMS to this power source. Power consumption is estimated at 45-50amps/hr.208v /60. 1.2.2 The Contractor shall provide all equipment, parts, maintenance, supplies, associated installation material and personnel to install & connect commercial power source with ATS, provide electrical power service and backup power generation to the HELAMS. 1.2.3 The Contractor shall provide a 100 amp, 3-phase, Y connection, 250 volt heavy duty safety switch (3 phase, neutral, and ground) (Cutler Hammer or equivalent), between the commercial power source and the ATS (see enclosure 3). 1.2.4 The Contractor shall provide an industrial ATS and a 30kW backup power generator, which shall be set up behind Building 266. There shall be a maximum 30 second delay between power loss on the commercial power grid and backup power being provided to the HELAMS. 1.2.5 The Contractor shall ground the HELAMS (see enclosure 4) to prevent electrical shock to personnel in accordance HELAMS technical manual. 1.2.6 The Contractor shall provide repair parts/installation for the HELAMS ECU on a reimbursable basis. 1.2.7 The Contractor shall perform all ECU maintenance and repairs with a certified heating venting and air conditioning technician. 1.2.8 The Contractor shall be required to have one (1) person designated as supervisor who shall be on call 24/7 for operations and maintenance issues. The supervisor shall be able to speak English and Spanish. 1.3 Period of Performance (PoP): The Contractor shall prepare the site's existing electrical power source for the connection to the HELAMS on 18 Jan 2016. The HELAMS will be set up on the site (by others) on 22 Jan 2016. The Contractor shall connect the power source to the HELAMS on 22 Jan 2016. The Contractor shall provide the electrical power service from 22 Jan 2016 to 28 Feb 2016, a period of 38 continuous days. 1.4 Government-furnished Equipment and Services: 1.4.1 The Government will provide and set up the HELAMS on a grass area in the North West corner of Hangar 2 behind Fire Station Building 250 next to Building 266. 1.4.2 The Government will provide electrical cabling (50 feet) to connect the HELAMS to the ATS. See enclosure 5. 1.5 General Information: 1.5.1 Quality Control: The contractor shall develop a Quality Control plan to include adequate inspection system, safety, and security. Inspections shall be performed to monitor the contract work and records are made available upon request to Government. 1.5.2 Quality Assurance: All work is subject to inspection and testing by the Government at all places and at all reasonable times to ensure compliance with the terms of the contract. 1.5.3 Recognized Holidays: No holidays are recognized. The Contractor shall be required to perform requirements outlined in the contract every day of the performance period. 1.5.4 Hours of Operation: The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this SOW when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential. 1.5.5 Site Access: Potential bidders are required to conduct site survey. Potential bidders may contact COR for additional technical information. 1.5.6 Place of Performance: The work to be performed under this contract is for US Army South Command at the specified site at Howard Panama Pacifico, Panama. 1.5.7 Type of Contract: The government will award a Firm Fixed Price contract. 1.5.8 Security Definitions: 1.5.8.1 Area of Responsibility. The U.S. Southern Command (USSOUTHCOM) area of responsibility (AOR) includes the geographic areas of Antigua and Barbuda, Argentina, Aruba, Barbados, Belize, Bolivia, Brazil, British Virgin Islands, Cayman Islands, Chile, Colombia, Costa Rica, Cuba, Curacao, Dominica, Dominican Republic, Ecuador, El Salvador, Falkland Islands, French Guiana, Grenada, Guadeloupe, Guatemala, Guyana, Haiti, Honduras, Jamaica, Martinique, Mayotte, Montserrat, Nicaragua, Panama, Paraguay, Peru, Saint Barthélemy, Saint Martin, Saint Kitts and Nevis, Saint Lucia, Saint Vincent and the Grenadines, Saint Maarten, Suriname, Trinidad and Tobago, Turks and Caicos Islands, Uruguay, and Venezuela. 1.5.8.2 Local Nationals. For the purpose of this clause or provision, a local national (LN) is defined as any person who is performing services under a contract and is a resident of any country within the USSOUTHCOM AOR. 1.5.8.3 Third Country Nationals. For the purpose of this clause or provision, a third country national (TCN) is defined as any person, regardless of citizenship, who travels into the USSOUTHCOM AOR from outside of the USSOUTHCOM AOR. This includes personnel who are citizens of the country where performance of the contract is being conducted, but reside outside of the USSOUTHCOM AOR. For this purpose, non-DOD contractor personnel are considered traveling under DOD sponsorship. 1.5.9 Security Requirements: The Contractor shall coordinate access with Panama Pacifico at Howard Airport with Mr. Castillo at cell # 6535-8574, as well as with SENAN, Teniente Chacon, at cell # 6701-5571 or the SENAN Sala de Guardia at # 6018-6282. 1.5.9.1 Background Checks. At the time of award of the contract or when hiring new contract workers, the Contractor shall ensure contractor employees and subcontractor employees performing services under this contract have passed a security check done by the Host Nation Police Department of their residence or the State Police Department of their U.S. residence. Security checks that have been completed as part of a security clearance background investigation, or a previous background check that was a condition of employment, meet this requirement. Documentation of these checks will be made available to the Government Representative upon request. The Government retains the right to exclude any employee from performance of duties under this contract if a security check reveals information an employee is a security risk. The exclusion of an employee for security reasons will not relieve the Contractor from performance of services required under this contract. If the Government determines additional background checks are required, at a minimum, and upon request from the Government, the Contractor shall provide to the Government Representative, the following information on any contractor or subcontractor employee performing services under this contract: • Full birth name • Married name (if applicable) • SSN or local equivalent (ID card number) • Date of birth • Place of birth (city, country) 1.5.9.1.1 If a background check on any employee performing services under this contract, whether the check was conducted as a condition of employment or as part of the contract with the Government, reveals any information from any source (including host country law enforcement) of criminal activity by Contractor employees, subcontractors, or subcontractor employees, the Contractor shall immediately: • Notify the Government Representative of that information; and • Any actions taken against Contractor employees, subcontractors, or subcontractor employees pursuant to this clause. • Traffic violations, other than parking, will be reported to the Government Representative only if the contract is for drivers for the Government. 1.5.9.1.2 The Contractor shall also immediately- • Notify the Government Representative of any suspicious activity by Contractor employees, subcontractors, or subcontractor employees the Contractor believes may pose a risk to U.S. or host nation national security or imminent risk of deadly bodily harm to any person; • Any actions taken against Contractor employees, subcontractors, or subcontractor employees pursuant to this clause. 1.5.9.1.3 Remedies. In addition to other remedies available to the Government, the Contractor's failure to comply with the requirements of this paragraph may result in- • Requiring the Contractor to remove a Contractor employee or employees from the performance of the contract; • Requiring the Contractor to terminate a subcontract; • Suspension of contract payments; • Loss of award fee, consistent with the award fee plan, for the performance period in which the Government determined Contractor non-compliance; • Termination of the contract for default or cause, in accordance with the termination clause of this contract; or • Suspension or debarment. 1.5.9.1.4 Subcontracts. The Contractor shall include the substance of this paragraph in all subcontracts. 1.5.9.2 Identification. If required by the Government, contract personnel and all associated sub-contractors employees accessing U.S. facilities or activities, shall present a valid picture ID provided by the Government while accessing Government owned or contracted facilities and shall adhere to facility security policies and restrictions. If applicable, Government issued access badges will not be worn outside designated facility where visible to the general public. 1.5.9.3 Vetting. The Contractor and all associated sub-contractor companies, must have been vetted by the US Embassy in the country which the contract will be performed. For the purposes of this contract, the company is considered vetted if the company is located in the country which the contract will be performed unless the company has been previously barred from performing services for the Government. If during a previous vetting process the company was barred from performing service for the Government, then that is grounds for termination of the contract. If the company is located outside of the country which the contract will be performed, the company must be vetted by the US Embassy in the country of performance. Vetting will be coordinated through the US Embassy's DOD Security Cooperation Office in the country of performance. If during any previous vetting process in other countries, the company was barred from performing services for the Government, it would be grounds for termination of the contract. 1.5.9.4 Medical Requirements. Contractor will ensure that all contractor employees and subcontractor employees are medically, dentally, and psychologically fit for performance of their contracted duties. 1.5.9.5 Installation Access. Contractor and all associated sub-contractor employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures. The employee performing services under this contract shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services, Security Office or the host nation equivalent. 1.5.9.6 FPCON. In addition to the changes otherwise authorized by the changes of clause of contract, should the US Government Force Protection Condition (FPCON) at any individual installation change, the Government may require changes in contractor security matters or process. During FPCONs Charlie and Delta, only contract services that have been deemed "mission essential" by the Government will continue. Contract services will resume when the FPCON is reduced to Bravo or lower. 1.5.9.7 AT Awareness Training. Upon award of the contract, or within 30 days of employment of new personnel performing services under this contract, the Contractor will coordinate with the supporting DoD Agency AT Officer through the Government Representative (GR), for AOR specific AT awareness training for U.S. based contractor employees and associated subcontractor employees. This training will be updated as required by the supporting installation AT policies. Verification of the training will be made available to the GR upon request. 1.5.9.8 OPSEC Awareness. If the contractor, or a sub-contractor, or employees of either disclose any information that disrupts or harms the Government's operations or activities, then the Government retains the right to exclude any employee from performance of duties under this contract. The exclusion of an employee for security reasons will not relieve the Contractor from performance of services required under this contract. By way of example, personnel shall not sketch or take photos of government facilities or activities, unless related to service to be provided. Personnel shall not post or discuss government facility activities on any unauthorized public access media. All government paper products and removable digital storage material that is received, generated, or stored during the contract will be destroyed completely when no longer needed to preclude recognition of information. 1.5.9.9 Advertisement and Social Media. The contractor shall NOT post information to public website or social media locations, personal or professional, that in any way disclose conference names, locations, hotel data, conference participants, discussions, pictures, etc. before, during or after the conference without the express consent of the Government. 1.5.9.10 Travel Requirements. Contractor will ensure that all U.S. citizen or resident, and TCN contractor employees and subcontractor employees performing services under this contract who are traveling into the USSOUTHCOM AOR follow the requirements identified in the Electronic Foreign Clearance Guide (FCG) at https://www.fcg.pentagon.mil/fcg.cfm and must have all necessary passports, visas, and other documents required to enter, exit or work in the USSOUTHCOM AOR; must have the appropriate DOD identity credential(s); must have the appropriate special area, country, and theater clearance as required in DOD Directive 4500.54E. Contractor personnel shall return all U.S. Government issued identification, to include the Common Access Card, to appropriate U.S. Government authorities within 5 days of the end of their travel or contractual duties. 1.5.9.11 Travel Training Requirements. All U.S. citizen or resident, and TCN contractor personnel must comply with the training requirements listed in the FCG. Verification of the training will be made available to the Government Representative upon request. Additionally, they must receive personal security training that includes at a minimum: • Safety and security issues facing employees within the USSOUTHCOM AOR. • Identifies safety and security contingency planning activities. • Identifies ways to utilize safety and security personnel and other resources appropriately. 1.5.9.12 Travel Medical Requirements. All U.S. citizen and third country national (TCN) contractor and sub-contractor personnel traveling into the USSOUTHCOM AOR from outside the USSOUTHCOM AOR must meet the medical screening requirements established by the USSOUTHCOM Commander in the Medical Suitability Screening Regulation (SC Reg 40-501), as well as the requirements identified in FORCE HEALTH PROTECTION (FHP) GUIDANCE FOR DEPLOYMENT in the USSOUTHCOM AOR or their successors and follow immunization and health protection guidelines outlined therein. All immunizations must be obtained prior to traveling to the USSOUTHCOM AOR. U.S. citizen and TCN contractor and sub-contractor personnel traveling from a country outside of the USSOUTHCOM AOR must travel into the USSOUTHCOM AOR with a current copy of the Public Health Service Form 791, "International Certificate of Vaccination". In addition, U.S. citizen and TCN contractor and sub-contractor personnel traveling to the USSOUTHCOM AOR are required to be beneficiaries of a medical evacuation plan and service through an insurance plan provided by their employer or paid for individually. 1.5.9.13 DNA Samples. The Contractor shall collect a DNA record for all U.S. citizen contractor and sub-contractor personnel traveling to the USSOUTHCOM AOR and shall have arrangements for storage of the DNA referenced specimen through a private facility or arrange for the storage of the specimen by contacting the Armed Forces Repository of Specimen Samples for the Identification of Remains (AFRSSIR) at http://www.afmes.mil/index.cfm?pageid=afdil.afrssir.overview or phone: (302) 346-8800. In addition, U.S. citizen contractor and sub-contractor personnel shall comply with the requirements of DoDI 3020.41, Enclosure 3, para 8.b., or its successor. 1.5.9.14 Synchronized Pre-deployment and Operational Tracker (SPOT). Upon award of this contract, or employment of new personnel, the Contractor will enter contractor employees and sub-contractor employees performing services under this contract into the SPOT database who meet one of the following conditions: • All U.S. citizen and resident, and third country national (TCN) personnel who travel into the USSOUTHCOM AOR for periods of performance anticipated to exceed 30 consecutive days. • TCN, host nation (HN), or local national (LN) personnel who reside with or work in the immediate vicinity of U.S. Armed Forces and/or DOD Civilian personnel for periods of performance anticipated to exceed 30 consecutive days. • Private security contractors and contingency contractor personnel authorized to carry weapons regardless of proximity to U.S. Armed Forces or DOD Civilian personnel and regardless of the length of the anticipated period of performance. • Contractor and sub-contractor personnel with a place of performance in the continental United States, including the USSOUTHCOM Headquarters and Joint Interagency Task Force-South (JIATF-S) Headquarters, that may, within the terms of the contract, deploy to the USSOUTHCOM AOR for periods anticipated to exceed 30 consecutive days. The Government Representative will approve all employees in the SPOT database and a Letter of Authorization (LOA) is generated to the Contractor on each employee. The signed LOA is required prior to travel to, from, or within the USSOUTHCOM AOR. The LOA also will identify any additional authorizations, privileges, or Government support to which Contractor personnel are entitled under this contract. The LOA will be regenerated by the Contractor upon expiration of the LOA. Changes to the status of individual personnel relating to their in-theater arrival date and their duty location, to include closing out the trip with their proper status (e.g., mission complete, wounded, etc.) shall be annotated within the SPOT database in accordance with the timeliness established in the SPOT business rules. Information and standards for the SPOT system is posted on the U.S. Government Foreign Clearance Guide website at https://www.fcg.pentagon.mil/fcg.cfm for the country of employment. Access to SPOT is https://spot.dmdc.mil. 1.5.10 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award meetings convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government. 1.5.11 Key Personnel: The Contractor shall provide a Contract Manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the Contractor when the manager is absent shall be designated in writing to the Contracting Officer. The Contract Manager or alternate shall have full authority to act for the Contractor on all contract matters relating to daily operation of this contract. 1.5.12 Identification of Contractor Employees: All contract personnel attending meetings, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed. 1.5.13 Data Rights: The Government has unlimited rights to all documents/material produced under this contract. All documents and materials, to include the source codes of any software, produced under this contract shall be Government owned and are the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government. These documents and materials may not be used or sold by the contractor without written permission from the Contracting Officer. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose. This right does not abrogate any other Government rights. 1.5.14 CONTRACTOR MANPOWER REPORTING (CMR): The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the US Government via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil/, and then click on the "Department of the Army CMRA" or the icon of the DoD organization that is receiving or benefitting from the contract services. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2015. Contractors may direct questions to the help desk by clicking on the "Send an email" which is located under the Help Resources ribbon on the right side of the login page of the applicable Service/Component's CMR website. 1.5.15 Insurance and Certifications. The Contractor shall obtain (at Contractor's own expense) any applicable types of insurance and certifications required by Panamanian law that is customary and ordinary for the type of work required in the Statement of Work (i.e., electrical, communication, etc). Insurance must meet Panamanian law dollar amount thresholds/limitations sufficient for normal and customary claims. The Contractor shall obtain Defense Base Act Insurance (DBA) if Panama does not have disability compensation and medical benefits for employees. This insurance is required in accordance with FAR clause 52.228-3 Workers' Compensation Insurance (Defense Base Act). The estimated amount will be adjusted throughout the contract periods as necessary using projected and actual labor expenditures.
