Description
It is the intent of the National Library of Medicine (NLM) to enter into a sole source procurement with Beijing Book Co Inc. for the purpose of acquiring a serial subscriptions. The provided supplies and services are proprietary and commercial as defined in Far Part 2. The Beijing Book Co Inc. is the only known source capable of providing the required supplies and services and is the only known source to NLM that can meet the above requirements since this procurement is a continuation of the existing services to provide serial subscriptions to enhance NLM's collection. Orders for new subscriptions may be issued by NLM at any time during the year. Beijing Book CO. Inc.is the only known source to provide the breadth and totally of unique serial subscriptions required by NLM. This action is under the authority of 41 U.S.C.253 (c) (1), as set forth in FAR 6.302-1 and HHSAR 306.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. This acquisition will be processed under FAR Part 12 - Acquisition for Commercial Items and will be made pursuant to the authority in FAR Part 13 to use simplified acquisition procedures for commercial acquisitions. The North American Industry Classification System Code Libraries and Archives 519120 the business size standard is $15.0. This solicitation incorporates provision and clauses in effect in the FAC 2005-83-3 FAR Revision effective November 1, 2015, including all FAR Circulars issued as of the date of this synopsis. NLM anticipates that an award will be made on or about December 23, 2015. This is not a solicitation for competitive quotations, nor is a RFQ available. However, if any other interested party believes that it can meet the requirement it may submit a statement of capabilities. The capability statement and any other information furnished must be in writing, and must contain material in sufficient detail to all NLM to determine if the party can meet all of the foregoing requirements. Quotations must be accompanied by descriptive literature, warranties, and/or other information that demonstrates that the vendor is capable of successfully performing the requirement. Vendors shall comply with all applicable Federal, State and Local laws, executive orders, rules and regulations applicable to its performance under this order. The following clauses and provisions cited herein are incorporated by reference into this announcement: FAR 52.212-1, Instructions to Offerors-Commercial Items (OCT 2015), FAR 52.212-2, Evaluation-Commercial Items (OCT 2014). Offerors are advised to provide with their offer a completed copy of the following provisions: FAR 52.212-3, Offeror Representations and Certifications- Commercial Items (NOV 2015)-With DUNS Number Addendum [52.204-6 (JUL 2013)]. The following FAR clauses apply to this acquisition: FAR 52.212-4, Contract Terms and Conditions-Commercial Items (MAY 2015)-With Addenda [Stop Work Order, FAR 52.242-15 (AUG 1989) and Year 2000 Compliance (July 1997)]; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items (NOV 2015), as well as the following clauses cited therein: FAR 52.232-18, Availability of Funds (APR 1984); FAR 52.242-15, Stop Work Order (AUG 1989) with Alternate I (Apr 1984); FAR 52.242-17, Government Delay of Work (APR 1984); and FAR 52.232-33, Payment by Electronic Funds Transfer-System for Award Management (JUL 2013).
