- For market research purposes, this is a sources sought is for Regulated Medical Waste Disposal (see SOW below). An IDIQ contract with base plus 4 option years will be awarded to an SDVOSB. I.Description/Specifications/ STATEMENT OF WORK: a.The Minneapolis Veterans Affairs Health Care System (MVAHCS) @ 1 Veterans Drive, Minneapolis, MN 55417 has a need for hauling, treatment and disposal of Regulated Medical Waste. Contractor is to supply all bags, tags, waste carts and associated material for packaging and transport of all medical waste. The items must meet all federal, state, OSHA and DOT standards for collection, storage and transport of medical waste. Carts must have wheels and be in good repair at all times. Carts must be appropriately labeled as medical waste carts. b.Contractor is responsible for providing a detailed manifest of all medical waste transported from the Minneapolis VA Healthcare System to include the date, location and proof of destruction. All medical waste collected from the VA will be weighed on site and a copy of the manifest stating the date collected, pounds of medical waste per cart and the number of carts must be left with the Contracting Officer Representative (COR) or his designee on the day of collection. The contractor is required to provide a signed and legible manifest attesting to the destruction of the medical waste is to be provided to the Director, Environmental Management Service within 30 days of the destruction of the medical waste. (i)Quantities indicated in the schedule of items are estimated. The MVAHCS makes no commitment concerning the minimum or maximum poundage of waste, which will be required for disposal by the Contractor. The amount of services requested from the Contractor will be determined solely by the MVAHCS (ii)Contractor will provide a certifiable weighing system to enable proper billing for waste poundage disposed; i.e., if the disposal container weighs 14 pounds and Contractor is to dispose/haul 10 containers, each container will be weighed and container total weight (140 pounds) is subtracted from the gross weight to determine total waste poundage to be paid. (iii)Rates are all inclusive of containers, vehicle(s), and the services of qualified vendor. Also included is delivery, set-up, disinfection of equipment or any other services called for by this solicitation. (iv)Service will be in the form of "Full Service", with contractor pickup up RMW from the MVAHCS soiled utility rooms throughout the hospital, and providing all additional packaging, manifesting for treatment and disposal per federal, state and local regulations. (v)The contractor is responsible for training medical center staff on the use, handling and care of the reusable sharps containers. Training will be documented and provided 24-7 during installation to ensure that training is available to all employees. c.Preferred method of treatment of Regulated Medical Waste is by means of autoclaving. (i)Offsite decontamination of infectious waste by autoclaving must be achieved in the following manner: i.Infectious wastes must be autoclaved at 250 degrees Fahrenheit at 15 pounds per square inch of gauge pressure for one hour or at least equivalent settings. ii.Loading of infectious waste must not exceed the design capacity of the autoclave. iii.An operating log for each load of infectious waste decontaminated must be kept onsite for three years and must contain the date, time, temperature, pressure and operator name. d.Waste may not be compacted or mixed with other waste materials prior to destruction and disposal. e.Contractor's RMW waste disposal facility will meet all OSHA, CDC, EPA and DOT requirements for operation f.Transportation and Vehicle: Vendor to avoid mechanical loading devices which may rupture packaged waste; use leak-proof vehicle and appropriate means to prevent, tip-overs, scattering, spillage or fall-offs during transport. Label transport vehicle with universal biohazard symbol; transport vehicle will not be left open nor unattended. Should medical waste be released during the performance of services under this contract, through no fault of the VA facilities, the Contractor will be responsible for all costs associated with the satisfactory remediation of the incident. This will include the cost of all labor and materials as well as any actual damages incurred to the facility and harm caused to patients, visitors and staff of the medical center. The remediation efforts shall be performed to the satisfaction of the cognizant regulatory authorities and the facility COR. g.Inspection by the VA Inspection Team and/or Safety Engineer may be made of the establishment facilities, vehicles and equipment; and maintenance records of vehicles and equipment anytime during the term of the contract. h.Offerors are required to furnish the following information to Director, Environmental Management Service: (i)Current waste transporter permit(s) the contractor and subcontractors (ii)List of all transfer stations, treatment, storage and disposal facilities (TSDFs) including incineration, disposal and treatment facilities that shall be utilized during this contract to include the capacity of these facilities and the waste streams they are permitted to accept by treatment technology. Address, phone number and other contact information shall be provided. The VA reserves the right to inspect each of these facilities before approving its use or at any time during or after contract period while VA wastes are present. (iii)Copy of Operator permit(s) (iv)Certificates of training and experience of contractor/subcontractor staff and/or personnel who will perform site work under this contract (all technicians that will work on VA premises will be expected to have received at least the minimum training required by law as specified in 29CFR 1910-120, 40 CFR Parts 260-265 and 49 CFR Parts 171-178). (v)Provide the contractor's/subcontractor experience in regulated medical waste packaging, transport, and disposal. (vi)Provide a copy of US EPA identification number(s) certificate for each business entity operated or contracted by the contractor that will provide service regarding any aspect of VA waste disposal program (i.e. storage, transfer, incinerator sites). (vii)Provided a copy of certificate of registration with the State EPA as a hazardous waste hauler for each business entity operated by the contractor that will provide hazardous waste transportation services for any aspect of VA waste disposal program, if applicable. (viii) Provide written acknowledgement of responsibility for acquisition of all applicable business licenses and permits required by law. Contractor shall certify that it acknowledges and is in possession of all required business licenses and permits. (ix)Provide a list of any violations and/or citations that the contractor and subcontractors have received for non-compliance with any hazardous waste laws, permit requirements, and/or OSHA requirements for the past three years from the date of submission. Contractor shall include information on all related business entities including associated firms that are owned by the contractor or owned by a common parent company that will be involved in any portion of the processing of VA waste disposal program. If no discharge or violations have occurred, contractor must provide a statement that certifies no discharges or violations have occurred. (x)Provide a plan describing Standard Operating Procedures (SOPs) that will be followed while conducting normal regulated medical waste management activities. The contractor shall describe: 1.Site safety and contingency procedures (e.g. spill management). 2.Operational procedures and site management structure. 3.Supplies and equipment practices. 4.Packing procedures. 5.Quality assurance and quality control procedures to ensure materials are properly identified, categorized, and packaged, and paperwork is properly completed. 6.Procedures for gaining waste acceptance into a transfer/ disposal facility. 7.Contractor and project management procedures. (xi)Provide the following information regarding the waste fleet owned and operated by the contractor: 1.Basic description of transportation services offered and capabilities. 2.Fleet description of number, types, and ages of vehicles. 3.Description of service and maintenance programs. 4.Types of materials licensed to haul. 5.Latest DOT or MCS rating (include a copy of the last inspection). 6.The DOT/MnDOT compliance record. 7.Description of driver qualifications including training programs, and experience. 8.Provide evidence that background checks have been performed on all employees that will perform any duties under this contract. (xii)Provide the following information on the contractor's emergency response (ER) capabilities (or any changes to original submission): 1.Contractor's ER policies. 2.ER capabilities and experience and limitations. 3.Type of ER equipment maintained (specify if owned or subcontracted and from whom). 4.Personnel availability, training and experience. 5.Contractor's emergency response procedure shall describe: a.How to request an emergency response. b.How the contractor notifies personnel and initiates response action. c.Incident command procedures followed by the contractor. d.ER work practices. e.ER protection of health and safety practices. f.ER invoicing policy. (xiii)Provide a detailed site safety plan that will be used to ensure that workers and nearby population will be adequately protected during packaging and removal operations. (xiv)Provide information identifying any proposed subcontractors and identifying services to be performed by the subcontractors. Contractor must submit evidence that subcontractor is qualified and legally able to provide services. (ALL subcontractors must be approved by the facility and Contracting Officer prior to performing any duties under this contract). The Government reserves the right to prohibit the contractor from employing the services of a subcontractor who does not possess the ability to satisfactorily perform in accordance with the provisions of this solicitation. The use of a subcontractor or subcontractors, does not relieve the contractor any requirements set forth in this solicitation The contractor is responsible for ensuring that any subcontractor(s) perform in accordance with the terms and conditions of this solicitation Subcontractors will also comply with (j) of this section. (xv)Provide a list of names, titles, addresses, telephone numbers (including cellular), pager/beeper numbers, facsimile numbers and e-mail addresses of key managers, supervisors, customer service and field service personnel performing under this contract. (xvi)Provide a single point of contact for each facility with backup. i.Contractor is to provide a documented back-up plan in the event circumstances disrupts his ability to provide pick-up services. Service will be provided within 24 hours of a failure to meet scheduled pick-up times. j.Pricing - All services are to be based on a price per pound that includes all bags, tags, waste carts, transportation, disposal, manifesting and tracking of the medical waste. k.The estimated annual poundage of medical waste produced by the medical center is between 50,000 and 57,000 pounds. This is subject to unexpected change (+ -10 - 15 %) due to changes in the medical centers scope of work. l.Contractor is to supply all sharps containers, mounting brackets, and single mobile carts (Approximately 20 single mobile cart units will be required capable of holding any of the different size containers for use in Intensive Care Units, Operating Room, Dialysis, etc.) and bulk transport carts. The items must meet all federal, state, OSHA and DOT standards for collection, storage and transport of medical waste/sharps. All mobile carts and bulk transport carts must have wheels and be in clean and in good repair at all times. Minimum requirements for the reusable sharps containers is as follows: 1.Reusable 2.Puncture proof 3.Pre-Assembled 4.Leak proof 5.One hand/one step disposal mechanism 6.Overfill protection 7.Secure tamper proof locking mechanism 8.Sight/view port 9.Large access opening but: with a restricted hand access that will not allow anyone (from child to adult) from getting his or her hand inside 10.Three (3) Sizes: 2 gal, 4 gal, and 8 gal 11.Three (3) Types: regular restricted access top (all sizes), OR open top (8 gal), 12.Must have a system identifier to track usage 13.Able to be Highly disinfect/sterilize m.Contractor is responsible for training medical center staff on the use, handling, and care of the reusable sharps container. Training will be documented and provided 24 hours, 7 days a week during installation to ensure that training is available to all employees. Training schedule will be mutually agreed upon between contractor and VA. n.Contractor is responsible for removal of existing sharps container wall brackets and installation of their sharps container wall brackets. Wherever feasible the contractor will mount their wall brackets in the same location as the existing wall bracket being removed. All sharps container brackets that are wall mounted must be mounted in accordance with industry standard ergonomics when possible. o.Contractor is responsible for providing a detailed manifest of all medical sharps container waste transported from the VA Medical Center to include the date, location and proof of destruction. All medical sharps container waste collected from the VA will be identified on the manifest stating the date collected, number and size of the used containers collected and the number and size of the clean containers returned. A copy of the manifest must be left with the Contracting Officer Technical Representative (COTR) or his designee on the day of collection. The contractor is required to provide a signed and legible manifest attesting to the destruction of the medical sharps waste is to be provided to the Director, Environmental Management Service within 30 days of the destruction of the medical waste. p.Waste pick-up will be provided once per a week from the hospital's designated waste holding area. The day for pick-up will be Wednesday between 6:00 a.m. and 3:30 p.m. q.Contractor is responsible for delivering replacement sharp containers that are certified to have been cleaned/sterilized and are in proper working condition prior to delivery to the medical center (containers returned to the medical center must be clean with no visible signs of blood or body fluids). Contractor is responsible for tracking number of times sharp container is reused and removing from service any containers that have been used the maximum allowable times. r.Contractor is to provide a documented back-up plan in the event circumstances disrupts his ability to provide pick-up services. Service will be provided within 24 hours of a failure to meet scheduled pick-up times. 1.SUPERVISION BY CONTRACTOR: The contractor shall appoint a project manager who will have responsibility for performance of medical waste removal services. The project manager or designee shall be competent to supervise all aspects of medical waste removal services and shall be available on-site within 3 hours after notification when problems arise with contractor's work or in the event that emergencies arise at this facility, which pertains to the contractor's responsibilities or duties. The project manager shall, in the absence of the contractor, act for the contractor as contractor's representative. 2. PERSONNEL QUALIFICATION AND REQUIREMENTS: a.Uniforms and Employer Identification: All of the contractor's personnel assigned to the performance of this contract are to wear a uniform that is clearly distinguishable from all VA uniforms and a PIV badge to clearly identify company name and employee name. b.Exposure to Hazardous Working Conditions: Contractor's personnel may be required to perform work under potentially hazardous conditions. Contractor's personnel shall be informed of potentially hazardous situations by contractor, trained by contractor in techniques required to recognize and deal with potentially hazardous situations in a manner which will minimize personal risk, and required to adhere to standard techniques for personal protection. c.Other Requirements: All contract personnel to be instructed that smoking is prohibited in buildings and only allowed in designated outside smoking areas as identified. d.Contractor must ensure their personnel working at this facility possess basic proficiency in spoken and written English. e.All conduct of contract personnel should be respectable and sensitive to patients, visitors and VA personnel. 3.QUALITY CONTROL/QUALITY ASSURANCE: a.Quality Control: The contractor shall have a Quality Control Program to ensure the requirements of this contract are provided as specified. The program shall include, but will not be limited to, the following: (i)An inspection system covering the services listed in Scope of Work. It must specify areas or work to be inspected on a scheduled basis. (ii)A method of identifying deficiencies in the quality of services performed before the level of performance becomes unacceptable. (iii)A record of all inspections conducted by the contractor and corrective action taken. These documents shall be made available to the Government during the term of the contract. b.Reporting Repairs: The contractor is to report all repairs or maintenance required by VA associated with work performed and VA responsibilities. c.Federal and State Regulatory Requirements: The contractor to comply to all federal and state waste handling requirements relating to both non-infectious waste and infectious/contaminated medical waste when hauling such materials from VA properly to appropriate collection site of waste hauler. Contractor will be compliant in the following: d.Regulated waste under the Federal Bloodborne Pathogens standard (BBP) found at 29 CFR 1910.1030 e.Regulated medical waste under the Federal Hazardous Materials Regulations (HMR) found at 49 CFR 173.134, administered by the U.S. Department of Transportation (DOT). This includes any laws in other states that are applicable to the transportation of infectious waste across state lines f.Guidelines required by Center for Disease Control (CDC). g.Guidelines required by EPA h.Other applicable regulating agencies 4.SAFETIES AND FIRE PREVENTION: a.Contractor shall provide all safety equipment for their employees in the performance of this contract while on government property and shall abide by safe working standards. b.In the performance of this contract, the contractor shall take such safety precautions as necessary to protect the lives and health of occupants of the building. c.The contractor shall immediately correct any fire and safety deficiencies caused by his/her employee. If the contractor fails or refuses to correct deficiencies promptly, the contracting officer may issue an order stopping all or any part of the work and hold the contractor in default of the contract. d.The contractor shall comply with applicable federal, state and local safety and fire regulations and codes that are in effect at the beginning of the contract period. The contractor shall keep abreast of, and comply with, changes in these regulations and codes applicable to the contract. e.The contractor is to provide copies of all MSDS Forms to Facility Management Service for all chemical products used by the contractor. EPA must approve all chemicals used. f.While at the Minneapolis VA Medical Center, all contractors, their supervisors and their employees shall comply with the Hospital and Safety Regulations and with the Occupational Safety and Health Act of 1970. The following is a list of the most common violations of Hospital Safety Regulations and OSHA Standards, which will be most closely monitored and enforced as part of this contract. g.Occupation Injuries: All injuries sustained by workmen while on the VA Medical Center property must be reported to the Safety Manager. h.Safety Inspections: The Medical Center Safety Manager and Project Inspectors will conduct periodic inspections of work area for compliance with hospital regulations and OSHA Standards. Failure to comply with the hospital regulations and OSHA Standards may result in immediate work stoppage. Injuries to patient, employees and visitors resulting from unsafe conditions or negligent acts created by work may result in legal action on the part of the injured. i.Enforcement: The COR on this project is designated as the person responsible for ensuring that the Fire and Safety Program Is carried out to the completion of the work performed and has the authority to enforce the provisions of these specifications and other applicable fire protection standards. 5.DAMAGE AND EQUIPMENT LOSS: a.All tasks accomplished by contractor personnel will be performed to preclude damage or disfigurement of government-owned furnishings, fixtures, equipment, and architectural or building structures. The contractor will report any damage or disfigurement to these items when caused by the contractor's personnel. This report will be given to the quality assurance evaluator. All damage to facilities and fixtures caused by the contractor during work performance will be reported to the quality assurance evaluator. The Government is not held responsible for contractor's equipment or belongings that are lost, stolen or damaged. 6.INTERFERENCE TO NORMAL FUNCTION: Contractor's personnel are required to interrupt their work at any time to avoid interference with patient care procedures and the normal functioning of the facility, including utility services, fire protection systems, and passage of facility patients, personnel, equipment, and carts. 7.CLEAN UP: The contractor will remove all residue dirt and soil, or other substances that may be left over or caused by contractor's work. 8.POLICY: All Contractors' employees should be respectable and sensitive to patients, visitors and VA personnel. Contractor's employees shall be neat and clean in appearance. All of the contractor's personnel assigned to the performance of this contract are to wear a uniform that is clearly distinguishable from all VA uniforms and name badge to clearly identify company's name an employee name. The VA Medical Center is a drug free and smoke free workplace. 9.TRAINING/LICENSES: The VA Medical Center will provide orientation and training on VA policies and procedures. All Contractor employees will be required to attend a facility orientation program on safety, health, and emergency procedures. This training will be scheduled at a post award meeting at a mutually agreeable date. 10. CLAIMS/DAMAGES: Any claims of damage or missing/stolen property will be the responsibility of the contractor. The VA assumes no responsibility for such claims.
