Description
The purpose amendment 9 is to provide changes (1) and provide an (2) answer the question below. (1) SECTION 5: ATTACHEMENTS Factor 3 is deleted and replaced with the following: 3. Offeror's Qualifications/Past Performance: To be technically acceptable under this factor the Offeror shall provide three references for experience relative to lease actions, including name and telephone number of individuals. Offerors will be provided Past Performance Questionnaires to be forwarded to their selected references. The Past Performance Questionnaires are provided in ATTACHMENT I - PAST PERFORMANCE SURVEY. Offerors that do not have any relevant, past performance must provide a certification that they do not have relevant past performance. Offerors who certify that they have no relevant past performance will be rated as neutral. a. Is the past performance source relative to a lease space b. Is the past performance information current c. Is the general trend of the Offeror's Past Performance acceptable d. Did the Past Performance Surveys indicate that the Lessor met the needs of the Tenant (2) Question: Can you please confirm if the following terms are acceptable? We will be proposing a 5 year lease whereby Americorp can terminate the lease any time after year 1 with 365 days' notice. Please confirm that this will be acceptable. Answer: The RLP SECTION 1, Paragraph 1.02 unfortunately can-not be changed. Also the second paragraph is edited to include the adjustment range. F. The lease term will be 1 Years Base/Firm, with four (4) 1-year Options, with Government termination rights, in whole or in part, effective at any time after the Firm Term of the Lease by providing not less than 60 days' prior written notice. Each option renewal term shall be based on "Consumer Price Index - Seasonably Adjusted U.S. City Average for All Urban Consumers" published by the bureau of Labor Statistics of the United States Department of Labor ("CPI-U") Indicator. The amount of the adjustment increase or decrease shall be determined by multiplying the CPI-U Indicator published sixty (60) days prior to the anniversary of the commencement date of the base lease by the annual rental rate stated in the lease. Provided, however, in no event may the CPI-U indicator for any one year be greater than 5.0%.
