- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (J&A) 1. Contracting Activity: The Defense Logistics Agency, Troop Support (DLA-TS), Directorate of Construction and Equipment. 2. The action being approved is solicitation SPE8EE16Q0061 for supplies on OTHER THAN FULL AND OPEN COMPETITION basis. 3. The contract will provide for the purchase of three (3) Hoist Chains - NSN 3950-01-036-8732, manufactured by 3HHC6 TOOL HOUSE INC., THE P/N 75113CA7 Following is a description of the NSN required to meet DLA's needs: Item Description (Application) NSN Quantity Unit Price Hoist Chains NSN 3950-01-036-8732 3 $57,174.79 This is a one-time buy with no options. The total estimated value of this buy is $171,524.37. It will be awarded as a fixed price contract 4. The applicable statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c) (1), only one responsible source and no other supplies will satisfy agency requirements (FAR 6.302-1). This solicitation comes under FAR 13.5-Simplified Procedures for Certain Commercial Items. 5. This item is Sole Source restricted to THE TOOL HOUSE INC (3HHC6) under P/N 75113CA7. It is a pneumatic powered chain with a 4300 pound capacity, a 15 foot list @ 16 FPM lift speed. Pneumatic powered operated low head room hoistractor trolley mounts 6-1/2 inch hear room. Hoist has a link type load chain with swivel type safety hook. Trolley is a sprocket drive for number 80 roller chain. The trolley travels on a STD I-beam with 3 inch flange width. It has a 90PSI operating pressure with a 10 foot dual pendant included. Trolley it travel @ 40 FPM travel speed. The Product Specialist, Dawn Cockrell, has certified that the Government does not have the data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation to purchase NSN 3950-01-036-8732, from other than the source cited on the Purchase Item Description. Dawn Cockrell certifies that the data presently available reflects the minimum needs of the Government as listed and that all means to obtain a technical data package adequate for manufacture of the item have been exhausted. A MC/AMSC: 3 (Sole Source/Manufacturer)/ D - (Sole Source - Data to produce is not available). The Tool House Hoists are built to Military specifications. For an annual demand quantity of only 3 per year, makes it cost prohibitive to reverse engineer or purchase the TDP for this item. 6. A Market Research Survey was sent to the approved source as well as the various dealers who have quoted in the past on this and we had contact information. Market Research Surveys were sent to the following vendors and approved source: 3HHC6 THE TOOL HOUSE - tomj@toolhse.com - Approved Source 1N8T8 J GILS, LLC - JGoff@jgils.com - Dealer 7Z016 KAMPI COMPONENTS CO - ashley@kampi.com - Dealer 61125 J.G.B. ENTERPRISES, INC. DBA - dburton@jgbhose.com -Dealer The acquisition was also posted in FedBizOpps for Sources Sought for 18 days and the solicitation will be posted to DIBBS. Vendors interested will be solicited. We received three responses back from our Market Research survey. Responses were received from the Approved Source, THE TOOL HOUSE (3HHC6), JGILS, LLC (1N8T8) and Kampi (7Z016). No inquires or responses were received regarding the Sources Sought solicitation posted on FedBizOpps. 7. As the contracting officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable. Offers received will be subjected to price analysis considering current prices, historical prices and development of a Fair Market Price (FMP) based on current market conditions for similar items. 8. A sources sought notice was posted to FED-BIZOPPS. No Responses were received back for any interested manufacturers. 9. Drawings/ Specifications are not available, nor is this item suitable for Full and Open competition, due to the fact that the Government does not have the data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation. The item is manufactured only by THE TOOL HOUSE INC. (3HHC6) in accordance with their proprietary drawings and technical data, which are not available to the Government. The rights to use the data are not owned by the government. The technical certification indicates that the technical data is proprietary and will not support a brand name or an "or equal" full and open competitive procurement. 10. TOOL HOUSE INC. (3HHC6) is the sole manufacturer for this Pneumatic Powered Chain Hoist. 11. Defense Logistics Acquisition Directive (DLAD) 52.217-9002, Conditions for Evaluation and Acceptance of Part Numbered Items, encouraging the submission of offers for alternate products will be included in the solicitation in an attempt to remove barriers to competition before any subsequent acquisition takes place and to indicate that the contracting officer will consider all offers. 12. As the contracting officer, I hereby certify that this Justification is accurate and complete to the best of my knowledge and belief.
