DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K to $650K) For Restricting Competition under FAR 13.106-1(b)( 2) "Single Source" 1.Contracting Activity: Department of Veterans Affairs, VISN 20 facilities including: Roseburg Healthcare Systems, Boise VA Medical Center, Boise, ID; Alaska VA Healthcare System (AVAHS), Anchorage, AK; Mann-Granstaff VAMC, Spokane, WA; VAMC, Portland OR and Vancouver, WA; VA Walla Walla, WA, White City, OR; SORCC VAMC, and VA Puget Sound Health Care Systems; Seattle, WA. 2.Nature of the Action Being Processed: This is a request for other than full and open competition for the procurement of Linearity Materials for Proficiency Testing. There is only one vendor that provides this service. 3.Description of Supplies or Services Required to Meet the Agency's Needs: This procurement under request VA260-16-AP-0633 is for College of American Pathologists (CAP) Linearity Materials for Proficiency Testing for Pathology and Laboratory Medicine Service laboratories in VISN 20. The vendor will supply the facilities with Linearity materials for proficiency testing to meet accreditation requirements at each site. 4.Statutory Authority Permitting Restriction in Competition: The statutory authority for restricting competition under SAP, or Single Sourcing, for acquisitions Over $150,000 or Simplified Acquisition Threshold (SAT) is 41 U.S.C. 1901 ), as implemented by FAR 13.106-1(b)(2) for acquisitions of commercial items conducted pursuant to Subpart 13.5.. The specific reason for restricting competition is: Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements. 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): VISN 20 Laboratories are currently accredited by the College of American Pathologist and in order to maintain accreditation, certain standards need to be met. CAP Proficiency Checklist Standard CHM.13600, AMR Verification, states that the AMR (analytical measurement range) must be performed with matrix-appropriate materials which, at a minimum, include the low, mid and high range of the AMR, appropriate criteria are defined, and the process is performed at least every six (6) months and following defined criteria. The testing has to be completed with standardized materials so the results can be validated and compared with lab standards nationwide. CAP is the only source that can provide the required Linearity Materials needed for proficiency testing. 6.Description of Efforts Made to Ensure that Offers are Solicited from As Many Potential Sources as Deemed Practicable IAW FAR 13.104: The Contracting officer conducted commercial market research through the online internet and other resources as to other options that might be available including other vendors perform lab accreditation testing (see contract file). 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable - IAW FAR 13.106-3: The anticipated price to the Government is approximately $630,000.00 over 5 years. This will be a firm fixed price Blanket Purchase Agreement (BPA). 8.Description of the Market Research Conducted and the Results, or Statement of Reasons Market Research was not Conducted (FAR 10): Market research was performed. A search to all mandatory sources was conducted, the details of this market research can be found in the contract file briefcase.
