II.Disposal of Removed Parts and Articles 1)Contractor shall be responsible for removing staging equipment and disposing of all removed materials in accordance with the applicable manufacturer, industry, federal, state, and local guidelines. Contractor shall remove disposed materials offsite. VA dumpsters are not authorized. III.Code Compliance 1)All work shall comply with the latest applicable NFPA Codes, the latest applicable IBC, the select SFRM manufacturer specification sheets, and the UL Directory by a UL qualified SFRM contractor, or certified for application of the specific SFRM by the manufacturer. IV.Materials and Workmanship 1)Installer Qualifications: The Fireproofing Applicator shall be certified as a UL Qualified SFRM Contractor, or certified for application of the specific SFRM by the manufacturer. 2)Fireproofing materials shall be obtained from a single manufacturer for each type of fireproofing applied and match the existing SFRM material. 3)The requirements for application shall be based on testing conducted by Underwriters Laboratories in accordance with accepted standards for an hourly fire resistance rating of a structural member or assembly. 4)Notwithstanding any other terms and conditions of this contract, inspection of materials and articles furnished under this contract will be made at the site by the Contracting Officer Representative (COR) or their designee, unless otherwise provided for in the specifications. V.Safety Requirements 1)In the performance of this contract, the Contractor shall take such safety precautions as the Contracting Officer, or his/her designee, may determine to be reasonably necessary to protect the lives and health of occupants of the building. The Contractor shall have one supervisory employee, who will disseminate requirements to those who work at our facility and, report to the Safety Manager's office for training and overview before commencing work. The Contracting Officer or his/her designee will notify the Contractor of any noncompliance with the foregoing provisions and the action to be taken. The Contractor shall, after receipt of such notice, immediately correct the conditions to which attention has been directed. Such notice, when served on the Contractor or his representative at the site of work, shall be deemed sufficient for the purpose aforesaid. If the Contractor fails or refuses to comply promptly with such notice, the contracting Officer may issue an order stopping all or any part of the work and hold the Contractor in default. ? VI.Daily Work Report 1)Prior to each visit to the facility, Contractor's service representative shall notify the COR of the visit. The Contractor shall report to the Safety office, Room 4B-330, Building 100, 4th floor, Facilities Management Service, both upon arrival and prior to departure. Unless special arrangements are made, work shall be completed Monday-Friday (excluding federal holidays) between 8:00 a.m. and 4:30 p.m. Federal Holidays observed by the VAMC are: oNew Years' Day oMartin Luther King Day oPresidents' Day oMemorial Day oIndependence Day oLabor Day oColumbus Day oVeterans' Day oThanksgiving Day oChristmas Day *Or any other day declared by the President of the United States to be a Federal Holiday. 2)The Contractor shall furnish to the COR each day a consolidated report for the preceding work day which shows the work performed 3)The Contractor shall be able to obtain a VAMC PIV access badge. VII.Warranty 1)The Contractor warrants that work performed under this contract conforms to the contract requirements and is free of any defect in equipment, material, or design furnished, or workmanship performed by the Contractor. 2)This warranty shall continue for a period of one (1) year from the date of final acceptance of the work. 3)The Contractor shall remedy, at the Contractor's expense, any failure to conform, or any defect. In addition, the Contractor shall remedy, at the Contractor's expense, any damage to Government-owned or controlled real or personal property, when that damage is the result of- a) The Contractor's failure to conform to contract requirements; or b)Any defect of equipment, material, workmanship, or design furnished. 4)The Contractor shall restore any work damaged in fulfilling the terms and conditions of this clause. 5)The Contracting Officer Representative (COR) will notify the Contractor, in writing, within 10 days after the discovery of any failure, defect, or damage. 6)The Contractor shall remedy any failure, defect, or damage within 10 days or an agreed upon time frame after receipt of notice. If the Contractor fails to do so the Government shall have the right to replace, repair, or otherwise remedy the failure, defect, or damage at the Contractor's expense. 7)This warranty shall not limit the Government's rights under the Inspection and Acceptance clause of this contract with respect to latent defects, gross mistakes, or fraud. VIII.Delivery Schedule The Contractor shall be required to commence and finish all required work under this contract within 90 calendar days after the date the Contractor receives a copy of the signed contract. The time stated for completion shall include final cleanup of the premises. IX.Evaluation Factors: The Government will award a contract on the basis of the lowest priced technically acceptable of quote meeting or exceeding the acceptable standards for non-cost factors. 1)Technical: (a)In this factor, the offer shall submit with quote the Technical and Management Approach for the requirement outlined in the Statement of Work (SOW) for Fireproofing. The offeror shall provide a narrative addressing the operation plan for sufficient personnel, procedures, material, and certifications to perform the services required in the statement of work. 2)Past Performance (within the past three (3) years): (a)In this factor, the Government will evaluate the offer's demonstrating past performance of work of a similar nature, frequency, quality of performance and relevance to this procurement. (b)Past Performance Surveys: The contractor shall send out the attached past performance surveys to each of their references. The Government will evaluate the quality and extent of offeror's performance deemed relevant to the requirements of this solicitation. The references shall return the survey directly to the Government Contract Specialist listed on the survey via email. (c)Offerors should follow-up and encourage references to return the questionnaires to the Contracting Officer in a timely manner. (d)The government will use information sources such as PPIRS and CPARS and other Federal government offices and commercial sources to assess performance. Note: Offerors with no relevant past performance history will not be evaluated favorably or unfavorably on past performance and will be given a neutral rating. 3)Price: In this Factor, Price will be evaluated for reasonableness, completeness, and fairness by comparing the proposed prices with the Independent Government Estimate and quotes posed by other offers. Pass - Offeror has a minimum rating of acceptable for each factor. Any unknown rating is acceptable. Fail- Offeror does not have a minimum rating of acceptable for each factor. (1) 52.203-99 Prohibition on Contracting With Entities That Require Certain Internal Common Confidentiality Agreements (DEVIATION 2015-02) (FEB 2015) (2)52.217-8 Option to Extend Services (NOV 1999) (3)52.228-5Insurance-Work on a Government Installation (JAN 1997) (4)52.219-13Notice of Set-Aside of Orders (NOV 2011) (5)52.222-41Service Contract Labor Standards (MAY 2014) (6)52.222-99Establishing A Minimum Wage For Contractors (Deviation 2014-O0017) (June 2014). This clause implements Executive Order 13658, Establishing a Minimum Wage for Contractors, dated February 12, 2014, and OMB Policy Memorandum M-14-09, dated June 12, 2014. (a) Each service employee, laborer, or mechanic employed in the United States (the 50 States and the District of Columbia) in the performance of this contract by the prime Contractor or any subcontractor, regardless of any contractual relationship which may be alleged to exist between the Contractor and service employee, laborer, or mechanic, shall be paid not less than the applicable minimum wage under Executive Order 13658. The minimum wage required to be paid to each service employee, laborer, or mechanic performing work on this contract between January 1, 2015, and December 31, 2015, shall be $10.10 per hour. (b) The Contractor shall adjust the minimum wage paid under this contract each time the Secretary of Labor's annual determination of the applicable minimum wage under section 2(a)(ii) of Executive Order 13658 results in a higher minimum wage. Adjustments to the Executive Order minimum wage under section 2(a)(ii) of Executive Order 13658 will be effective for all service employees, laborers, or mechanics subject to the Executive Order beginning January 1 of the following year. The Secretary of Labor will publish annual determinations in the Federal Register no later than 90 days before such new wage is to take effect. The Secretary will also publish the applicable minimum wage on www.wdol.gov (or any successor website). The applicable published minimum wage is incorporated by reference into this contract. (c) The Contracting Officer will adjust the contract price or contract unit price under this clause only for the increase in labor costs resulting from the annual inflation increases in the Executive Order 13658 minimum wage beginning on January 1, 2016. The Contracting Officer shall consider documentation as to the specific costs and workers impacted in determining the amount of the adjustment. (d) The Contracting Officer will not adjust the contract price under this clause for any costs other than those identified in paragraph (c) of this clause, and will not provide price adjustments under this clause that result in duplicate price adjustments with the respective clause of this contract implementing the Service Contract Labor Standards statute (formerly known as the Service Contract Act) or the Wage Rate Requirements (Construction) statute (formerly known as the Davis Bacon Act). (e) The Contractor shall include the substance of this clause, including this paragraph (e) in all subcontracts. (7)CL-120In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract: (a) Workers' compensation and employers liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers. (b) General Liability: $500,000 per occurrences. (c) Automobile liability: $100,000 per person; $500,000 per occurrence and property damage. (d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage. (8)52.232-40 Providing Accelerated Payments to Small Businesses Subcontractors (DEC 2013) (9)52.237-3 Continuity of Services (JAN 1991) 11. VAAR CLAUSES: a. 852.203-70 Commercial Advertising (JAN 2008). The bidder or offeror agrees that if a contract is awarded to him/her, as a result of this solicitation, he/she will not advertise the award of the contract in his/her commercial advertising in such a manner as to state or imply that the Department of Veterans Affairs endorses a product, project or commercial line of endeavor. b. 001AL-11-15-A Limitations on subcontracting - Monitoring and Compliance (JUNE 2011). This solicitation includes VAAR 852.219-10. SDVOSB registration will be verified in System Award Management (SAM), Small Business Administration (SBA) and Vendor Information Pages (VIP). Quotes will be considered non responsive and rejected if the Contracting Officer is not able to verify and view contractor registrations. Accordingly, any contract resulting from this solicitation will include this clause. The contractor is advised in performing contract administration functions, the CO may use the services of a support contractor(s) retained by VA to assist in assessing the contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to contractor's offices where the contractor's business records or other proprietary data are retained and to review such business records regarding the contractor's compliance with this requirement. All support contractors conducting this review on behalf of VA will be required to sign an "Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement" to ensure the contractor's business records or other proprietary data reviewed or obtained in the course of assisting the CO in assessing the contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs. Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the contractor to protect proprietary information as required by FAR 9.505-4, obtaining access to proprietary information, paragraph (b). The contractor is required to cooperate fully and make available any records as may be required to enable the CO to assess the contractor's compliance with the limitations on subcontracting or percentage of work performance requirement. c. 852.232-72 Electronic Submission Of Payment Requests (NOV 2012) (1) Definitions. As used in this clause- (a) Contract financing payment has the meaning given in FAR 32.001. (b) Designated agency office has the meaning given in 5 CFR 1315.2(m). (c) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests. (d) Invoice payment has the meaning given in FAR 32.001. (e) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract. (2) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required. (3) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following: (a) VA's Electronic Invoice Presentment and Payment System. (See Web site at http://www.fsc.va.gov/einvoice.asp.) (b) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI). The X12 EDI Web site (http://www.x12.org) includes additional information on EDI 810 and 811 formats. (4) Invoice requirements. Invoices shall comply with FAR 32.905. (5) Exceptions. If, based on one of the circumstances below, the contracting officer directs that payment requests be made by mail, the contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for: (a) Awards made to foreign vendors for work performed outside the United States; (b) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information; (c) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies; (d) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or (e) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above. e. 852.237-70 Contractor Responsibilities (APR 1984) The contractor shall obtain all necessary licenses and/or permits required to perform this work. He/she shall take all reasonable precautions necessary to protect persons and property from injury or damage during the performance of this contract. He/she shall be responsible for any injury to himself/herself, his/her employees, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by his/her employees fault or negligence, and shall maintain personal liability and property damage insurance having coverage for a limit as required by the laws of the State of Texas. Further, it is agreed that any negligence of the Government, its officers, agents, servants and employees, shall not be the responsibility of the contractor hereunder with the regard to any claims, loss, damage, injury, and liability resulting there from. (End of Clauses) 52.252-1 SOLICITATION PROVISIONS INCORPORATED BY REFERENCE (FEB 1998) 12. FAR PROVISIONS: a. 52.219-27 NOTICE OF SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESS SET-ASIDE (NOV 2011) (a) Definition. "Service-disabled veteran-owned small business concern"- (1) Means a small business concern- (i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and (ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran. (2) "Service-disabled veteran" means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16). (b) Applicability. This clause applies only to- (1) Contracts that have been set aside or reserved for service-disabled veteran-owned small business concerns; (2) Part or parts of a multiple-award contract that have been set aside for service-disabled veteran-owned small business concerns; and (3) Orders set aside for service-disabled veteran-owned small business concerns under multiple-award contracts as described in 8.405-5 and 16.505(b)(2)(i)(F). (c) General. (1) Offers are solicited only from service-disabled veteran-owned small business concerns. Offers received from concerns that are not service-disabled veteran-owned small business concerns shall not be considered. (2) Any award resulting from this solicitation will be made to a service-disabled veteran-owned small business concern. (d) Agreement. A service-disabled veteran-owned small business concern agrees that in the performance of the contract, in the case of a contract for- (1) Services (except construction), at least 50 percent of the cost of personnel for contract performance will be spent for employees of the concern or employees of other service-disabled veteran-owned small business concerns; (2) Supplies (other than acquisition from a nonmanufacturer of the supplies), at least 50 percent of the cost of manufacturing, excluding the cost of materials, will be performed by the concern or other service-disabled veteran-owned small business concerns; (3) General construction, at least 15 percent of the cost of the contract performance incurred for personnel will be spent on the concern's employees or the employees of other service-disabled veteran-owned small business concerns; or (4) Construction by special trade contractors, at least 25 percent of the cost of the contract performance incurred for personnel will be spent on the concern's employees or the employees of other service-disabled veteran-owned small business concerns. (e) A joint venture may be considered a service-disabled veteran owned small business concern if- (1) At least one member of the joint venture is a service-disabled veteran-owned small business concern, and makes the following representations: That it is a service-disabled veteran-owned small business concern, and that it is a small business concern under the North American Industry Classification Systems (NAICS) code assigned to the procurement; (2) Each other concern is small under the size standard corresponding to the NAICS code assigned to the procurement; and (3) The joint venture meets the requirements of paragraph 7 of the explanation of Affiliates in 19.101 of the Federal Acquisition Regulation. (4) The joint venture meets the requirements of 13 CFR 125.15(b) (f) Any service-disabled veteran-owned small business concern (nonmanufacturer) must meet the requirements in 19.102(f) of the Federal Acquisition Regulation to receive a benefit under this program. (End of Clause) b. 52.203-98 PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN INTERNAL CONFIDENTIALITY AGREEMENTS-REPRESENTATION (DEVIATION) (FEB 2015) (1) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Resolution Appropriations Act, 2015 (Pub. L. 113-235), Government agencies are not permitted to use funds appropriated (or otherwise made available) under that or any other Act for contracts with an entity that requires employees or subcontractors of such entity seeking to report fraud, waste, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or contactors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information. (2) The prohibition in paragraph (a) of this provision does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information. (3) Representation. By submission of its offer, the Offeror represents that it does not require employees or subcontractors of such entity seeking to report fraud, waste, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information. c. 52.204-16 Commercial and Government Entity Code Reporting (NOV 2014) d. 52.204-17 Ownership or Control of Offeror 13. VAAR PROVISIONS: a. 852.252-70Solicitation Provisions Or Clauses Incorporated By Reference (Jan 2008) The following provisions or clauses incorporated by reference in this solicitation must be completed by the offeror or prospective contractor and submitted with the quotation or offer.
