Description
On January 19, 2016, the Technology Acquisition Center awarded Task Order VA118-16-F-0838 under the terms and conditions of National Aeronautics and Space Administration Solutions for Enterprise-Wide procurement V Governmentwide Acquisition Contract with TechAnax, LLC, located at 15000 Afton Ct., Montclair, VA 22025. TechAnax will be providing brand name Autodesk design and creation suites software licenses, which provides VA facility engineers with the platform necessary for creating and editing engineering designs, construction plans, and facility record drawings. The period of performance shall be from January 31, 2016 through January 30, 2017. The total order value is $164,060.86. JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: The proposed brand name acquisition is for a firm-fixed-price task order to be issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC). 3. Description of the Supplies or Services: The VA, Office of Information and Technology (OI&T), Service Delivery and Engineering, Field Operations Region 3 has a requirement to renew existing brand name Autodesk design and creation suites software licenses, which provides VA facility engineers with the platform necessary for creating and editing engineering designs, construction plans, and facility record drawings. The current support for the VA owned software expires on January 30, 2016, and as such, the period of performance required for continuation of license renewal, maintenance support, and upgrades under this effort is January 31, 2016 through January 30, 2017. 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited Above: This is a brand name justification in accordance with FAR 11.105, Items Peculiar to One Manufacturer. Based on extensive market research, as described in section 8 of this justification, the Government has determined that limited competition is available among authorized resellers of Autodesk software. Autodesk software is the only software that meets all Region 3 facility requirements to include providing users with the ability to edit, update, and transfer facility record drawings back and forth into the Automatic Computer Aided Design (AutoCAD) DraWinG (DWG) format, and be able to directly import existing files into the AutoCAD application. The license renewals and support coverage from an authorized reseller will provide product support and new version updates to the existing software. Only Autodesk, or an authorized reseller, has the proprietary rights to provide the required support for this software such as patch fixes and updates which are critical to the continued functionality of the software and in turn the task completion the software facilitates. Autodesk products allow VA staff facility engineers to manage land assets, physical assets, infrastructure, and facilities with greater efficiency from a single software platform. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in section 8 of this justification. This effort did not yield any additional software Government's requirements. Although the Government is limiting competition as a result of specifying Autodesk brand name software license renewals and maintenance, there are multiple resellers of Autodesk software on the NASA SEWP V GWAC. Additionally, this justification will be submitted to the NASA SEWP V GWAC website with the solicitation in accordance with FAR 16.505(a)(4)(iii)(A). Further, in accordance with FAR 5.301 and 16.505(b)(2)(ii)(D), this action will be synopsized and the justification will be made publicly available within 14 days of award on the Federal Business Opportunities webpage. 7. Actions to Increase Competition: Although the Government is limiting competition as a result of specifying brand name software, there are multiple authorized resellers of Autodesk brand name software licenses and maintenance on the NASA SEWP V GWAC. In order to remove or overcome barriers to completion in future acquisitions for this requirement, the Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be fully competed. 8. Market Research: In November 2015, market research was conducted by Region 3 technical representatives. This market research consisted of VA technical personnel reviewing products similar to the Autodesk brand name software and maintenance such as Software by FastCad, Microstation and Pro-E. The technical team found that Autodesk software continues to provide features within its AutoCAD suites that allow the user to open, edit, update and directly import existing engineering drawing files into AutoCAD. More importantly, it enables users to transfer current drawings back and forth into the AutoCAD DWG format, whereas no other product has the capability to meet this requirement. Software by FastCad, for example, could open and edit versions of AutoCAD drawings, but does not have the capability to convert drawings back and forth into the AutoCAD DWG format. Microstation and Pro-E are software products that were reviewed and found not to utilize the same platform as AutoCAD and therefore cannot edit or update Computer Aided Design (CAD) drawings as is, nor transfer files back and forth in the DWG format. Furthermore, the design files and similar historical engineering records that currently exist in VA databases are in AutoCAD DWG format and are easily viewed, annotated, updated and imported directly into the current workflow using Autodesk software. Accordingly, Region 3 technical representatives determined that Autodesk software is the only software that can fully transfer CAD information, without risk of file corruption, in the DWG format which is the principal means of communication between engineering and architectural professionals within and supporting VA. Moreover, no other software provider has the ability to provide the license renewal and maintenance support on the existing Autodesk software because Autodesk's source code is proprietary and can only be maintained by Autodesk or its authorized resellers. Additional market research was conducted in November 2015 utilizing the NASA SEWP V Provider Lookup tool, and it was determined that there are multiple resellers of Autodesk software. 9.
