BOX 41502 Nashville, Tennessee 37204-1502 NGTN-SMO-MM 1 February 2016 J&A #: MEMORANDUM FOR RECORD SUBJECT: Justification and Authority for Other than Full and Open Competition •1. The request for justification for other than full and open competition for a Manifold Valve for a 621B Scraper requested by Department of Logistics (DOL) for FMS # 11 of the Tennessee Army National Guard and purchased by the Contracting Division of the Tennessee Army National Guard United States Property and Fiscal Office (USPFO). This approval is for a new firm fixed priced contract using operational and maintenance funds. •2. This approval is for a new firm fixed priced contract using operational and maintenance funds. •3. Estimated Total Value: $13,824.37. Manifold Valve for a 621B Scraper. •4. Statutory Authority: the Federal Acquisition Regulation (FAR) 6.302-5, Full and Open Competition need not be provided for when (i)A statute expressly authorizes or requires that the acquisition be made through another agency or from a specified source, or (ii)The agency's need is for a brand name commercial item for authorized resale. 5. The Manifold Valve is unique in the fact that Caterpillar is the only company that manufactures this part that is on the 621B Scraper. This justification elaborates that the use of the Manifold Valve description in this acquisition is essential to the Government's requirements, thereby precluding consideration of a product manufactured by another company. The item can be purchased locally with no shipping charges. Thompson Machinery, a registered CAT dealer in Camden, TN has the part on hand and there will be no freight charges. 6. Efforts to identify other contractors were made by emailing CCR vendors found under the NAICS code 423490. A request for quote was sent out on January 15, 2016. One vendor responded to the RFQ that could provide the Manifold Valve for the 621B Scraper. 7. Continued efforts were made to identify other sources of competition by searching GSA Advantage and FEDBIZOPPS.GOV website for the related information. No information was found. 8. There are no other facts to support the use of other than full and open competition. 9. No other firms expressed an interest in this acquisition. 10. No further action to remove brand name will be taken, as Thompson Machinery in Camden, TN is the only known organization who can supply the Caterpillar parts. 11. The anticipated cost of this acquisition is determined fair and reasonable by comparison pricing of similar products. Quality of products was not used as a factor f for price reasonableness. 12. Notification complete of 1 February 2016. Purchase Order will be executed as of 2 February 2016.
