Description

On February 16, 2016, the Technology Acquisition Center awarded Delivery Order VA118-16-F-0873 under the terms and conditions of National Aeronautics and Space Administration (NASA) Solutions for Enterprise Wide Procurement (SEWP) V Government Wide Acquisition Contract (GWAC) NNG15SD38B with RedHawk IT Solutions, LLC (RedHawk), 2689 Maple Ridge Drive, Woodbridge, VA 22192-3826. RedHawk will be providing Tableau Server Software license maintenance and support. The period of performance shall be from March 1, 2016 through February 28, 2017. The total order value is $170,781.84. ? JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: This proposed action is for the award of a brand name firm-fixed-price Task Order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC). 3. Description of Supplies or Services: VA, Office of Information and Technology, Service Delivery and Engineering, Field Operations Region 5 has a requirement for the renewal of existing Tableau Server licenses, maintenance and technical support. The renewal of Tableau Server license and maintenance is in support of the Veteran Benefit Administration's (VBA) use of Tableau Professional Desktop that operates on existing Tableau Servers. The Tableau Server software licenses allow for VBA users to analyze, visualize, and share data related to Veteran claims to facilitate processing. The required technical support includes phone, email support, on-line, self-help, and maintenance to include software patches and updates. The technical support included with the software license and maintenance renewal is from 6AM to 6PM, Pacific Time, Monday through Friday. The period of performance shall be from March 1, 2016 through February 28, 2017. 4. Statutory Authority: The statutory authority permitting this exception to fair opportunity is 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited Above: Based on market research as described in paragraph eight of this document, it was determined that limited competition is available among authorized resellers of Tableau Server software license, maintenance, and support renewal. The proposed action is for the procurement of software maintenance and support renewal on existing Tableau Server Software licenses. No other brand software provider is capable of providing the required support and maintenance, as only Tableau possesses the proprietary data necessary to maintain the current software. No other vendor has the capability or data rights to provide the support required due to proprietary restrictions. Specifically, only Tableau has the rights and technical ability to produce necessary code patches and updates for the software. If the current Tableau software does not receive software patches and updates, software performance could degrade or fail, and security vulnerabilities may be exposed. Additionally, since the software is proprietary, no other company offers phone, email, or on-line support, in addition to self-help and maintenance. The impact of not purchasing continued Tableau Software maintenance could degrade the Government's ability to analyze, visualize, and share data supporting Veteran benefits claims and delay timely processing of claims to the detriment of Veterans. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in section eight of this justification. This effort did not yield any additional sources that can meet the Government's requirements. It was determined that limited competition is viable among authorized resellers for the required brand software license, maintenance and support renewal. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D), notice of award of this action will be synopsized and this justification will be made publicly available within 14 days of award on the Federal Business Opportunities Page. In accordance with FAR 16.505(a)(4)(iii)(A), this justification will be posted with the request for quotation on the NASA SEWP V GWAC website to notify all interested parties. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be competed. 8. Market Research: Market research was conducted by VA's technical experts in December 2015 and January 2016 by reviewing other server software products such as Pyramid, Prognoz, and Yellowfin. It was determined that none of these vendors can provide the necessary patches, updates, and support for VA's current Tableau software licenses. While these other brands provide similar maintenance support, all are brand specific to its own proprietary software and is not compatible with other brands. No other product is compatible with the existing Tableau Server licenses. Additional market research was conducted in January 2016 by utilizing the Provider Lookup tool to determine whether the brand name Tableau Server software maintenance is available from NASA SEWP V GWAC holders. It was determined that there are several resellers of the brand name Tableau Server software maintenance that hold current GWACs. 9. Other Facts: None.
