- Sole Source Justification - NCRO Lift Station Pump Replacement A sole source contract will be issued to American Electric Service Co. Inc. with a value of ________. (1) National Capital Region, National Park Service, Department of Interior. 1100 Ohio Drive SW, Washington, DC 20242. (2) Sewage Lift Pump Replacement - in accordance with Statement of Work, Davis Bacon WD, and clauses. (3) IAW FAR 36.204 the disclosure of magnitude is between $25,000.00 and $100,000.00. Estimated at __________ including removal of old pumps, installation of new pumps, and all associated labor and materials. (4) 41 U.S.C. 3304(a)(2) (5) The sewage East Potomac Park (EPP) lift station at National Park Service National Capital Region Office located at 1100 Ohio Dr SW, Washington, DC 20242 failed on the afternoon of 1/15/2016. The NCRO campus includes the National Mall Office, National Mall Maintenance Office, NCRO Headquarters Office, and the Park Police Headquarters Office. This sewage lift station is also part of a pressurized system that supports Park Police D-1 Sub-station, East Potomac Park Golf Course, and the Jefferson Memorial. The Park Police is a federal law enforcement agency and requires the ability to operate continuously seven days a week twenty four hours a day. The National Mall Maintenance Office maintains the ability for continuous operation. The failure necessitated immediate pumping to remove black water from the pump pit, and replacement of the pumps. (6) Multiple past and previous vendors were contacted to determine if competition would be possible in the short time before performance would be required. Despite this contact, only the contracted source was available to start and continue performance until complete on such short notice. (7) The anticipated cost to the government of the requirement was estimated at _______ including ________ for pumping to clear black water and sewage from the wet well and __________ for the pumps to be replaced. As comparison a previous requirement for the replacement of a 10hp lift station sewer pump at Turkey Run was completed for ___________ and did include pumping. This requirement includes the replacement of two 3hp pumps. (8) Market research was conducted both of the previous requirement for a lift station pump replacement and of other emergency service providers that could comply with the Davis Bacon wage requirements. Several vendors were suggested, but they were unable to perform. American Electric Services is a SB contractor that previously performed contract P15PX01803, responded, and is able to commence the work immediately and continue to completion over the weekend and outside of normal business hours. (9) Any other facts supporting the use of other than full and open competition, such as: (i) Technical data packages, specifications, and engineering descriptions were not available. The condition of the Lift Station at East Potomac Park differed significantly from lift stations previously repaired by this office. The EPP lift station had previously been repaired multiple times by in-house staff, but frequently not in accordance with standard practice; which required significant work and subsequent remedial measures to mitigate, and ensure safe performance in a confined space. (ii) When 6.302-1 is cited for follow-on acquisitions as described in 6.302-1(a)(2)(ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived. (iii) When 6.302-2 is cited, data, estimated cost, or other rationale as to the extent and nature of the harm to the Government. The immediate damage to the government is estimated as _______ per week for port o johns and _________ per week for pumping. However, if the pumping is not successful, it is possible that the sewage will back up into the various offices disrupting the ability of the offices to operate, causing significant damage, and increasing recovery and remediation costs. Other damages include the inability of the National Park Service National Capital Region Headquarters, Park Police Headquarters, Park Police D-1 Sub-station, Golf Course, and Jefferson Memorial to operate normally. (10) No sources expressed an interest in writing. (11) The agency will pursue developing a list of electrical, mechanical, and plumbing vendors that can provide emergency services in similar situations. The agency will also attempt to pursue the development of a list of other emergency vendors. An after action report will be completed to avoid these and similar issues in the future. (12) This justification is accurate and complete to the best of the contracting officer's knowledge and belief. //Signed Copy in File//
