Description
Justification for Other than Full and Open Competition U.S. Department of Energy Office of Headquarters Procurement Services Office of Legacy Management Rocky Mountain Health Plans 1. Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for Other than Full and Open Competition. The U.S. Department of Energy (DOE) hereby submits its justification for Other Than Full and Open Competition in accordance with 41 U.S.C. § 3304(a)(2) as implemented by Federal Acquisition Regulation (FAR) 6.302-2. DOE intends to non-competitively contract with Rocky Mountain Health Plans for medical insurance premium payments for retired employees of Rust GeoTech, a former M&O contractor supporting the former Grand Junction Field Office site. 2. Nature and/or Description of the Action Being Approved. DOE has a contract in place to transact the medical insurance premium payments as part of a tripartite agreement between DOE, the contractor, and the primary insurance company, Rocky Mountain Health Plans. That contract is DE-LM0000391.On February 4, 2016, the contractor performing this function notified DOE that it was unable to fulfill its contractual obligations and that the insurance premiums were past due for three months. The total amount of premiums due is approximately $290,000. 3. A description of the supplies or services required to meet the agency’s needs. This requirement is to ensure the retirees covered by Rocky Mountain Health Plans continue to receive benefits. There is a tripartite agreement between the Rocky Mountain Health Plans (RMHP), the contractor for DE-LM0000391 and DOE which makes DOE the responsible party for paying the premiums. 4. The statutory authority permitting Other Than Full and Open Competition. The applicable authority is 41 U.S.C. § 3304(a)(2) as implemented by FAR 6.302-2, “Unusual and Compelling Urgency”. 5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority. Failure to pay the past-due premiums would result in the retired workers losing their benefits. DOE has the responsibility to provide coverage for the retired workers based on the tripartite agreement. Due to the support contractor’s inability to make payments, DOE does not have the time to procure another contract competitively and must act now to pay the balance of $290,000 directly to the insurance provider. 6. A description of efforts to ensure that offers were solicited from as many potential sources as is practicable. Include whether or not a FedBizOpps announcement was made and what response, if any, was received, and include the exception under FAR 5.202 when not synopsizing. Describe whether any additional or similar requirements are anticipated in the future. Other sources were not considered due to the nature and timing of paying the premiums that were already past due when DOE was notified by the support contractor that it had defaulted on performing these payment services. DOE will post this justification to FedBizOpps after this non-competitive contract action has been executed, in accordance with FAR 5.202 due to the urgent and compelling nature of this action. 7. Cite the anticipated dollar value of the proposed acquisition including options if applicable and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. When exceptional circumstances exist that require the period of performance to exceed one year, the JOFOC shall state priced option period(s) will be included and that a determination and findings is being prepared for the Senior Procurement Executive’s approval. The anticipated value for the purchase is $290,000. The amount is based on the premiums due but not paid under contract DE-LM0000391. There are no options related to these orders. 8. A description of market research conducted and the results or a statement of the reason market research was not conducted. Market research was not conducted for this requirement because the cost are related to previously approved premium rates that were associated with contract DE-LM0000391 and incorporated into that contract in accordance with the aforementioned tripartite agreement. 9. Any other facts supporting the use of other than full and open competition, such as: No other facts supporting use of other than full and open competition have been identified beyond those found in this justification document. 10. A list of the sources, if any, that expressed a written interest in the acquisition.. The Government has not contacted any other sources as Rocky Mountain Health Plans is the single source providing medical insurance for the beneficiaries affected by the contractor’s failure to make the payments required under the terms of its contract. 11. A statement of actions, if any, the agency may take to remove or overcome any barriers before any subsequent acquisition for the supplies or services required. There will not be any barriers that will lead to restricted competition on future acquisitions for this requirement. The agency is pursuing an alternative procurement strategy to transition these insurance premium payment services from the defaulted contractor to another, responsible contractor. The circumstances resulting in the need for other than full and open competition for this contract are temporary and should not be a factor in future competitions.
