Description
National Cancer Institute (NCI), Center for Cancer Research (CCR), Experimental Transplantation and Immunology Branch (ETIB), plans to procure preventive and maintenance services for BD Biosciences Influx s/n X5000042, one (1) radius module and four (4) laser modules. This is a combined synopsis/solicitation for commercial items, prepared in accordance with format in FAR 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation and a separate written solicitation will not be issued. This solicitation: No. N02RC62518-61 includes all applicable provisions and clauses in effect through FAR FAC 2005-86 (Feb 2016) simplified procedures for commercial items. The North American Industry Classification System code is 811219 and the business size standard is $20.5 Million. Only one award will be made as a result of this solicitation. This will be awarded as a firm fixed price type contract. I. Description of Requirement The NCI Experimental Transplantation and Immunology Branch Flow Cytometry Core Facility provide flow and image cytometry services to investigators in multiple NCI Branches. The core is required to maintaining an up-to-date array of cell analysis and separation instrumentation for its investigators who are continuing to fulfill the mission on reducing the burden of cancer through exploration, discover and translation. Contractor Requirements are: 1. Contractor shall provide all labor, material and equipment to provide preventive maintenance for government-owned BD Biosciences Influx s/n X5000042 and the following laser modules: BD Biosciences INFLUX SAPPHIRE 488-200 LASER BD Biosciences INFLUX VIOLET 405-50 RADIUS BD Biosciences INFLUX RED 640-50 LASER BD Biosciences INFLUX 561-75 LT GREEN LSR BD Biosciences INFLUX XCYTE 100MW UV LASER All maintenance services shall be performed in accordance with the manufacturer's standard commercial maintenance practices. 2. PREVENTIVE MAINTENANCE Contractor shall perform two (2) preventive maintenance inspections as scheduled during the contract period if it is so required. Service shall be performed by technically qualified, factory-trained personnel. Service shall consist of a thorough cleaning, calibration, adjusting, inspection, lubrication and testing of all equipment in accordance with the manufacturer's latest established service procedures. All equipment shall be operationally tested through at least one (1) complete operating cycle at the end of the preventive maintenance inspection assure optimum and efficient performance. 3. EMERGENCY SERVICE Emergency repair services shall be provided on an unlimited basis during the term of this contract at no additional cost to the government. Emergency service shall be provided during normal working hours, Monday thru Friday excluding Federal Holidays. Upon receipt of notice that any part of the equipment is not functioning properly the Contractor shall within forty-eight (48) hours furnish a qualified factory-trained service representative to inspect the equipment and perform all repairs and adjustments necessary to restore the equipment to normal and efficient operating condition. All responses and repairs must be made within the forty-eight (48) hour period following the initial call for service. Emergency service calls shall not replace the necessity for scheduled PMIs. 4. REPLACEMENT PARTS The contractor shall furnish all required replacement OEM parts, with the exception of consumable parts to include batteries. Parts shall be new or remanufactured to original equipment specifications. This includes the laser modules, which must be true OEM replacement components and modified to function properly with the BD Influx unit. This also includes Influx firmware updates, which must be provided both as part of standard preventative maintenance, and as a repair item in response to bugs and patches. All replacement parts must be delivered by overnight shipment from in stock spare parts inventory unlimited OEM approved spare parts replacement to specifically include lasers. 5. SOFTWARE UPDATES/SERVICE The contractor shall provide Software Service in accordance with the manufacturer's latest established service procedures, to include telephone access to technical support for use of program software and trouble shooting of the operating systems, at no additional cost to the Government. The contractor shall receive advance approval for the installation of all software updates and revisions from the Government. Defective software shall be replaced at no additional cost to the government. Any software and firmware modification, changes and repairs must also be made within the true 48 hour service window mandated in item 3. 6. SERVICE EXCLUSIONS The contractor shall not be responsible for any repairs necessitated by abuse, neglect, vandalism, Acts of God, fire or water. These repairs shall be the subject of a separate purchase order and shall not be performed under this contract. 7. PERIOD OF PERFORMANCE April 1, 2016 - March 31, 2017 (Base Period) April 1, 2017 - March 31, 2018 (Option Period 1) April 1, 2018 - March 31, 2019 (Option Period 2) April 1, 2019 - March 31, 2020 (Option Period 3) April 1, 2020 - March 31, 2021 (Option Period 4) 8. PERSONNEL QUALIFICATIONS Personnel shall have a minimum of three (3) years factory training and experience in the servicing of BD Influx s/n X5000042 as covered by this contract. All primary service personnel shall have at least one backup support that will have at least the same level of expertise on the equipment covered by this contract. 9. PAYMENT Payment shall be made quarterly in arrears. Payment authorization requires submission and approval of invoice per the attached Invoice & Payment Provisions. 10. PLACE OF PERFORMANCE Service shall be performed at the following location: National Cancer Institute 9000 Rockville Pike Bethesda, MD 20892 11. PROVISIONS AND CLAUSES 11.1 FAR 52.252-2 CLAUSES INCORPORATED BY REFERENCE (FEB 1998) This contract incorporates one or more clauses by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. Also, the full text of a clause may be accessed electronically at this/these address(es): http://www.acquisition.gov/far/ 11.3 FAR 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years. 11.4 HHSAR 352.203-70 ANTI-LOBBYING (DEC 2015) Pursuant to the current HHS annual appropriations act, Public Law 112-74, except for normal and recognized executive-legislative relationships, the Contractor shall not use any HHS contract funds for: (a) Publicity or propaganda purposes; (b) The preparation, distribution, or use of any kit, pamphlet, booklet, publication, electronic communication, radio, television or video presentation designed to support or defeat the enactment of legislation before the Congress or any State or local legislature or legislative body, except in presentation to the Congress or any State or local legislature itself; or designed to support of defeat any proposed or pending regulation, administrative action, or order issued by the executive branch of any State or local government, except in presentation to the executive branch of any State or local government itself; or (c) Payment of salary or expenses of the Contractor, or any agent acting for the Contractor, related to any activity designed to influence the enactment of legislation, appropriations regulation, administrative action, or Executive order proposed or pending before the Congress or any State government, State legislature or local legislature or legislative body, other than for normal and recognized executive-legislative relationships or participation by an agency or officer of a State, local or tribal government is policymaking and administrative processes within the executive branch of that government. The prohibitions in subsections (a), (b), and (c) above shall include any activity to advocate or promote any proposed, pending, or future Federal, State or local tax increase, or any proposed, pending, or future requirement for, or restriction on, any legal consumer product, including its sale or marketing, including, but not limited to, the advocacy or promotion of gun control. 11.5 HHSAR 352.237-74 NON-DISCRIMINATION IN SERVICE DELIVERY (DEC 2015) It is the policy of the Department of Health and Human Services that no person otherwise eligible will be excluded from participation in, denied the benefits of, or subjected to discrimination in the administration of HHS programs and services based on non-merit factors such as race, color, national origin, religion, sex, gender identify, sexual orientation, or disability (physical or mental). By acceptance of this contract, the contractor agrees to comply with this policy in supporting the program and in performing the services called for under this contract. The contractor shall include this clause in all sub-contracts awarded under this contract for supporting or performing the specified program and services. Accordingly, the contractor shall ensure that each of its employees, and any sub-contractor staff, is made aware of, understands, and complies with this policy. GENERAL EVALUATION INSTRUCTIONS The Government does not anticipate requesting revisions to quotes, so Quoters should provide their best solution and price in its response to the RFQ. However, the Government reserves the right to request quote revisions that seek additional price discounts, provide revisions to the technical quote, or clarify aspects of the quote. In the event quote revisions are requested, the Government will not necessarily be seeking revisions from all Quoters. The Government may not be conducting "discussions" as defined in FAR Part 15. OFFERORS: Offers must be submitted on an SF-1449 with a completed 52.212-3 Offeror Representations and Certifications-Commercial Items-with DUNS Number Addendum, signed by an authorized representative of the offeror OR provide a copy of the valid certification registrations of the offeror's System for Award Management (SAM) through sam.gov. Quotations must be received in the NCI-OA contracting office by 11:00 AM EST on 3/10/16. Please refer to solicitation number N02RC62518-61 on all correspondence. No collect calls will be accepted. Electronic mail quotations will be accepted. All questions shall be in writing by March 8, 2016 and may be addressed to the aforementioned individual noted above. No collect calls will be accepted. In order to receive an award, contractors must be registered and have valid certification in the System for Award Management through sam.gov. 13. EVALUATION FACTORS FOR AWARD Quotes will be evaluated using a Lowest Price Technically Acceptable (LPTA) strategy. Offeror's quotes shall be evaluated against the following criteria: 1-The offeror shall deliver two (2) per year comprehensive, Original Equipment Manufacturer (OEM) approved, Preventive maintenance service visits performed by OEM factory-trained personnel. 2-The offeror shall deliver unlimited, OEM-approved emergency repair services for all equipment specified under SCOPE during the performance period of this maintenance services contract. All repairs, due to normal operating of the equipment, shall be completed to OEM standards at no additional cost to the government. 3-For BD Biosciences Influx s/n X5000042 and the following laser modules: BD Biosciences INFLUX SAPPHIRE 488-200 LASER BD Biosciences INFLUX VIOLET 405-50 RADIUS BD Biosciences INFLUX RED 640-50 LASER BD Biosciences INFLUX 561-75 LT GREEN LSR BD Biosciences INFLUX XCYTE 100MW UV LASER The offeror shall demonstrate a guarantee of 48 hour on-site response time for emergency repair services. 4-The offeror has the primary dispatch control of the field engineers who shall perform maintenance services under this contract, and dispatch of field engineers under this contract will be set to a higher priority than billable calls. 5-The offeror shall maintain, and deliver unlimited access to, a technical helpdesk providing telephone support for the purpose of trouble shooting technical problems and dispatching field engineers and/or parts as necessary. 6-The offeror maintains a comprehensive spare parts inventory of Original Equipment Manufacturer (OEM) approved new/refurbished parts for Influx equipment manufactured by Becton Dickinson Biosciences, including lasers. 7-When necessary for emergency repairs, the offeror shall deliver by overnight shipment from in stock spare parts inventory unlimited OEM approved spare parts replacement to specifically include lasers. 8-All spare parts installed, including lasers shall be OEM factory configured to be compatible with existing OEM software and with existing hardware. 9-Offeror shall perform timely installation of all OEM software revisions and OEM component revisions, as well as re-installation of existing software and operating systems as required to repair instrumentation according to OEM standards. 10-The offeror hires and deploys a technical workforce that includes field engineers based in the local Washington DC metropolitan area with a minimum of three (3) years factory training and experience in the servicing of: BD Biosciences Influx s/n X5000042 and the following laser modules: BD Biosciences INFLUX SAPPHIRE 488-200 LASER BD Biosciences INFLUX VIOLET 405-50 RADIUS BD Biosciences INFLUX RED 640-50 LASER BD Biosciences INFLUX 561-75 LT GREEN LSR BD Biosciences INFLUX XCYTE 100MW UV LASER 11-All primary service personnel shall have at least one backup support person with at least the same level of expertise on the equipment covered by this contract. FAR 52.217-5 Evaluation of Options (JULY 1990) Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).
