- NIHON KOHDEN NEUROFAX EEG-1200A ACQUISITION SYSTEM HHS-NIH-NIDA-SSSA-NOI-16-228 INTRODUCTION This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This acquisition is being conducted in accordance with the procedures of FAR Part 13--Simplified Acquisition Procedures and FAR Part 12--Acquisition of Commercial Items. The solicitation number is HHS-NIH-NIDA-SSSA-NOI-16-228 and the solicitation is issued as a PRE-SOLICITATION, NOTICE OF INTENT, to award a contract on a noncompetitive basis to Nihon Kohden America, Inc. located at 15353 Barranca Parkway, Irvine, CA 92618. REGULATORY & STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13--Simplified Acquisition Procedures, Subpart 13.106-1, only one responsible source and no other supplies or services will satisfy agency requirements, and FAR Part 12--Acquisition of Commercial Items and is NOT expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13--Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6--Competition Requirements. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-85-2, dated February 26, 2016. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The associated NAICS code for this requirement is 334516 with size standard of 500 Employees. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The non-competitive determination is based upon the market research conducted as prescribed in FAR Part 10--Market Research, specifically the results of market research concluded that Nihon Kohden is the original equipment manufacturer (OEM) of the NeuroWorkbench Data Management System and amplifier equipment JE-209A, JE-207A, JE-911A, and JE-921A used by the NINDS EEG/Sleep Section that now require additional equipment for additional capabilities. As such, only Nihon Kohden is capable of meeting the needs of this requirement as only this contractor is authorized and able to provide compatible equipment for this purpose. Use of any other contractor would place current equipment hardware and software integrity in jeopardy and also risk continuity of science; research data is based on the current software and equipment calibration so use of incompatible additional equipment would invalidate standardization of longitudinal research study data and loss of this data would be to the serious detriment of the NINDS mission. Accordingly, only Nihon Kohden is capable of providing the required additional/upgrade equipment. This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. DESCRIPTION OF REQUIREMENT Background The National Institute of Neurological Disorders and Stroke (NINDS) is a part of the National Institutes of Health (NIH), conducting research into the causes, treatment, and prevention of neurological disorders and stroke. The NINDS mission is to seek fundamental knowledge about the brain and nervous system and to use that knowledge to reduce the burden of neurological disease. In agreement with the NINDS mission, the EEG/Sleep Section contributes neurodiagnostic information and investigative research as it explores the physiologic, anatomic, behavioral, and therapeutic components of epilepsy and somnolence. Further, it provides diagnostic services for the Clinical Center to support and evaluate ongoing medical care and research activities. The NINDS EEG/Sleep Section currently uses the Nihon Kohden NeuroWorkbench Data Management System and Nihon Kohden amplifier equipment JE-209A, JE-207A, JE-911A, and JE-921A to perform research. Additional capabilities are now required and the associated upgrade equipment must be compatible with this existing equipment. Purpose and Objectives The purpose of this acquisition is to procure one (1) Nihon Kohden Neurogax EEG-1200 Long-Term Video EEG Monitoring System for the NINDS EEG/Sleep Section Intensive Care Unit (ICU). To ensure research data standardization, this is a sole source requirement. Project Description The contractor shall provide the NINDS EEG/Sleep Section with one (1) Neurofax EEG-1200 Acquisition System as follows: 1.One (1) Neurofax EEG 1200A Acquisition System [Part No. EEG-1200A-G] 2.One (1) JE-120A Series Amplifier, 64 channel [Part No. JE-120A-21] 3.One (1) QI-123A Base Unit [Part No. QI-123A] 4.One (1) Flat Pack Mini 64 Channel 1 - 64, Two Bipolar jacks. Includes 10 m cable for use with JE-120A amplifier only. [Part No. JE-125AK] 5.One (1) Pouch, holds 1 or 2 JE-125, 225, 226, 227 and/or 228AK [Part No. A/POUCHTRIFOLD] 6.One (1) 19" Flat screen TFT monitor [Part No. A/FLTSCREEN-19] 7.One (1) Sound bar for 19" to 20" monitor [Part No. A/AC511] 8.One (1) Mobile cart for EMU, EEG, MEB, PSG Systems [Part no. A/NIH8000] 9.One (1) Digital Video Software MPEG4, inclusive of USB Dongle [Part No. NK-MPEG4-SW] 10.One (1) SD Camera with PTZ, IP Streaming [Part No. NK-CAMERA-SD] 11.One (1) Internal NIC, Quad Ports (for use with SFF & Tower systems) [Part No. A/EXPI9404BLK] 12.One (1) Infrared Illuminator with 42 LEDs [Part No. A/EX12LED] 13.One (1) IP Camera mount [Part No. NK-251A] 14.One (1) Microphone system (ceiling or surface mount) [Part No. NK-MICROPHONE-3] 15.One (1) Hospital grade UPS (Uninterruptable Power Supply) 420VA [Part No. A/ABCE420-11IE] 16.One (1) Photic Cable Extension Kit and 14' Cat-5 Cable [Part No. A/QI200] 17.One (1) Expansion Kit (inclusive of mini DIN cable) for diagnostic monitoring system [Part No. A/QI400] 18.Remote monitoring software to access networked NKA systems remotely over LAN [Part No. #RMSW] 19.Persyst software, single license, that interfaces with Nihon Kohden Neuroworkbench on the acquisition and review work stations. [Part No. A/CPA-I] 20.Remote IT systems configuration, inclusive of software installation and configuration, and three days of training, inclusive of travel [Part Nos. #NK-ITCFG-REMOTE and #NK-EEG-TRAINING] 21.Installation and Termination per unit up to 20 units [Part No. #NK-Install] Additionally, the contractor shall provide a one (1) year warranty on parts and depot repair. All products shall be warranted to be free from material defects in workmanship or material under normal use and service for warranty period. Batteries, paper, power cables, electrodes, electronic media and other consumable items used by or with the products as well as products subject to unusual physical or electrical stress or improper maintenance may be excluded from warranty. Delivery/Period of Performance The required equipment shall be delivered to the NIH NINDS EEG/Sleep Section, 10 Center Drive, Building 10, Room 7 SW-3753, Bethesda, MD 20892 within sixty (60) days after contractor receipt of order. Inside delivery is mandatory. The contractor shall deliver and install the Neurofax EEG-1200 Acquisition System, as well as incorporate the machine into the current database and remote monitoring systems, at the same time. The equipment shall be installed during normal working hours (from 8:00 AM to 5:00 PM local prevailing time, Monday through Friday). The contractor shall provide an original equipment manufacturer certified service technician to perform setup installation, and training. Training must be provided within ten (10) days of delivery and installation. Place of Performance: The place of performance shall be the National Institutes of Health, NINDS EEG/Sleep Section, 10 Center Drive, Building 10, Room 7 SW-3753, Bethesda, MD 20892. Contract Type A firm fixed price purchase order within the Simplified Acquisition threshold is anticipated. Payment shall be remitted using Electronic Funds Transfer on a NET30 basis. RESPONSE INSTRUCTIONS Responses to this solicitation must include sufficient information to establish the interested parties' bona-fide capabilities of providing the product or service. The price quote shall include: unit price, list price, shipping and handling costs, delivery days after contract award, delivery terms, prompt payment discount terms, F.O.B. Point (Destination or Origin), product or catalog number(s); product description; and any other information or factors that may be considered in the award decision. Such factors may include: past performance; special features required for effective program performance; trade-in considerations; probable life of the item selected as compared with that of a comparable item; warranty considerations; and maintenance availability. PLEASE ENSURE THAT ALL EVALUATION CRITERIA ARE SPECIFICALLY ADDRESSED IN ANY RESPONSE(S) SUBMITTED. EVALUATION CRITERIA FAR clause 52.212-2, Evaluation - Commercial Items (October 2014) applies to this acquisition and the specific evaluation criteria to be included in paragraph (a) of that provision are as follows: The Government will award a purchase order resulting from this solicitation on the basis of best value in consideration of both technical factors and price. Technical factors are as follows, in order of importance: 1.Equipment Capability and Warranty: The contractor shall detail in a technical proposal how its proposed equipment meets each of the project requirements. This shall include detailed specifications of the offered equipment and its capabilities as well as warranty information. Technical approach shall be evaluated for the ways in which the proposed equipment meets or exceeds the equipment specification requirements. Exceeding requirements shall be considered favorably. 2.Delivery and Installation: The contractor shall detail in a technical proposal how it shall meet the delivery, and installation requirements. The Government shall evaluate for ability to meet or exceed the requirements detailed in this statement of need. Proposals must include a delivery lead-time and detailed explanation of who shall perform installation as well as the installation time frame. 3.Past Performance: The Contractor shall provide a list of two (2) contracts or purchase orders completed during the past five (5) years, similar in size and scope to the equipment provision, delivery, and installation requirements outlined in this Statement of Work. Experience shall include the following information for each contract or purchase order listed: a.Name of Contracting Organization b.Contract Number c.Contract Type d.Total Contract Value e.Description of Requirement and Specific Responsibilities of the Offeror as they relate to this SOW f.Contract Period of Performance Past Performance shall be evaluated for relevance to the current requirement. APPLICABLE TERMS AND CONDITIONS INCORPORATED BY REFERENCE The following FAR clauses and provisions shall apply to this solicitation: 1.All Offerors MUST be actively registered in the System for Award Management (SAM) www.sam.gov. 2.The provision at FAR clause 52.212-1, Instructions to Offerors - Commercial Items (April 2014), applies to this acquisition. 3.A completed copy of the provision at FAR clause 52.212-3, Offeror Representations and Certifications - Commercial Items (March 2015), is required with any offer submitted. This requirement may be met by completion of the provision in the System for Award Management. 4.FAR clauses 52.212-4, Contract Terms and Conditions - Commercial Items (May 2015) and 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (October 2015) apply to this acquisition. 5.The Defense Priorities and Allocations System (DPAS) are not applicable to this requirement. In addition, the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size must be included in the response.
