Description
GENERAL SERVICES ADMINISTRATION South Branch, Real Estate Acquisition Division Justification for Other than Full and Open Competition 5MD0312 <REDACTED> Columbia, Maryland 1. Nature and/or description of the action being approved. To exercise an unevaluated five-year renewal option, eighteen months of which is firm, for the <REDACTED> at <REDACTED> in Columbia, MD. This renewal option is intended to provide sufficient time to conduct a competitive procurement for a long term replacement lease. 2. Description of the supplies or services required to meet the agency's needs (including estimated value). <REDACTED> currently occupies 11,009 ANSI/BOMA Office Area square feet (ABOASF) or 12,330 Rentable Square Feet (RSF) of office space. The current lease expires April 19, 2016. The current annual rent is <REDACTED>. This is a fully serviced lease. The lease may be terminated, in whole or in part, after eighteen months of the renewal term by giving at least 90 days written notice to the Lessor. The rates for the option term are as follows: Rent: <REDACTED> The aggregate value of this five year renewal is <REDACTED> 3. Identification of the statutory authority 41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. 4. Demonstration that the proposed contractor's unique qualifications or nature of the acquisition requires use of the authority cited. In accordance with 41 U.S.C. 3304(a)(1), the agency's minimum needs can only be satisfied by unique supplies or services available from only one responsible source and no other type of property or services will satisfy the needs of the agency. Staying at the current location while the agency's new space is competitively procured will allow <REDACTED> to fulfill their mission and keep continuity of operations. It would be economically infeasible to relocate for a short time frame. 5. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. An advertisement was posted on November 24, 2015 with a response date of December 8, 2015. <REDACTED> expressions of interest were received in response to this advertisement. Market research of available properties within the delineated area able to accommodate the requirement was conducted through CoStar on October 2, 2015. <REDACTED> was identified that had adequate square footage within the delineated area to meet the agency's needs; however, <REDACTED> is the only location capable of meeting the timeline and the short term space need. 6. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. REIS, Costar, and CBRE market report indicates the rental rate range for class A space in the Columbia, MD market to be $25.34/RSF to $29.50/RSF. These rental rates are first year rates, typically subject to an annual escalation, included tenant improvements, and generally require a longer firm term. There are no annual escalations within the existing renewal option. Due to the short firm term the tenant improvements would be amortized over a much shorter duration than the market typically seeks and is not a requirement for this action. The renewal rental rate is within and on the low end of the market rental rate range and is therefore fair and reasonable to the Government. 7. Description of the market research conducted See attached market research report. 8. Other facts supporting the use of other than full and open competition The agency has a continuing need for space however; they have not been able to finalize their space requirements due to budgetary constraints and on-going changes within the agency. The agency anticipates requiring the existing space for at least an additional 2 years while their staffing levels and space requirements stabilize. This will provide adequate time to evaluate their space needs and develop a thorough program of requirements. It is not feasible to relocate the agency prior to the expiration date because such a move would be cost prohibitive, premature, and disruptive to their operation. Therefore, it is recommended that GSA exercise this renewal option to protect our lease interest and prevent holdover. Furthermore, the Lessor had great past performance and the agency is confident that this space will continue to meet their needs for the duration of the renewal firm term. 9. List of any sources that expressed in writing an interest in the acquisition There have been no written expressions of interest for this acquisition. 10. Statement of actions the agency may take to remove or overcome any barriers to competition The intention for exercising this renewal option is to allow enough time for the Government to develop their program of requirements for a long term replacement lease. If the new location is completed prior to the expiration of this renewal option, then the lease will be terminated and the new lease will become effective.
