- U.S. General Services Administration GSA Region 4 Leasing Division - Branch B JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION LEASE NUMBER: GS-04B-LFL61852 LOCATION: Gainesville Regional Airport, 3880 NE 39 th Ave., Gainesville, FL 32609-5626 GSA BUILDING NO.: FL3046zz PROJECT NUMBER: 4FL0322 AGENCY: Transportation Security Administration (TSA) - (A/B Code 7054) 1. IDENTIFICATION AND DESCRIPTION OF ACTION BEING APPROVED. The General Services Administration currently leases 1,536 Rentable Square Feet (RSF with a Common Area Factor (CAF) of 1.00, yielding 1,536 ANSI BOMA Office and related square feet at Gainesville Regional Airport, 3880 NE 39 th Avenue, Gainesville, FL 32509-5626, under lease GS-04B-LFL61852 for the Transportation Security Administration (A/B Code 7054). The current lease expires 03/31/2016. Branch A transitioned this project to Branch B in July 2015 with only 8 months remaining of the current lease term which expires 03/31/2016. TSA delayed providing GSA requirements until 8/21/2015. Further, TSA is requesting to downsize the space by 336 RSF. The Gainesville Airport Management on November 2, 2015 indicated to the LCO time is not of essence from their perspective and will likely not comply in an expeditious manner with the government's leasing process prior to lease expiration. Therefore, to avert a holdover lease, approval is requested to extend the lease with the incumbent Lessor without full and open competition for continued occupancy at this leased location for not to exceed twenty-four (24) months, twelve (12) months firm term. This will enable GSA to conduct the long-term requirement. The long-term action is for a 10 year; 3 year firm term On-Airport Lease (*succeeding). There is no requirement to conduct a full and open competition for On-Airport Leases. 2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED. SHORT TERM: The short-term requirement is for 1,536 RSF of space with a Common Area Factor (CAF) of 1.0 yielding 1,200 ANSI BOMA Office Area square feet (ABOA) for twenty-four (24) months; twelve months (12) firm term, commencing April 1, 2016 through March 31, 2018. Extension to have early termination rights (supersede) upon completion of long-term on-airport lease action if procurement is completed prior to the extension expiration date. The estimated annual cost of this full service lease is $51,385.00. The rental rate of $33.43 PRSF is inclusive of Operating Cost. There are no tenant improvements for the extension period. LONG TERM: TSA submitted long-term requirements on 8/21/2015 for a succeeding on-airport lease. The long-term requirement is for 1,200 RSF of space with a Common Area Factor (CAF) of 1.0 yielding 1,200 ANSI BOMA Office Area square feet (ABOA) for ten years; 3 years firm term, commencing April 1, 2016 through March 31, 2026. The agency is requesting downsizing of the space from 1,536 RSF to 1,200 RSF for a reduction of 336 RSF. Additionally, a paint refresh and new carpet are requirements for the long-term procurement. The estimated annual cost of this full service lease is $51,385.00. The rental rate of $33.43 PRSF is inclusive of Operating Cost. 3. IDENTIFICATION OF STATUTORY AUTHORITY. 41 U.S.C. 253(c) (1): Only one responsible source and no other supplies or services will satisfy agency requirements. a. An agency may use procedures other than competitive procedures when the property or services needed are available from only one responsible source and no other type of property or service will satisfy the needs of the agency, 41 U.S.C. 253 (e)(l). b. Demonstration that the acquisition requires use of the authority cited: FAR 6.302·1, which implements the referenced statutory authority, authorizes limited competition when the property or services needed are available from only one responsible source and no other type of properly or service will satisfy the needs of the agency. 4. DEMONSTRATION THAT THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED. FAR 6.302·1, which implements the referenced statutory authority, authorizes limited competition when the property or services needed are available from only one responsible source and no other type of properly or service will satisfy the needs of the agency. The Aviation and Transportation Secl1l'ity Act (ATSA) was signed into law on November 19, 2001. TSA employs more than 45,000 security screeners and provides guidance and training to flight crews for dealing with threats on board aircraft. Since February 17, 2002, TSA has been responsible for all civil aviation security functions. Because these tasks are directly related to the security of the national air transportation system, TSA has a critical need to be located on airport properly 5. DESCRIPTION OF EFFORTS TO SOLICIT AS MANY OFFERS AS PRACTICABLE. Market Surveys will be conducted as the need for space arises and the notices required by FAR 5.201 and GSAM 505.202 will be published and any proposals received will be considered. The cost quoted to the Government by the current Lessor, at the existing location for this extension, will remain at the current rental rates under the lease which includes annual rent adjustments. 6. DETERMINATION THAT THE ANTICIPATED COSTS WILL BE FAIR ANS REASONABLE: The cost for the space and any specific improvements shall be deemed to be fair and reasonable by each contracting officer by utilizing any market information available. Each contracting officer must specifically determine in writing that the contract price for each lease acquired pursuant to this justification is fair and reasonable. 7. DESCRIPTION OF THE MARKET SURVEY CONDUCTED: As the need arises, a market survey will be conducted to determine if space is available that meets the requirements of TSA off of airport property and all sources that can deliver the needed space, meeting the requirements of the agency within the timeframe specified, will be solicited. At this time, the TSA specific mission requirement to be located at the airport precludes a market survey. 8. OTHER FACTS SUPPORT THE USE OF OTHER THAN FULL AND OPEN COMPETITION: None 9. LIST OF SOURCES WHO EXPRESSED INTEREST IN THE ACQUISITION: None 10. STATEMENT OF ACTIONS TO OVERCOME BARRIERS TO COMPETITION: None 11. CONTRACTING OFFICER CERTIFICATION: This class justification may be used by GSA contracting activities only with respect to the proposed lease contract, the contracting officer certifies as follows: "I certify that this lease contract is within the scope of the class justification for other than full find open competition for the acquisition of administrative and support work space for the Transportation Security Administration (TSA) in response to Public Law 107-71, and that the justification is accurate and complete to the best of my knowledge and belief." This class justification for other than full and open competition is hereby made and approved in accordance with Section 303 (f) of the Federal Real Property and Administration Services Act of 1949, as amended (41 U.S.C. 253 (f) and FAR Subpart 6.3.
