Solicitation Number:Notice Type: DE-SOL-0009590Combined Synopsis/Solicitation Synopsis: This is a combined synopsis/solicitation for brand-name commercial items prepared in accordance with FAR Parts 12 and 13 as supplemented with additional information included in this notice and under the authority implemented by FAR 13.106-1(b). Quotations are being requested. This is a Request for Quotation (RFQ) and the solicitation document and incorporated provisions and clauses are those in effect in FAR Part 52.212-4, Contract Terms and Conditions - Commercial Items. The solicitation number associated with this combined synopsis/solicitation is DE-SOL-0009590 and is issued as full and open market. A firm-fixed price brand-name contract will be awarded on an all-or-none basis to the firm that presents the ?best value? to the Department using the lowest price technically acceptable process. Delivery will be 120 days ARO. Description of the supplies required to meet the agency?s need: QuantityPart Number Description 31 each Sig Sauer MCX SBR PN# WRMCX-11B-TFSAL-SBR 11.5? BBL, FDE, 5.56 mm, Coyote Sig Sauer compact configured battle rifle 30 each Sig Sauer P320, PN# W320CA-9-BSS, FDE, 9 mm Carry, Coyote, Night Sights and 3 Magazines Sig Sauer configured defensive pistol package The Federal Supply Code is 1095, Miscellaneous Weapons. The NAICS Code for this procurement is 453998, All Other Miscellaneous Store Retailers (Except Tobacco Stores), with an associated size standard of $7.5. Additionally, all Suppliers must be registered and current in the Government System for Award Management (SAM) database. A Dun and Bradstreet (DUNS) number is required for SAM registration. This combined synopsis/solicitation is issued as a Request for Quotation (RFQ). A quotation is not an offer and cannot be accepted by the Government to form a binding contract. The order is an offer by the Government to the supplier to buy supplies or services upon specified terms and conditions. A contract is established when the supplier accepts and signs the offer. Responses to this solicitation are due by 5 p.m. MST, Monday, March 21, 2016, and may be submitted via email to Kristi Squires, Contracting Officer, at Kristi.Squires@cbfo.doe.gov. The anticipated award date for this requirement is expected on or before March 25, 2016. Only brand-name quotations will be considered. Quotations received after the stated time will not be accepted/considered. All questions relating to this RFQ must be submitted via email by Close of Business, March 16, 2016, to Kristi Squires, Contracting Officer, at Kristi.Squires@cbfo.doe.gov. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION WHEN PURCHASING A BRAND NAME ITEM (1) Identification of the agency and the contracting activity and (2) Nature of the action being approved. The Department of Energy (DOE) Carlsbad Field Office (CBFO) has a requirement for brand-name small firearms for the Waste Isolation Pilot Plant (WIPP) Security Program Compliance. The brand-name for these firearms is Sig Sauer. (3) A description of the supplies required to meet the agency?s needs and estimated value: QuantityPart NumberDescription 31Sig Sauer MCX SBR PN# WRMCX-11B-TFSAL-SBR 11.5? BBL, FDE, 5.56 mm, CoyoteSig Sauer compact configured battle rifle 30Sig Sauer P320, PN# W320CA-9-BSS, FDE, 9 mm Carry, Coyote, Night Sights and 3 MagazinesSig Sauer configured defensive pistol package (4) Statutory authority permitting other than full and open competition: The authority for this purchase is FAR 13.106-1(b)(ii), Solicitation from a single source. Justification is required when requesting brand name products as the government?s requirement, since products peculiar to one manufacturer do not provide for full and open competition. This justification only covers that portion of the purchase that is brand-name. (5) Demonstration that the acquisition requires use of the authority cited. The current arsenal of weapons in use by the security program has exceeded the recommended life cycle of usage and requires replacement. The CBFO has invested a significant amount of time and resources into the selection of specific weapons makes and models of the arsenal including specialty tools, parts, accessories, and specialty training. Specifically, the Sig Sauer MCX 5.56 mm and Sig Sauer P320 9 mm carry models were selected after considerable research for equipment that meets the security mission and configuration of WIPP security operations. CBFO is required by 10 CFR 1046, Physical Protection of Security Interests; 10 CFR 1047.7, Use of Deadly Force; and DOE Order 473.2, Protective Force Programs, to maintain an armed force capable of responding to specific types of threats analyzed by risk assessment. DOE Security Technical Standards requires firearms inventories be maintained in a safe and secure manner, and recommends the application of manufacturer?s maintenance schedules, if recommended usage and care under a qualified armorer is sustained. By procuring these specific makes and models of firearms, the current arsenal system is able to continue operations without transition, retooling or retraining to new configurations. (6) Description of efforts to ensure offers are solicited and whether a notice will be publicized. Per FAR 5.201(b)(1), Solicitation DE-SOL-0009590 will be transmitted through the GPE. (7) Determination that the anticipated cost to the Government will be fair and reasonable. This requirement will be competed through FedBizOps. Competition provides more competitive pricing, because the vendors are competing against each other to provide the best value. (8) Description of market research conducted. Market research was conducted utilizing the open market and from known distributors. (9) Approval of justification The justification must be approved in accordance with FAR Part 6.304 Approval of the justification. Per FAR 6.304 (a) (a1) for a proposed contract not exceeding $550,000, the contracting officer?s certification will serve as approval unless a higher approval level is established in agency procedures.
