JUSTIFICATION FOR SINGLE SOURCE AWARDS (SSJ) IAW FAR 13.106-1 (OVER MICRO-PURCHASE THRESHOLD($3K) BUT NOT EXCEEDING THE SAT ($150K)) When competition is not practicable, IAW FAR13.106-1(b), COs solicit from a single source for purchases not exceeding the simplified acquisition threshold. COs may solicit from one source if the CO determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). Note: Statements such as "only known source" or "only source which can meet the required delivery date" are inadequate to support a sole source purchase. 1. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE: The Fort Harrison Veterans Affairs Medical Center (FTHVAMC), and Eastern Colorado Health Care System Denver VAMC (ECHCS) are seeking to enter into firm fixed price contract with Richard-Allan Scientific Company to provide 12 months (Base year plus two option years) of preventive maintenance (Sole Proprietary Rights) on Thermo-Fisher Tissue Processors and Cryostats. UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED: The components and replacement parts of the Thermo Fisher Tissue Processor equipment are proprietary to Thermo-Fisher. The use of parts not validated by Thermo-Fisher will jeopardize the integrity of the equipment and VA's capacity to provide reliable patient care. The following is what this contractor provides: Thermo-Fisher has the ability to perform a certified preventive maintenance visit to validate the performance of the equipment in accordance with Thermo-Fisher specifications. Thermo-Fisher provides a loaner option for the slide-mate sub-component of the Tissue Processor. Thermo-Fisher service engineers have access to proprietary advanced service materials. Other companies are not licensed by Thermo-Fisher for this and are unable to access advanced levels of service materials. Thermo-Fisher only offers preventive maintenance through their subsidiary company, Richard-Allan Scientific, Inc., which is large business. It was determined that no small businesses are available for this requirement through market research through the NCO 19 Small Business Specialist's Fed Mine search; Contractdirectory.gov; FPDS EZ search; VETBIZ; GSA eLibrary; SBA dynamic search; SAM; public Internet search engine, and Thermo Fisher Scientific official website. 4. SUGGESTED SOURCE INFORMATION (Contractor Name, Address, City, State, Zip, and Telephone Number) Richard-Allan Scientific, Inc. REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE, WHICH CAN PROVIDE THE SUPPLIES OR SERVICES: The Richard-Allan Scientific Inc. has sole proprietary rights and manufactures the Thermo Fisher Tissue Processor. Preventive maintenance, repair and maintenance on the Thermo Fisher are proprietary and require new, OEM, proprietary parts and processes available only from Richard-Allan Scientific Inc. Market research conducted revealed only one source available (see section 8 below for further details). 6. DESCRIPTION OF MARKET RESEARCH (MR) CONDUCTED AND RESULTS OR STATEMENT WHY IT WAS NOT CONDUCTED: In accordance with the MR conducted, all companies belong to Thermo Fisher Scientific to include the regional geographical territories pending supply and service product lines fall under the affiliation of Thermo-Fisher vendor, Thermo Fisher Healthcare. The GSA schedule has Thermo-Fisher equipment and/or supplies; however, GSA schedule does not provide preventive maintenance services. There it has been determined by the CO there is only one source that can provide preventive maintenance services on Thermo Fisher equipment. [END OF SINGLE SOURCE JUSTIFICATION]
