Description

1.Contracting Activity: Department of Veterans Affairs, VISN 10W, Ann Arbor VA Healthcare System, transaction 506-16-2-1527-0048. 2. Nature and/or Description of the Action Being Processed: This procurement is for a new firm fixed price contract. In accordance with FAR 13.5 Test Program for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. The Contractor information is as follows: Manufacturer/Contractor: Sorin Group Manufacturer/Contractor POC & Phone Number: Mike Armbrister; (303) 467-6221 MFG/Contractor Address: 14401 W. 65th Way Arvada, CO 80004-3599 3.Description of Supplies/Services Required to Meet the Agency's Needs: This requirement is for full service coverage on the Sorin S5 Heart-Lung and Heater-Chiller at the VA Ann Arbor Healthcare System. The expected period of performance for this contract will be from the date of contract award for a one year period with four (4) one (1) year options. 4.Statutory Authority Permitting Other than Full and Open Competition: (x ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Biomedical Engineering Department is requesting labor, material, and equipment to provide service, full service coverage on the Sorin S5 Heart-Lung and Heater-Chiller including planned maintenance, priority response for service, and other services described in the manufacture maintenance specification. Only the original manufacturer is able to maintain this complex and delicate equipment that is an integral part of the facility. All the above listed equipment is proprietary. Sorin is the only authorized vendor who can obtain Original Equipment Manufacturer (OEM) parts for replacement. I have contacted Sorin and they have confirmed they do not train or certify third party vendors to do the repair of the equipment. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: This contract is for the support of Sorin OEM equipment, where OEM parts are only manufactured by Sorin. Sorin, as the OEM is the only source for this proprietary equipment, no other source has the knowledge or equipment necessary to service these items. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The Contracting officer will utilize the procedure in FAR 13.106-3(a)(2)(ii) to determine price fair and reasonableness. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A Sorin representative has confirmed the only training that is provided is to internal hospital staff. They do not certify any third parties. However, the hospital has chosen to use the OEM for full service to ensure the performance of the heart-lung machine is working as it should and so that biomedical engineering technicians can view OEM standard care in person. Currently there is no other certified third party, which leaves the OEM as the only option. The Government will continue to conduct market research and reevaluate training opportunities in the future to open up other options for meeting this requirement. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: Sorin is the manufacturer of the aforementioned equipment that requires a full service agreement and is the only provider that is capable of providing the range of services specified by the manufacturer. The range of service that only Sorin can provide will prove beneficial in the overall cost effectiveness in maintaining and operating the Sorin equipment. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: No other sources expressed interest, as Sorin is the only source capable of supporting the equipment. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Should a requisition of this nature occur again we will perform a new market survey to locate possible new vendors. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
