- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Activity: Department of Veterans Affairs, VISN 22, Network Contracting Office (NCO 22), 4811 Airport Plaza Dr. Suite 600, Long Beach, California, 90815 2. Nature and/or Description of the Action Being Processed: NCO22, on behalf of the VA Greater Los Angeles Healthcare System (VAGLAHS), Healthcare for Homeless Veterans (HCHV) program office, shall enter into an Indefinite Delivery, Indefinite Quantity (IDIQ), fixed price contract with San Fernando Valley Community Mental Health (SFVCMH) for housing placement and case management services through other than full and open competition procedures. The anticipated award date is March 15, 2016 with a period of performance of April 1, 2016 - September 30, 2016. 3. Description of Supplies/Services Required to Meet the Agency's Needs: The Contractor shall provide housing placement and case management services through the Housing and Urban Development VA Supportive Housing (HUD-VASH) program. The purpose of this program is to place and maintain chronically homeless Veterans into permanent, community based housing using HUD Section 8 Housing Choice Vouchers. Contractor shall assist Veterans with obtaining housing in any area served by the VAGLAHS, based on Veteran preference and housing availability. Contractor shall also provide case management services that will engage the Veteran in the HUD-VASH process, utilizing counseling strategies to include crisis intervention, and case management including both long and short-term services working toward long range HUD-VASH Program discharge goals. 4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(2), as implemented by FAR 6.302-2. Authorized or required by Statue full and open competition need not be provided for. ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (X) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): At this time the VAGLAHS does not have adequate staffing or community care resources to provide these services to the entire Veteran population that currently require such services. While current contract services are in place recent procedural changes from the HCHV have resulted in the necessity to establish new contracts requiring the contractor to follow new guidelines. Failure to establish this short term contract under these new guidelines would result in the discharge of 90 Veterans from current housing placements, making them homeless and without critical case management services. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Pricing has been solicited from the above listed Contractor. This Contractor is currently working with Veterans and has been providing services under the HUD-VASH program since 2013. They are familiar with VA procedures under this program and have established processes. Given the nature of the services being provided, any lapse in services would negatively impact the Veterans themselves, the VAGLAHS, HCHV program, and the Community Care and Social Work departments. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated total dollar amount for the subsequent contract listed above is considered to be fair and reasonable to the Government based upon comparing identical services and pricing from the contract holder's FY13 Option Year two pricing. The average cost for services is $910.81 per Veteran per month at the high intensity level of care, $543.68 per Veteran per month at the standard intensity level of care, and $260.00 per Veteran per month at the low intensity level of care 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market Research was conducted on a limited basis to determine if the required services are available in the commercial marketplace. However, after consultation with the ordering service, it was determined that given the nature of services that are required combined with staffing and time constraints; it was determined that the most suitable method of acquiring these services would be a sole source acquisition under FAR Part 6.302-2. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None. 10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: San Fernando Valley Community Mental Health 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: It is anticipated that any subsequent requirement will be competed IAW FAR Part 6.101 12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
