- (1) PORE MABO, Pacific West Region, National Park Service, Department of Interior - Justification for Other than Full and Open Competition (2) Sole source justification for Emergency Repairs to JD 644 Loader (3) Crater Lake National Park (CRLA) has a requirement to repair a 2001 John Deere 644 H wheel loader. The equipment had a total transmission pump failure which requires immediate attention. The requirement includes a rebuilt transmission and in order for the repairs to happen, the cab needs to be removed and the transmission pulled out from the frame, and filled with the appropriate lubricant and the cab installed so the loader to be placed back into service. The estimated value is $33,000.00 (4) FAR 13.106(b) (i) (5) There is only one responsible source in the local area that is able to complete the repairs in an immediate time frame. The immediacy is due to March and April being large snow months in the Cascade Mountains and scheduled spring opening. Spring opening is currently one week behind and starts in March and runs through July, with planned Rim Opening happening by July 4 weekend. The one responsible source is Pape Machinery, the closest qualified facility with 2 locations in Medford & Klamath Falls. They have qualified technicians standing by and the remanufactured transmission in stock. We did contact a local business John Deere technician, and they indicated that their shop was unable to remove the cab and replace the transmission. CRLA has had a record breaking 422 inches of snow since December 1, with a current snow depth of 132 inches. April is the park's peak month for snowfall. For the safety of the visitors and park employees, the main park road going up to the rim has been closed for over a week because the snowplows can only push snow to the side of the road. The snow banks on the sides of the road are currently 12 to 15 feet high. When the snowplows push snow to the side of the road, it has nowhere to go because the snow banks are at the fog line. This makes the road currently only 1.5 vehicle widths wide. With the next snowstorm, this width will reduce. This has prevented the visiting public from being able to see and enjoy the lake and concession employees. Spring opening operations have begun and are behind schedule. This includes removal of snow to the lodge, dorm, restaurant and campground. After snow removal at the lower elevations the road crew moves to the Rim Roads of Crater Lake. Snow removal around the rim requires all three rotary snow blowers, snowplows and dump trucks which can take up to three months. Only one of the park's three snow blowers is operational but this is a truck mount blower with a low, non-extendable, blower mount which can't push the snow far enough over the bank to clear the snow. If the park receives another heavy snowfall of five feet in three days then this blower will not be able to handle keeping the roads safe. Without the rotary snow blowers, the park will be forced to close the roads, and evacuate visitors, employees and residents. This is an extremely urgent health and life safety matter for park staff, residents, Xanterra and the visiting public. This repair will require the knowledge and skills that only a John Deere technician can provide. There will be Deere specific tooling required for this repair. Only genuine Deere parts will be accepted for the replacement. (6) Multiple past and previous vendors were contacted to determine if competition would be possible in the short time before performance would be required. Despite this contact, only the contracted source had parts in stock and technicians available to start and continue performance until complete on such short notice. (7) The anticipated cost to the government of the requirement was determined to be fair and reasonable when compared to published price lists and recent acquisitions. (8) Market research was performed in an effort to locate qualified firms able to respond quickly to perform this work in the field. (9) Other facts supporting the use of other than full and open competition: The wheeled loader is used to with a 600 HP rotary snow blower. When this loader failed, all three of CRLA's rotary snow blowers were down for repairs. The snowfall in March was average; 80 inches. Without the rotary snow blowers, any significant storms would have forced the closure of the park and evacuation of the residents and staff. (10) No sources expressed an interest in writing. (11) The agency will pursue developing a list of construction equipment repair vendors that can provide emergency services in similar situations. The agency will also attempt to pursue the development of a list of other emergency vendors. (12) This justification is accurate and complete to the best of the contracting officer's knowledge and belief. //Signed Copy in File//
