- Clauses SOW Solicitation THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN FAR SUBPART 12.6-STREAMLINED PROCEDURES FOR EVALUATION AND SOLICITATION FOR COMMERCIAL ITEMS-AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTATIONS ARE BEING REQUESTED, AND A SEPARATE WRITTEN SOLICITATION DOCUMENT WILL NOT BE ISSUED. THE SOLICITATION IS BEING ISSUED USING SIMPLIFIED ACQUISITION PROCEDURES. This solicitation is a Request for Quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-87. The Infrastructure Services Division (ISD) of the Office of Information Systems Management (OISM) at the National Institute of Standards and Technology (NIST) currently uses IBM Tivoli Storage Manager (TSM) software to backup user data. To eliminate NIST's dependency on tape, improve NIST's disaster recovery readiness and reduce NIST's backup cost, ISD has determined that the on-premise DataDirect Networks (DDN) disk arrays are required. In addition, an annual support contract is required with DDN for its hardware and software maintenance. The purpose and objective of this procurement is to acquire the DataDirect Networks (DDN) hardware and software support and maintenance services for NIST existing DataDirect Networks (DDN) disk arrays.' Use of the statutory authority 41 USC 3304(a)(5) requires that the supplies or services required by the agency must be of a particular brand name. The DDN disk storage arrays were purchased as a bundled system from DDN which comprises custom configured hardware and proprietary software. The proprietary software was developed and copyrighted by and are marketed and maintained solely by DDN. Only the software developer has the technical expertise and access to proprietary source code to provide the level of support required and to develop and make available temporary patches to fix errors. Equivalent support is not available from any source other than DDN or its authorized resellers. Only qualified support personnel from DDN can service the system. The associated North American Industrial Classification System (NAICS) code for this procurement is 541519 Information Technology Value Added Resellers. The small business size standard is 150 employees. This acquisition is 100% set aside for small businesses under the applicable small business size standard. NIST anticipates the award of a single, firm-fixed price purchase order. All offerors shall provide a firm-fixed price quotation in accordance with the Instructions to Offerors for the line items detailed in the attachment titled "Required CLIN Structure."
