- This is a Notice of Intent to award a sole source procurement under the Simplified Acquisition Procedures and Other Than Full and Open Competition in accordance with FAR 6.302-1. A solicitation will not be issued. The associated NAICS Code for this acquisition is 512230, size standard in number of employees is 750. The Regional Contracting Office - National Capital Region intends to award a Firm Fix Price sole source contract to James Stephenson, located at 3040 Cornwallis Road, Research Triangle Park, NC 27709 in support of United States Marine Band, Marine Barracks Washington, located at 8th & I Streets South East, Washington, District of Columbia 20390-5000. The required delivery date is 30 Sep 2016. The Marine Band is one of the foremost professional musical ensembles in the world and the organization has established a long standing initiative to commission new original works from the most accomplished and established composers who have significant professional experience writing for large musical ensembles. The Director of the Marine Band is a subject matter expert in the field of classical music and has determined that James Stephenson is uniquely qualified to write a specific original work for the Marine Band. This initiative directly supports the Director's primary responsibility to determine what music is performed by the marine Band in direct support of the Commandant of the Marine Corps and the President of the United States. The Marine Band presents a series of free public concerts in the Washington metropolitan area during fiscal year 2016 as a public relations tool and training aid. Additional, the Band is tasked to perform at the internationally recognized Midwest Band and orchestra Clinic in Chicago, IL. The Marine Band will be the featured ensemble during this convention which focuses on the creation of new music by significant composers. A requirement of the 2016 concert series as well as the special performance at the Midwest Clinic coincides with the Director of the Marine Band's responsibility as the leader of the world's foremost concert band to commission, perform, and record new music for the wind band medium. The act of commissioning an original work for wind band ensures the Marine Band fulfills its obligation to the CMC and the American public to providing the highest quality new music to be performed not only during this fiscal year, but also for years to come. As well, commissioning an original work ensures the Marine Band has unlimited performance rights, and reduced copyright, mechanical license and recording limitations associated with the music. These factors combine to make commissioning a cost-effective expenditure of government funds. This original work will be performed at the Midwest Clinic in December 2016, recorded for the Marine Band's annual educational compact disc project, and then retained for unlimited future use in the organization's library. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.
