Description
The U.S. Army, 409th Contracting Support Brigade, Theater Contracting Center, Unit 23156, APO, AE 09054-3156, has a requirement to provide a non-personnel services contract to provide Life Support Area (LSA) at Rhein Ordnance Barracks, Kaiserslautern, Germany. The U.S. Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the U.S. Government. The first day of required service will be on 28 May 2016 and the final day will be on 17 June 2016. The proposed contract award is Firm Fixed Priced. Complete details will be given in Request for Quote (RFQ) W564KV-16-R-0035 to be released to the Army Single Face to Industry (ASFI) and Federal Business Opportunities website (FedBizOps), within the next 30 days. This acquisition is being procured on a full and open competition basis with no set aside. The NAICS code for this procurement is 424990. PERFORMANCE WORK STATEMENT (PWS) SWIFT RESPONSE-16 Life Support Area (LSA) Part 1 General Information This is a non-personnel services contract to provide Life Support Area (LSA) at Rhein Ordnance Barracks, Kaiserslautern, Germany. The U.S. Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the U.S. Government. The first day of required service will be on 28 May 2016 and the final day will be on 17 June 2016. 1. Introduction: This is a non-personnel services contract to provide Life Support Area. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government. 1.1 Background: : Is an 82d airborne division-led multinational interoperability exercise IOT develop the U.S. Global Response Force with a multinational led CJTF CPX in Poland and U.S. global response force coupled with the allied readiness force ISO airborne operations into Hohenfels Training Area (HTA), Germany from 24 May 16 - 28 Jun 16. SR 16 utilizes 82d airborne division global response force (GRF) to expand the current 82nd joint operational access exercise (JOAX) model, by deploying a brigade (-) under 82d airborne mission command from Fort Bragg, North Carolina. The purpose of Swift Response 16 is to conduct Joint and Combined readiness training for a JTF Headquarters, Brigade, and Battalion level execution of strategic out load, airborne joint forcible entry, and follow-on missions. The exercise will be conducted at the following locations: Swindin, Bydgoszcz airfield, Torun, and DPTA in Poland; Hohenfels training area (multi-national interoperability field training exercise (FTX); Grafenwoehr training area(command post exercise (CPX) and (life support area (LSA); Rhein Ordnance Barracks, Germany (intermediate staging base (ISB) operations); Ramstein Air Base (APOD). 1.2 Responsibilities: The Contractor shall assume total responsibility for all requirements stated herein on the commencement date of the performance period. The Contractor shall perform as specified in this Contract and under the direction of the Contracting Officer (KO). See also Paragraph 1.1 Introduction. 1.2.1 Work Responsibility: The Contractor shall perform all work and assume responsibility for planning, programming, administering, managing, and executing all functions necessary to provide the services specified in this PWS. The Contractor shall conduct work in accordance with this PWS and all applicable United States (U.S.), German, and local laws, regulations, standards, provisions, and directives to include applicable publications in Section C-6. The Contractor shall ensure that all work meets the level of service, performance standards, or tolerances specified in the PWS or in applicable referenced documents. Some services under this Contract may be performed at designated facilities, or portions of installations, by in-house Government personnel or by other contractors. 1.2.2 Administrative Responsibility: The Contractor shall perform all related administrative actions required to provide services or perform work such as material requisitioning, quality control (QC), financial control, meetings, and correspondence. The Contractor shall also maintain accurate and complete records, files, and libraries of documents to include all U.S. German, and local regulations, standards, provisions, codes, laws, technical manuals, and manufacturers' instructions and recommendations that are necessary and related to the functions being performed. The Contractor shall compile historical data, prepare required reports, and submit information as specified by the Deliverable List presented in this PWS. 1.3 Objectives: Provide for the Life Support Area (LSA) at Rhein Ordnance Barracks, Kaiserslautern, Germany. The contractor shall provide all management, tools, supplies, equipment, and labor necessary to conduct Life Support Area, set-up, operate, maintain, and take down all previously identified items. 1.4 Functional Areas: Life Support Area 1.5 Period of Performance: The Period of Performance (POP) shall be from 28 May 2016 through 17 June 2016. 1.6 Management and Administration: 1.6.1 Phase In /Phase Out Period: Non-Applicable. 1.6.2 Contractor Management: The Contractor shall perform continual management of the functional areas contained in this PWS and shall provide a Project Manager physically present on-site during normal duty hours. The Project Manager shall conduct overall management coordination and shall be the central point of contact (POC) with the Government for performance of all work under the PWS. At the Post Award conference, the Contractor shall submit to the COR, in writing, the name, title, office, home and mobile telephone number of the Project Manager (Deliverable 103R003). A Contractor employee shall be designated to act for the Project Manager when work is being performed outside of duty hours, or during the Project Manager's absence. Both the Project Manager and the Contractor employee filling in for the Project Manager, shall have full authority to act for the contractor on all Contract matters relating to daily operation of this Contract. 1.6.3 Contractor Responsiveness: The Project Manager or designated alternate shall be available for telephone communication or site attendance, with the COR, as required by the COR, 24 hours a day, 7 days a week. A personal answering service is permitted at other than normal Contract workdays and work hours for receipt of COR emergency response work requirements, provided that the Project Manager or designee responds to all calls within a time not to exceed two hours after notification of the call by the answering machine and/or service. The Project Manager and any individuals designated to act in that capacity shall have full authority to contractually bind the Contractor for prompt action on matters pertaining to execution of the PWS. 1.6.4 Meetings, Conferences, and Briefings: The Contractor shall attend, participate in, and furnish input to scheduled and unscheduled meetings, conferences, and briefings that relate to the functions and services herein as required by the Government to provide effective communication and impart necessary information. The Project Manager or designated representative shall attend meetings as requested by the Government. Meeting attendees shall at times include Contractor managerial, supervisory, and other personnel knowledgeable of the subject matter. Meetings may start or end outside of regular duty hours. 1.6.5 Hours of Operation: The contractor is responsible for conducting business, between the hours of 0500 and 2000, 7 days a week. The contractor shall coordinate daily with the COR and expect to be able to adjust times if needed in order to accommodate daily mission requirements. For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential. 1.6.6 Recognized Holidays: Contractor shall perform during all recognized U.S. and German holidays as required to maintain service during the POP as defined by this PWS. These are typically combined with regular holiday leave schedules (for example, Christmas half days or day on day off schedules). Training Holidays may affect access to military operated facilities. If scheduled work or access to facilities is required, coordination with occupants will be necessary or the work in affected facilities shall be rescheduled after the training holiday. However, announced training holidays or exodus of military personnel may provide the Contractor with an opportunity for unrestricted access to facilities and areas. The Contractor shall take full advantage of such opportunities by planning maintenance or actions that are better accomplished when such areas are vacant. 1.6.8 Quality Control: The contractor shall develop and maintain an effective quality control program (QCP) to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor's quality control program is the means by which he assures himself that his work complies with the requirement of the contract. The QCP is to be delivered, within 30 days after contract award. Three copies of a comprehensive written QCP shall be submitted to the KO and COR within 5 working days when changes are made thereafter. After acceptance of the quality control plan the contractor shall receive the contracting officer's acceptance in writing of any proposed change to his QC system. 1.6.9 Quality Assurance: The government shall evaluate the contractor's performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s). 1.6.10 Place of Performance: The work to be performed under this contract will be performed at Rhein Ordnance Barracks, Kaiserslautern, Germany. 1.6.11 Type of Contract: The government will award a Firm Fixed Price or other equivalent contract. 1.6.12 Security Program: The contractor will NOT be expected to maintain any level of security clearance for this event. 1.6.13 Physical Security: The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured. 1.6.14 Key Control: Non-Applicable 1.6.15 Special Qualifications: The contractor is responsible for maintaining all required certifications in order to operate in Kaiserslautern, Germany. 1.6.16 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government. 1.6.17 Contracting Officer Representative (COR): The (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order. 1.6.18 Key Personnel: The follow personnel are considered key personnel by the government: An English speaking Supervisor on site in Rhein Ordnance Barracks, Kaiserslautern, Germany, during execution of the contract. The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The contract manager or alternate shall be available between 0500 and 2000 during the POP. 1.6.19 Identification of Contractor Employees: All contract personnel shall be identified with an employer issued badge so as to clearly indicate the person is an authorized contractor employee. The badge shall, at a minimum, contain a picture of the employee with the individual's full name shown and easily read. 1.6.20 Contractor Travel: Non-Applicable. 1.6.21 Other Direct Costs: Non-Applicable. 1.6.22 Data Rights: Non-Applicable. 1.6.23 Organizational Conflict of Interest: Contractor and subcontractor personnel performing work under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The Contractor's mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may effect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI. 1.6.24 Safety: The Contractor shall provide drivers licensed IAW with applicable regulations, and standards for operating in Germany. 1.6.24.1 Safety Plan and Program: The contractor shall adhere to all safety guidelines as required in the jurisdiction the service is being provided. 1.6.25 Environmental Compliance: Non-Applicable 1.6.25.1 Environmental Compliance Plan and Program: Non-Applicable DEFINITIONS & ACRONYMS 2. Definitions And Acronyms: 2.1 Definitions: Contractor - A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime. Contracting Officer - A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government. Contracting Officer's Representative (COR) - An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract. Defective Service - A service output that does not meet the standard of performance associated with the Performance Work Statement. Deliverable - Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports. Key Personnel - Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal. Physical Security - Actions that prevent the loss or damage of Government property. Quality Assurance - The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards. Quality Assurance Surveillance Plan (QASP) - An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance. Quality Control - All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements. Subcontractor - One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor. Work Day - The number of hours per day the Contractor provides services in accordance with the contract. Contractor Furnished Items And Responsibilities: 4.1 General: The Contractor shall furnish all supplies, equipment, facilities and services required to perform work under this contract that are not listed under Section 3 of this PWS. 4.2 Secret Facility Clearance: Non-Applicable. 4.3 Materials: The contractor shall provide all materials as identified in Part 5 below. If the material is not specifically mentioned herein, then it should be assumed the contractor is to provide the material if it is necessary to satisfy the intent of the contract. 4.4 Equipment: The Contractor shall furnish all equipment, supplies, and labor to provide LSA Support. SPECIFIC TASKS 5.1 Basic Services: This is a non-personnel services contract to provide Life Support Area (LSA) at Rhein Ordnance Barracks in Kaiserslautern, Germany. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the U.S. Government. The first day of required service will be on 28 May 2016 and the final day will be on 17 June 2016. 5.2 Recurring Services: The contractor shall provide the following: 5.2.1 Life Support Area 5.2.1.1. Scope: The contractor shall provide all management, tools, supplies, equipment, and labor necessary to conduct Life Support Area functions at Rhein Ordnance Barracks in Kaiserslautern, Germany. The location of the LSA, with respective latitude and longitudinal coordinates for each site are shown in Technical Exhibit 3 below. The Contractor shall provide Chemical Latrines, Hand washing Stations, Shower Tents, Grey Water Storage and Removal (Tank or Bladder), two twenty meter x fifty meter tent flooring, one eighteen meter x fifty-five meter tent flooring, six Light Kits two per tent, eight Heat/AC Units for DFAC with seating for five hundred personnel, four twenty foot containers two with Refrigeration of food items, two for Dry Storage of food items, one fully operational Food Dining Operation in which the vendor provides all equipment and labor to prepare, serve, sanitize in support of two thousand one hundred personnel with a Meal Cycle of AMA, and two eight cubic meter dumpsters. 5.2.1.2. Contractor shall provide all classes of supply and requirements in order to accomplish the mission. This includes, but is not limited to bulk water requirements for hand washing. Removal of any grey water produced as a result of hand washing shall be the responsibility of the contractor. 5.2.1.3. Contractor shall return all grounds to their original condition upon completion of mission. This includes, but is not limited to removal of all structures, equipment, power lines, cords, wires, trash, lumber and replacement of damaged grass by re-sodding. The contractor and COR will walk the site prior to commencement to work. It is the contractor's responsibility to document any damage on the grounds prior to any work being performed. 5.2.1.4. Additional requirements and modifications may be required in an urgent and compelling manner to ensure the success of operations. All coordination of these requirements shall be conducted through the Contracting Officer. 5.2.1.5. The successful offeror must provide an employee list of Host Nation employees to the Contracting Officer's Representative (COR) as soon as possible, but no later than 19 May 2016. Contractor employees on list will be issued badges by the contractor for access to the LSA. All Contractor personnel shall maintain identification badges on their person and visible at all times while in the area of operation (AOR). 5.2.2 Commercial Portable Latrines and Hand washing Stations: 5.2.2.1. Commercial Portable Latrines The contractor shall provide portable chemical toilets (one seat) that are of the standard commercial-type, a single cabin unit in the approximate size of 1.25 meters wide and 1.25 meters deep and 2.0 meters tall. The cabin is to be equipped with a hand cleaning agent (dispenser), a urinal, a waste holding tank (minimum capacity of 250 liters). The contractor shall deliver the portable chemical toilets in good operational working condition, clean and ready-for-use. All portable chemical toilets shall be either one-piece shell construction or high grade plastic. All units shall placed level on the ground and be properly stabilized to prevent turning over. Each unit shall have basic equipment: one toilet paper holder, clean unbroken toilet seats, screened vents, clothing hook, ventilation outlets, and operational interior locking mechanisms, translucent roof, and spring loaded doors providing automatic closure. 5.2.2.2 The contractor shall provide all labor, materiel, transportation and equipment required for the delivery, installation, emptying/servicing, removal of sludge to the appropriate sewage disposal point, and the pickup of the latrine facilities at the expiration of the rental period. All portable latrines shall be in place and service shall begin according to the period of performance stated in Schedule 5.2.3.1.4. 5.2.2.3 Servicing of Portable Chemical Latrines. All portable chemical toilets shall be cleaned at least once a day between the hours of 0700-2000, seven days a week, to include all weekends and holidays but may need to be cleaned more frequently to keep the sanitary systems in good clean working condition. Cleaning and maintenance shall include but not be limited to the following: 5.2.2.4 Pump out storage tank. 5.2.2.4.1 Replace chemicals and water. The proportion of chemical to water shall be in accordance with the manufacturer's recommendation. 5.2.2.4.2 Each cabin interior will be completely cleaned with a disinfectant agent, and the exterior walls will be cleaned as appropriate to give a well-maintained appearance. 5.2.2.4.3 Replenish toilet paper and hand sanitizer as needed. 5.2.2.4.4 Provide maintenance, repair or replacement of units as needed (within eight (8) hours of notification or next day by 0700 if contractor is notified after 1200 hours). The contractor may leave a day's supply of equipment and material (i.e. toilet paper, soap, sanitizer etc.) with the COR and or his representative to ensure full coverage over the required time period. 5.2.2.4.5 Contractor is responsible for inspection, maintenance, repair or replacement to ensure all facilities are free of cracks and leaks and are in good operational order. All facilities not meeting these standards shall be replaced within eight (8) hours of notification, or next day if contractor is notified after 1200 hours. 5.2.2.4.6 Location for latrines shall be coordinated with the Contracting Officer Representative (COR) at site. Disposal of all waste material shall be in accordance with host nation regulations. The contractor shall provide portable hand washing stations supplied with potable water that are of the standard commercial-type. Each station will include foot operated pump, liquid soap dispenser, paper towel dispenser, trash receptacle and water holding tanks consisting of one for potable water and one for gray water. Each unit should be constructed of high grade plastic material and shall have at a minimum the following specifications: gray and potable water holding tanks with the ability to handle 600 uses between cleanings, faucet which allows for the washing of both hands while the water is running. Wash basins must have the ability to hold water with built in or attached chain link stoppers. Provisions shall be taken to prevent personnel from standing in water puddles or mud on the ground around the sinks. 5.2.3.1 The contractor shall provide all labor, material, transportation and equipment required for the delivery, installation, servicing, and the pickup of the hand washing stations at the expiration of the rental period. All hand washing stations shall be in place and maintenance shall begin for each of the three locations according to the period of performance stated in Schedule 5.2.3.2.3. 5.2.3.2 Maintaining Portable Hand Washing Stations. All portable hand washing stations cleaned and maintained at least once a day between the hours of 0700-2000, seven days a week, to include all weekends and holidays. Replenishment of potable water and removal of gray water may be required more than once a day depending on capacity of the gray and potable water holding tanks. The Facility will also include privacy curtains to allow for male or females to shower concurrently. Coordinate location with COR. See Attachment 6. 5.2.5 Tent Flooring The contractor shall provide two (2) twenty (20) meter x fifty (50) meter tent flooring, one (1) eighteen (18) meter x fifty-five (55) meter tent flooring constructed of wood. Maximum slope of the flooring in any one direction shall be no greater than 1%. 5.2.6 Tent Lights Kits The contractor shall provide six (6) complete Light Kits; two (2) per tent at the locations depicted in Attachments 4 and 5. Light Kits shall include enough conductors to extend five (5) feet past the exterior wall of the tent at minimum in order to connect to the government provided power box. Light voltage will be 220 volts. Light kits shall be installed and be capable of producing a minimum of 200 LUX for all facilities. 5.2.7 Heat/AC Units The contractor shall provide eight (8) Dual Heat and AC capable units (Environmental Control Units) with a capacity greater than 350K BTU for the fully operational Food Dining Operation (DFAC) located in Attachment 5. All electrical connections, duct work, and physical tent connections will be the responsibility of the contractor. Electrical power will be provided by the U.S. Government. Coordinate locations with COR. 5.2.8 Food Storage Containers The contractor shall provide two (2) twenty foot (20') containers with Refrigeration Units for Cold Storage capable of self generated power (Internal) and the ability to connect to an external power source, for perishable food items. 5.2.9 Seating and Table The contractor shall provide 2.5m diameter table with eight chairs per table. Tables and chairs in quantity sufficient to seat five hundred (500) personnel at a time within the designated DFAC Tent. See Attachment 6. 5.2.10 Dumpster The contractor shall provide two eight cubic meter dumpsters at the locations designated. See Attachments 4 and 5. 5.2.11 Food Dining Operation The contractor shall provide one fully operational Food Dining Operation in which the vendor provides all equipment and labor to prepare, serve, sanitize in support of two thousand one hundred personnel with a Meal Cycle of a Hot Meal, MRE, Hot Meal (AMA) Government will provide all food to be prepared during the (A) cycle, the (M) cycle does NOT need to be handled by contractor. 5.3 On-Demand Services: Non-Applicable. 5.4 Functional Areas: Non-Applicable. 5.5 Task Heading: Non-Applicable. 5.6 Contractor Manpower Reporting Application (CMRA): Non-Applicable.
