4 April 2016 Alexander D. Mueller (CT) US Army Corps of Engineers 1616 Capitol Ave Omaha, NE 68102 Service Code R410 Subject- Notice of Intent to Sole Source In Accordance with Federal Acquisition Regulation (FAR) 6.302-1 "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements" Solicitation Number- W9128F-16-R-0074 Closing response date 20 April 2016 This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 -Synopses of Proposed Contract Actions. US Army Corps of Engineers - Omaha District, intends to issue a Firm-Fixed Price contract to Louis Berger Group, located 412 Mount Kemble Ave, Morristown, NJ 07960 on a Sole Source basis. Description of work- The objective of this requirement is to provide work items that require Contractor support for the U.S. Army Corps of Engineers (USACE) to finalize preparation of a Management Plan (MP) and environmental impact statement (EIS) for potential changes to the Biological Opinion on Operation of the Missouri River Main Stem System, Operation and Maintenance of the Missouri River Bank Stabilization and Navigation Project, and Operation of the Kansas River Reservoir System (USFWS, 2000), including its amendment (USFWS, 2003) and adaptive management actions. The primary purpose of this contract is to execute the requirements of the National Environmental Policy Act (NEPA) of 1969 for these potential changes. Louis Berger Group has been working on this project for the Corps of Engineers since 2013 and is intimately familiar with the work required to finalize the plan. Duration of the contract is from approximately 1 August 2016 - 28 February 2018. Authority- The statutory authority for this non-competitive acquisition is 10 U.S.C. 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR), Part 6.302-1 "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements" No other sources have been determined to be capable of conducting this work to provide the data quality essential to addressing the project objectives. There have not been any alternate services determined to be used or obtained competitively. It is the best value to the government to procure this work via sole source contract with Louis Berger Group, as it is the most cost-effective option to accomplish this work, while maximizing continuity and data quality to ensure the data and resultant information is available to guide management decisions into the future. A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this sole source action. The NAICS code is 541990, "All Other Professional, Scientific, and Technical Services". The size standard as defined by the U.S. Small Business Administration is $15M. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. Oral communications are not acceptable in response to this notice. A determination by the government not to compete this proposed requirement is solely within the discretion of the government. Responses and questions shall be submitted to alexander.d.mueller@usace.army.mil. The U.S. Army Corps of Engineers is not responsible for any costs incurred by responding to this notice.
