COMBINED SYNOPSIS/SOLICITATION VA248-16-Q-0890 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation for this action. Quotes are being requested, and a written solicitation will not be issued. This solicitation is issued as a Request for Quote (RFQ). Submit written quotes on RFQ VA248-16-Q-0890. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-87-2 / 04-06-2016. This solicitation is issued 04/08/2016 and will end 04/13/2016 at 16:00 pm EST and is 100% set aside for Small Business (SB) and only qualified offerors may submit quotes. The Network Contracting Office 8-SAO East intends to award a firm-fixed price contract for National Fire Protection Associations On-Site training for NFPA 13, NFPA 20, and NFPA 25 Services for Bay Pines Veterans Affairs Medical Center, 10000 Bay Pines Blvd, Saint Petersburg, FL 33708. This procurement is being conducted under FAR Part 13 Simplified Acquisition Procedures apply. The intent is to award a onetime contract for a 5 day training session at our facility. Period of Performance is to be provided in May 2016. Upon completion of these training students will be awarded 0.7 CEU's per day for successful completion of the seminars through an accredited and authorized training built by the publisher of the codes, delivered with official NFPA books using NFPA approved training and certifications and not using their own interpretations. The North American Industrial Classification System (NAICS) code for this procurement is 611430-Professional and Management Development Training with a small business size standard of $11 Million. All offerors must be registered in System for Award Management (SAM) at http://www.sam.gov to be considered for an award of a federal contract. The record must be complete and not missing elements such as representations and certifications.. Vendors also have to be registered in Small Business Administration (SBA) http://dsbs.sba.gov/dsbs/search/dsp_dsbs.cfm. Questions not received within the specified time prior to the close of the solicitation may not be considered. *** The Government will award a contract resulting from this RFQ to the responsible offeror whose quote is the lowest price technically acceptable (LPTA). Quotes are due by 16:00 P.M. Eastern Standard time on April 14, 2016. Quotes received after this date and time will be considered late in accordance with 52.212-1(f) and will not be evaluated. STATEMENT OF WORK National Fire Protection Associations (NFPA) NFPA ON-SITE TRAINING - NFPA 13, NFPA 20, AND NFPA 25 Purpose: The contractor is to provide all labor, materials, equipment, and incidentals to conduct 5-days of NFPA on-site training. The five-day seminar shall provide training to our staff in accordance with the National Fire Protection Association (NFPA) associated regulatory & code requirements for NFPA 13- Standard for the installation of sprinkler system, NFPA 20- Standard for the installation of stationary pumps for fire protection, and NFPA 25- Standard for the inspection, testing, and maintenance of water-based fire protection systems. The five-day seminar will be held at the Bay Pines, Florida facility, students will be awarded a minimum of 3.0 CEUs through an accredited and authorized provider by the International Association for Continuing Education and Training (IACET). Background: The NFPA 13, NFPA 20, and NFPA 25 training will provide up to 25 of designated staff the knowledge and expertise to conduct inspections with the ability to site codes and references to better protect or staff, visitors, and veterans. Bay Pine's staff requires CEUs to keep their professional certifications current. Objectives: Personnel to be Trained: 25 Bay Pines Employees Location: Bay Pines VA Health Care Facility Duration: 5 days (total) Vendor will provide On-site Training, student manual, a copy of the 2016 edition of NFPA 13, a copy of the 2016 edition of NFPA 20, a copy of the 2014 edition of NFPA 25, a calculator, canvas brief case, and a Certificate of Attendance. Those students who pass the exam will also receive a Certificate of Educational Achievement. The objective is for trainees to gain a certification at the conclusion of the 5 days of training and prepare unannounced Joint Commission and CMS surveys, Annual Work Place Evaluations and demonstrate their newly acquired knowledge of related NFPA codes and standards. A minimum of 3.0 CEUs are required to be awarded upon completion of training through an accredited and authorized provider by the International Association for Continuing Education and Training (IACET). Scope: The contractor shall provide all personnel, equipment, tools, materials, supervision, and other items necessary to provide on-site training, certification, and Continuing Education Units (CEUs) for National Fire Protection Association (NFPA) 13, 20 and 25, for twenty-five (25) participants at the Bay Pines VA Health Care Facility, 10000 Bay Pines Blvd, Bay Pines, FL 33744. Mandatory Tasks and Deliverables: The contractor shall provide an instructor with a working knowledge of policies and procedures. Specifically, the contractor shall provide the following: Task One: NFPA 13-Standard for the installation of sprinkler systems. This portion of the training is designed to educate the student to the comprehensive requirements of sprinkler system design, installation, and acceptance testing. At the conclusion of this module, participants should be able to: oExplain the organization of NFPA 13 oExplain Hazard Classification/Identifying the Hazard oExplain the overall Water Supplies oExplain the concepts of Type of System/System Requirements oLocate Code definitions oExplain classification of Design Approaches oExplain classification of Design Deliverables oIdentify System Components and Usage oDetermine System Acceptance oIdentify and describe type of storage Task Two: NFPA 20-Standard for the installation of Stationary Pumps for Fire Protection The certificate training is designed to certify students that successfully complete the program to be able to locate and apply the requirements for stationary fire pumps and ensure proper function according to the provisions found in NFPA 20. The course will cover both electric motor driven pumps and diesel engine driven pumps. At the conclusion of this module, participants should be able to: oExplain the organization of NFPA 20 oExplain Fire Pump Basics oDetermine and apply Pump Selection Criteria oExplain and apply Driver Selection Criteria oLocate Code definitions oIdentify and apply Installation Requirements oExplain classification of Design Deliverables oDetermine Acceptance Testing and Close Out Task Three: NFPA 25-Standard for the inspection, testing, and maintenance of water-based fire protection systems Students will learn the requirements for inspection, testing and maintenance of water-based systems. Understanding how the suppression systems are designed, installed, commissioned, inspected, and tested will help our agency avoid failure of the fire alarm system and ensure that systems are maintained in operational order. Additionally, BPVAHCS pipe fitters having successfully completed the training would have a level of training necessary to conduct limited response actions including replacement of sprinkler heads, escutcheons and to facilitate some system repair work. At the conclusion of this module, participants should be able to: oIdentify General Requirements, and Impairments oIdentify and apply Sprinkler Systems, Hoses, and Water Mains oDefine Fire Pumps and Tanks oDefine and identify Valves, Valve Components, and Trim oExplain and identify Obstruction Investigations Deliverables: oInstructor shall be a qualified Fire Protection Engineer with experience instructing for the NFPA and has completed a minimum of six (6) NFPA 13, 20 and 25 classes on the latest edition of the code oThe class will begin at 8:00 am and end at 4:30 pm each day unless preapproved by the Safety and Emergency Management Chief. Classes will be conducted over five (5) consecutive business days (Mon-Fri). The class dates will be determined by the Bay Pines Medical Center Safety and Emergency Management Chief, with a minimum of three (3) weeks advance notice. oInstructor shall provide computer and projection system needed to teach the class. oPrice must be all-inclusive, covering all of the instructor's travel and expenses, all course materials, and a copy of the most recent edition of the NFPA 13, 20 and 25 for each student. Period of Performance: The period of performance shall be 90 days from the date of award. There are ten (10) Federal holidays set by law (U.S.C. Title 5 Section 6103): Under current definitions, four are set by date: New Year's DayJanuary 1 Independence DayJuly 4 Veteran's DayNovember 11 Christmas DayDecember 25 If any of the above falls on a Saturday, then Friday shall be observed as a holiday. Similarly, if one falls on a Sunday, then Monday shall be observed as a holiday. The other six are set by a day of the week and month: Martin Luther King DayThird Monday in January Washington's BirthdayThird Monday in February Memorial DayLast Monday in May Labor DayFirst Monday in September Columbus DaySecond Monday in October ThanksgivingFourth Thursday in November Place of Performance: The Contractor shall support this effort at the Bay Pines VA Health Care Facility, 10000 Bay Pines Blvd, Bay Pines, FL 33744. Key Personnel: Certain skilled experience professional and/or technical personnel are essential for accomplishing the work to be performed. These individuals are defined as "Key personnel" and are those persons whose resumes were submitted and marked by the vendor as "Key Personnel". Substitutions shall only be accepted if in compliance with "Substitution of Key Personnel" provision identified below. The instructor shall be a qualified Fire Protection Engineer with experience instructing for the NFPA and has completed a minimum of ten (10) NFPA 101 & 99 classes on the latest editions of the code. Travel: Bay Pines anticipates no travel of VA personnel. Quote must be all inclusive, covering all of the instructor's travel and expenses required to provide on-site training at Bay Pines. Type of Contract: A Firm- Fixed Price Contract will be issued for this effort. Changes to the SOW: Any changes to this SOW shall be authorized and approved only through written correspondence from the Contracting Officer. A copy of each change will be kept in a project folder along with all other products of the project. Costs incurred by the contractor through the actions of parties other than the Contracting Officer shall be borne by the contractor. Government and Contractor Responsibilities: The CBO shall provide the contractor with copies of documents that the VA is required to provide. The contractor shall request other VA documentation deemed pertinent to the work accomplishment directly from the COR. The contractor is expected to use common knowledge and resourcefulness in securing all other reference materials, standard industry publications, and related materials that are pertinent to the work. The contractor shall maintain frequent communications with the Program Office and the COR to conduct work in progress reviews. Progress reports shall be delivered electronically to the COR, with an electronic courtesy copy to the Program Office. Formal Acceptance or Rejection of Deliverables: The VA shall have 5 business days to review each document and provide feedback and comments. The contractor shall have five business days to incorporate comments. A final review shall be conducted with the COR and the HRC Training Department. Delivery of the post-final review document with incorporated comments from the final review meeting shall constitute acceptance by the VA with COR's written approval. Quality Standards for Deliverables - Performance Measures: Standards Review of relevant materials. Deliverables shall be timely, comprehensive, thoughtful, relevant presentation of alternatives, pros and cons, and feasible recommendations. CBO Presentations: Presentations shall be clear, concise, executive-focused, and written in such a way as to be understood by lay persons. Quality of deliverable directly correlates with effectiveness of CBO communications. Project Plan: Project Plan shall be timely and comprehensive; recognize and address authority, perceptions, and concerns of stakeholders; incorporate scope of requisite contract requirements across the CBO. Reports: Reports are submitted on time and include those topics described in the SOW, agreed to in the master plan and as requested for special reports; necessary clearances are obtained as needed in a timely manner. Publications and other documents: Deliverables are timely submission in formats appropriate to target audiences; consideration of best dissemination mechanisms; user friendly, clear, thorough and comprehensive documentation and publications. Meeting support: Timely and thoughtful pre-meeting preparations and logistics; smooth meeting operations; timely and comprehensive post-meeting summaries. Coordination: Contractor collaboration with CBO is timely, appropriate and demonstrates cooperative support to VHA Executives and staff. Analyses and Assessments: Analyses and assessments are performed with accuracy, comprehensiveness and adherence to industry best practices. Modifications: Timely, comprehensive, high quality covering all functional, performance, and physical areas as delineated in the SOW; final plan incorporates VA feedback in a timely manner. Obtain relevant stakeholder input: Deliverables are innovative, timely implementation of input mechanisms; accurate and comprehensive synthesis of results and recommendations. Integration of relevant stakeholder input documented for deliverable. SECURITY - PRIVACY REQUIREMENTS: General - All contractors and contractor personnel shall be subject to the same Federal laws, regulations, standards and VA policies as VA, and VA personnel, regarding information and information system security. Contractors must follow policies and procedures outlined in VA Directive 6500, Information Security Program and its handbooks to ensure appropriate security controls are in place. The C&A requirements do not apply, and that a Security Accreditation Package is not required. The following requirements are GO/NO GO 4.Technical Requirements that the Contractor Shall Provide: The Government will award a firm fixed priced contract to the responsible offeror who is the lowest priced technically acceptable. The following factors will be utilized to determine the acceptability or unacceptability of a quote: 1.0Factor 1 - Technical 1.1To be acceptable, the offeror their qualifications to provide NFPA 13, NFPA 20, and NFPA 25 training and also must be able to provide evidence that they can provide Federally recognized CEU certification to students. Failure to provide authorization will reflect a determination of unacceptability. The offeror must show that it has credentials to provide this training to be able to certify our personnel and to conduct the work in the SOW complying with FAR 52.219-14. 1.2Offerors must submit a narrative, describing experience in performing the work identified in the SOW regarding training and experience of the personnel who will perform the work. Include number of years of experience or specialized training in performing the services. Include training certificates and/or work experience. The Government will evaluate the Offeror's reputation for a record of reasonable and cooperative behavior and commitment to customer satisfaction; and generally the Offeror's business-like concern for the interest of the customer. 2.3In investigating relevant past performance, the Government considers information in the offeror's proposal and information obtained from other sources. Other sources may include past & present customers & their employees, other Government agencies including state and local, consumer protection agencies pre-award surveys, and better business bureaus & others who may have useful information, including the Government's Contractor Performance Assessment Reporting System (CPARS) & Past Performance Information Retrieval System (PPIRS). 2.4Offerors must provide the Past Performance Questionnaire (Attachment A), for up to five (5) or more Past Performance References of the same size and scope, instructing them to complete the form and Email/Fax the completed form per the instructions on the Questionnaire, by April 14,2016 4:00 PM EST. Offeror needs to complete section 1 (Contractor/Offeror Information). 2.5Past performance will be evaluated on an acceptable or unacceptable basis. If two or more questions on the questionnaire are found to be unacceptable this will lead to an overall questionnaire rating of unacceptable. Offerors without a record of relevant past performance or for whom information on past performance is not available, will not be evaluated as either favorable or unfavorable, and, as a result, will receive a "Neutral/Unknown Confidence" rating for past performance. 3.0Factor 2 - Price The Government will utilize a comparison of quoted prices in response to the solicitation. 3.1A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. Award: The Government intends to award a contract resulting from this RFQ to the lowest priced, technically acceptable offor that is deemed responsible. Disputes (July 2002) (a) This contract is subject to the Contract Disputes Act of 1978, as amended (41 U.S.C. 601-613). (b) Except as provided in the Act, all disputes arising under or relating to this contract shall be resolved under this clause. (c) "Claim," as used in this clause, means a written demand or written assertion by one of the contracting parties seeking, as a matter of right, the payment of money in a sum certain, the adjustment or interpretation of contract terms, or other relief arising under or relating to this contract. However, a written demand or written assertion by the Contractor seeking the payment of money exceeding $100,000 is not a claim under the Act until certified. A voucher, invoice, or other routine request for payment that is not in dispute when submitted is not a claim under the Act. The submission may be converted to a claim under the Act, by complying with the submission and certification requirements of this clause, if it is disputed either as to liability or amount or is not acted upon in a reasonable time. (d)(1) A claim by the Contractor shall be made in writing and, unless otherwise stated in this contract, submitted within 6 years after accrual of the claim to the Contracting Officer for a written decision. (ii) The certification requirement does not apply to issues in controversy that have not been submitted as all or part of a claim. (iii) The certification shall state as follows: "I certify that the claim is made in good faith; that the supporting data are accurate and complete to the best of my knowledge and belief; that the amount requested accurately reflects the contract adjustment for which the Contractor believes the Government is liable; and that I am duly authorized to certify the claim on behalf of the Contractor." (3) The certification may be executed by any person duly authorized to bind the Contractor with respect to the claim. (e) For Contractor claims of $100,000 or less, the Contracting Officer must, if requested in writing by the Contractor, render a decision within 60 days of the request. For Contractor-certified claims over $100,000, the Contracting Officer must, within 60 days, decide the claim or notify the Contractor of the date by which the decision will be made. (f) The Contracting Officer's decision shall be final unless the Contractor appeals or files a suit as provided in the Act. (g) If the claim by the Contractor is submitted to the Contracting Officer or a claim by the Government is presented to the Contractor, the parties, by mutual consent, may agree to use alternative dispute resolution (ADR). The protest will not be considered if the interested party has a protest on the same or similar issues pending with the contracting officer. (End of Provision) 852.237-70 Contractor Responsibilities. The contractor shall obtain all necessary licenses and/or permits required to perform this work. He/she shall take all reasonable precautions necessary to protect persons and property from injury or damage during the performance of this contract. He/ she shall be responsible for any injury to himself/herself, his/her employees, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by his/her employees fault or negligence, and shall maintain personal liability and property damage insurance having coverage for a limit as required by the laws of the State of Florida. Further, it is agreed that any negligence of the Government, its officers, agents, servants and employees, shall not be the responsibility of the contractor hereunder with the regard to any claims, loss, damage, injury, and liability resulting there from. (End of Clause) VAAR 852.270-1 REPRESENTATIVES OF CONTRACTING OFFICERS (JAN 2008) The contracting officer reserves the right to designate representatives to act for him/her in furnishing technical guidance and advice or generally monitor the work to be performed under this contract. Such designation will be in writing and will define the scope and limitation of the designee's authority. A copy of the designation shall be furnished to the contractor. (End of Provision)
