Description
On April 7, 2016, the Technology Acquisition Center awarded Delivery Order VA118-16-F-0945 under the terms and conditions of National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V contract NNG15SD26B with ThunderCat Technology, 1775 Wiehle Avenue Suite 104, Reston, VA 20190. ThunderCat Technology will be providing ForgeRock Software maintenance. The period of performance shall be from August 28, 2016 through August 27, 2017, plus three 12-month options for continued maintenance support, the total order value of $254,933.18. ? JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1.Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 2.Description of Action: This proposed action is for the award of a brand name firm-fixed-price task order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC). 3.Description of Supplies or Services: VA, Office of Information and Technology, Service Delivery and Engineering, Enterprise Operations (EO) has a requirement for the renewal of brand name ForgeRock Software maintenance. ForgeRock software provides access management functionality which manages secure access services remotely from any location at any time and identity management functionality which simultaneously manages user identities across multiple digital channels. The required software maintenance will consist of software upgrades, updates, and fixes, to include major releases, point releases, service releases and security releases of applicable software on a quarterly basis, and within 48 hours in cases in which a high risk vulnerability fix becomes available. These software license maintenance renewals and updates are necessary for EO to be able to operate successfully and ensure the software remains operational. The period of performance is August 28, 2016 through August 27, 2017, plus three 12-month option periods, if exercised. 4.Statutory Authority: The statutory authority permitting this exception to fair opportunity is 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5.Rationale Supporting Use of Authority Cited: Based on market research, as described in section eight of this document, it was determined that limited competition is available for the required brand name ForgeRock Software maintenance. The current EO infrastructure includes existing ForgeRock Software and VA requires support compatible with the existing infrastructure protocols and functionality for continued operational availability. ForgeRock software provides access management functionality which manages secure access services remotely from any location at any time and identity management functionality which simultaneously manages VA user identities across multiple digital channels. VA requires software upgrades, updates, and fixes, to include major releases, point releases, and service releases of applicable software on a quarterly basis, and within 48 hours in cases where a high risk vulnerability fix becomes available. Only ForgeRock or its authorized resellers can provide the necessary software updates because of the propriety source code required to develop and implement software updates. Additionally, for this reason no other source provides the technical support for the product, such as helpdesk support. Replacement of the existing ForgeRock Software licenses is cost prohibitive compared to acquisition of license and maintenance renewal of the existing software. Should maintenance for the ForgeRock software not be acquired, there is an immediate risk to the functionality which could compromise secure access services for VA employees and Veterans. 6.Efforts to Obtain Competition: Market research was conducted, details of which are in section eight of this justification. This effort did not yield any additional sources that can meet the Government's requirements. It was determined that limited competition is viable among authorized resellers for the required brand name ForgeRock Software maintenance renewal. This justification shall be posted with the solicitation on the NASA SEWP web site for review by prospective GWAC holders. 7.Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be competed. 8.Market Research: The Government's technical expert performed market research in July 2015 by reviewing similar software products to ascertain if these items could meet VA's requirements. Specifically, the Government's technical experts conducted web-based research on software solutions offered by Authentify and AlertEnterprise. The market research confirmed that the source code required to perform the required software maintenance s is proprietary, therefore ForgeRock or its authorized resellers are the only sources capable of providing the required maintenance to include upgrades, updates and fixes for ForgeRock Software. No other vendor, including those reviewed by the technical experts, has the capability of developing and issuing software upgrades, updates or fixes for ForgeRock Software necessary to support existing EO requirements. Based on the above, only ForgeRock Software maintenance meets all of the Government's requirements. Additional market research was conducted in January 2016 by utilizing the NASA SEWP V GWAC Provider Look-up Tool to determine whether the brand name ForgeRock Software maintenance is available from resellers that hold NASA SEWP V contracts. It was determined that there are several resellers of brand name ForgeRock Software maintenance that hold current NASA SEWP V contracts. Therefore, limited competition is expected from NASA SEWP V GWAC resellers. 9. Other Facts: None.
