- The U.S. Customs and Border Protection on behalf of the Office of Human Resources Division intends to procure instructional training in the areas covering Merit Systems Protection Board (MSPB) Charges and Penalties with an emphasis in employee relations and discipline. The Contractor will be expected to provide detailed training in covering the basics of charges, penalties and performance cases, with additional interest on leave abuse and medical issues. The Contractor should have a thorough teaching discussion for understanding the five elements of every disciplinary case and the MSPB's power to mitigate a penalty and recent trends in the Board's use of that authority, educating uninformed arbitrators, using alternatives to discipline. The Contractor will be expected to teach and discuss the different types of charges, parts of a charge, how charges are interpreted, the role of the proposing and deciding officials, attractive options to difficult charges and common charging mistakes. Our practitioners will be expected to learn how to be able to effectively argue and support intent and non-intent charges, draft defensible performance standards which may include converting an unacceptable performance problem into a proper Part 752 disciplinary action if necessary. The course material will be covered over two full business days at a designated training location in Tucson, AZ. Electronic course material shall be provided to the COR/POC, no later than one full month prior to the training start date. In addition, fifty new, hardcopy textbooks, which would support the MSPB training, must be delivered to the Tucson LER Field Services Office POC one month prior to the start of the class date. A book which supports the MSPB training would be similar to the latest edition of UnCivil Servant. The Contractor will provide and teach a group course of a minimum of 35 LER employees and a maximum of 50, at a designated training location. All audio-video equipment for the instructor to conduct the course will be provided except for a computer. This is a market survey / sources sought for informational purposes only and shall not be construed as a Request for Quote. Currently, there is no solicitation document available; no contract will be awarded based on this announcement; no reimbursement will be made for costs associated with responding to this announcement, and no telephone calls about this procurement will be accepted or acknowledged. Contractors are responsible for all costs for submitting their capability packages.
