Description

1. Agency and Contracting Activity Identification: The National Cemetery Administration ( NCA), Pacific District, 1301 Clay Street, Suite 1230 North, Oakland CA 94612-5209, as directed by the NCA National Memorial Cemetery of Arizona (NMCA) will enter into a Purchase Order that requires justification for other than full and open competition procedures. 2. Nature of Acquisition Being Approved: NMCA Waste Management services container rental and pickup. Award shall be made through other than full and open competition to Waste Management, due to the company territorial rights. 3. Description of Requirement: The awarded contractor is to provide Waste Pickup and container rental services. The period of performance shall be from April 12, 2016 through September 30, 2016. The estimated cost is $31,800.00. 4. Statutory Authority Permitting Other Than Full and Open Competition: The Services are being procured under the authority of 41 U.S.C. 3304 (a) (1), FAR Part 6.302-1(b)(2). 5. The Nature of the Acquisition Requires Use of the Authority Cited: FAR Part 6.302-1. When the agency's need for the supplies or services can only be procured to one responsible source and no other supplies or services will satisfy agency requirements. Market research indicates that there zero companies in the required area to completely satisfy the requirements without using the Waste Management garbage facility. Waste Management is the sole company that holds territorial refuse rights within the NMCA. Other companies may provide the services as a duplicate subcontractor to Waste Management which will only cause unnecessary additional cost to the Government. Award shall be made to Waste Management for refuse services. 6. A Description of Efforts Made to Ensure That Offers From as Many Potential Sources As Practicable and Whether a Notice Will Be Publicized. A notice shall be posted in accordance with FAR part 5 procedures. 7. Anticipated Cost: The anticipated cost should be fair and reasonable to the government based upon comparative service pricing from past competed requirements. 8. Results of Market Survey: Market research indicates that many companies are able to provide the service. However, the Waste Management Facility will still be utilized. This will cause additional unnecessary cost on the Government. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: None. See Items 5 above. 10. Any Other Interested Sources? Yes, however, there are no company that can complete the job without the assistance of the apparent awardee. 11. A Statement of the Actions, if any, the Agency May Take To Remove of Overcome Any Barriers to Competition Before Any Subsequent Acquisition is required: It is not anticipated that any subsequent requirement will be needed by the Government. 12.
