Description

Justification for Exception to Fair Opportunity This J&A is being posted in compliance with FAR 16.505, within 14 days after placing an order exceeding the simplified acquisition threshold that is supported by an Exception to Fair Opportunity justification for Brand Name. On April 12, 2016, The National Institute of Allergy and Infectious Diseases issued a delivery order to DLT Solutions under NITAAC Contract HHSN316201500012W Order HHSN272200006. This order was issued under the authority of 41 U.S.C. 4106(c), as implemented by FAR 16.505(b)(2)(i), only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized for the justification. The justification document is provided in the attached package.
