- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office (NCO) 19, 4100 E. Mississippi Ave., Suite 900, Glendale, CO 80246, on behalf of the Salt Lake City VA Medical Center (SLCVAMC), 500 Foothill Drive Salt Lake City, UT 84148. The Department of Veterans Affairs proposes to enter into a contract on the basis of other than full and open competition for preventative maintenance of the campus-wide Johnson Controls METASYS Systems. The purchase request number is 660-16-1-5059-0065. 2.Nature and/or Description of the Action Being Processed: This is a new procurement to purchase from Johnson Controls all necessary labor, equipment, supplies, and supervision to perform Preventive Maintenance Planned Service. This system is proprietary to Johnson Controls and they are the original equipment manufacturer (OEM) of the system currently in use at the SLCVAMC. The estimated total value of the contract, including the base and all option years, is $611,254.00 3.Description of Supplies/Services Required to Meet the Agency's Needs: In order to meet the continuous maintenance needs for the Johnson Controls systems currently installed at the SLCVAMC, a responsible contractor is required to supply all labor, equipment, supplies, and supervision to perform Preventive Maintenance/Planned Service on the Johnson Controls proprietary systems. 4.Statutory Authority Permitting Other than Full and Open Competition: 41 USC §253(c) (1), as implemented by FAR 6.302.1 (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Johnson Controls Metatsys System is the system currently installed campus wide. This system provides integrated controls for the heating and cooling of almost every building on the SLCVAMC Campus. Without regular preventative maintenance and OEM tech support the performance of this system may be decreased or disrupted, causing difficulties in maintaining the proper temperature through the facility. This purchase is of their proprietary services, hardware, and software that cannot be obtained from any other vendor. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable; Because of the proprietary nature of this equipment, it is necessary to utilize the Original Equipment Manufacturer. In the future all similar requirements will be competed to the fullest extent practicable. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The cost of this equipment is in line with other OEM equipment of like nature and use. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Due to the proprietary nature of this requirement, initial market research was limited to contacting the OEM for a quote as well as statement of the sole source nature. After receiving the verification of the proprietary nature of the service, I contacted two other contractors in the Colorado/Utah area who specialize in building systems controls and both verified that Johnson Controls would be the only vendor to supply the required service. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Johnson Controls 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Any purchase must be made through the OEM because of the proprietary nature of the equipment.
