- Revised combined synopsis/solicitation. (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) The solicitation number is AHR173764. The solicitation is issued as a Request for Quote (RFQ). (iii) This solicitation and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-87-1. (iv) The NAICS code for this acquisition is 541519 and the corresponding small business size standard is $27.5 million. (v) List of contract line item number(s) and items, quantities and units of measure - One 12-month renewal of Ektron CMS400.NET software maintenance. To be technically acceptable, the product quoted shall be Ektron brand ONLY. Please see section xiii for the "Brand Name Justification." (vi) Description of Requirement - The Department of Health and Human Services (DHHS), Agency for Healthcare Research and Quality (AHRQ), requires a 12-month renewal of standard maintenance for its Ektron CMS400.NET Enterprise software licenses, to include unlimited phone and email support within business hours 8 a.m. through 8 p.m.; access to software version upgrades on major and minor releases, patches, etc.; and two pre-production domain keys. (vii) The period of performance shall be from 04/30/2016 - 04/29/2017. (viii) The provision at FAR 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition. (ix) The provision at FAR 52.212-2, Evaluation - Commercial Items, applies to this acquisition. The Government will award a contract resulting from this synopsis/solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. (x) Offerors are to include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items, with its offer or acknowledge its listing in the System for Award Management (SAM) website. (xi) The clause at FAR 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition. (xii) The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (MAR 2016), applies to this acquisition. The Contracting Officer has indicated the following clauses listed in paragraph (b) as applicable and are hereby incorporated by reference: (25) 52.222-3, Convict Labor (JUN 2003); (27) 52.222-21, Prohibition of Segregated Facilities (APR 2015); (28) 52.222-26, Equal Opportunity (APR 2015); (30) 52.222-36, Affirmative Action for Workers With Disabilities (JUL 2014); (33) 52.222-50, Combating Trafficking in Persons (MAR 2015); (40) 52.223-18, Encouraging Contractor Policies to Ban Text Messaging While Driving (AUG 2011); (44) 52.225-13, Restrictions on Certain Foreign Purchases (JUNE 2008); and (50) 52.232-33, Payment by Electronic Funds Transfer - System for Award Management (JUL 2013). (xiii) Brand Name Justification - AHRQ requires the use of the Ektron software maintenance because it currently owns and uses the Ektron Web Content Management platform, and requires continued use of the software/platform in order to deliver essential intranet-related services to its employees, contractors, and other on-site staff. Use of a different platform would disrupt AHRQ's existing processes and inhibit proper functioning. Clauses - The clauses at FAR 52.232-40, Providing Accelerated Payment to Small Business Subcontractors (DEC 2013); HHSAR 352.203-70, Anti-Lobbying (DEC 2015); and HHSAR 352.222-70, Contractor Cooperation in Equal Employment Opportunity Investigations (DEC 2015), apply to this acquisition.
