Description
Notice of Intent to Award Sole Source It is the intent of the National Archives and Records Administration (NARA) to enter into a sole source, firm fixed price order with Interra Systems, Inc., 1601 S. De Anza Blvd, Cupertino, CA 95014, for an annual maintenance agreement for Baton software. The proposed contract action will be conducted in accordance with FAR Part 12, Acquisition of Commercial Items. The NAICS code is 541511. The order will be for the base year plus four option years. The base year period of performance is July 1, 2016 through June 30, 2017. The anticipated award date is June 1, 2016. The proposed contract action is for services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302, only one responsible source and no other supplies or services will satisfy agency requirements. Interested persons may identify their interest and capability to respond to the requirement or submit quotes no later than 4:00 p.m. eastern time May 4, 2016. This notice of intent is not a request for competitive quotes. However, all quotes received after the date of publication of this synopsis and prior to 4:00 p.m. eastern time May 4, 2016, will be considered by the Government. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred in responding to this notice. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY, AND SPECIFIC IDENTIFICATION OF THE DOCUMENT AS A "JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION" See Page 1 II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED NARA seeks to make a sole source purchase for an annual maintenance agreement with Interra Systems, Inc. for continued support of their file quality control tool (Baton). The original equipment was purchased in FY 2011 at a cost of $ from Interra Systems, under Purchase Order NAMA-NW-11-M-001. The order included the base year plus for four option years at a cost of $ per each option year. The total order was $. Interra Systems is the only manufacturer and supporter of the Baton software and therefore Interra Systems is the only provider of service for Baton in order to ensure files meet industry standards and are verified in order to provide greater access to the moving image and audio collections. While there are other file verification and QC tools on the market it would be cost prohibitive to purchase an entirely new system. A new system would cost, on average, approximately $50,000.00 with similar costs for ongoing maintenance and upgrades. Testronic software is $ with the need for a new server ($ ), Tektronix Aurora is $ with the need for a new server ($ ), and Telestream is $ also with the need for a new server. III. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS (INCLUDING THE ESTIMATED VALUE) NARA seeks to make a sole source purchase for an annual maintenance agreement with Interra Systems for continued support of their file quality control tool (Baton). The cost of the annual maintenance agreement with Interra Systems is $ for the base year and $ for each of the four option years. The total estimated cost is $. IV. AN IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION. 41 U.S.C. 3304(a)(1) -"Only One Responsible Source" as implemented by FAR 6.302-1. V. A DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED This acquisition meets the authority of FAR 6.302-1 which states that this authority may be used "when the supplies or services required by the agency are available from only one responsible source, or from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for." See above II. VI. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION UNDER 5.202 APPLIES. Interra Systems is the only manufacturer and supporter of the Baton software and therefore Interra Systems is the only provider of service for Baton in order to ensure files meet industry standards and are verified in order to provide greater access to the moving image and audio collections. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE Pricing is less than, or consistent with, manufacturers of similar (but different) products. Interra Systems provided a proposal for this annual maintenance agreement at the same cost as the initial annual maintenance agreement, $ per year. VIII. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (SEE PART 10) AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED Market research conducted via web-search and Interra Systems confirmed that they are the only manufacturer and supporter of Baton. Market research shows that a new system would cost, on average, approximately $50,000.00 with similar costs for ongoing maintenance and upgrades. Testronic software is $ with the need for a new server ($ ), Tektronix Aurora is $ with the need for a new server ($ ), and Telestream is $ also with the need for a new server. IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION. SEE FAR 6.303-2(a)(9) N/A X. A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE ACQUISITION N/A XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED The agency will remain abreast of changes in the availability of upgrades and support for this equipment; for example, availability via authorized re-sellers and distributors, as well as offerings via GSA schedule. XII. CONTRACTING OFFICER CERTIFICATION THAT THE JUSTIFICATION IS ACCURATE AND COMPLETE TO THE BEST OF THE CONTRACTING OFFICER'S KNOWLEDGE AND BELIEF See Page 1. ATTACHMENT 2 PERFORMANCE WORK STATEMENT Software System Maintenance Agreement 1.0 INTRODUCTION Statement of Need The National Archives seeks to acquire a maintenance agreement for the Interra Baton system currently installed in the Audio/Video Preservation Lab and Motion Picture Preservation Lab. 2.0 SCOPE 2.1 The maintenance agreement shall include all terms necessary for the achievement of the stated requirements in a manner that enables operation of all functions by operators. The maintenance agreement shall comply with all industry and Government equipment standards for health and safety. 2.2 Annual Software System Maintenance Agreement 2.2.1 The Maintenance Agreement Shall Include • 24 hour/7days phone support • Priority Technical Phone Support • Stable support costs • Software support and upgrades • System should include maintenance releases, upgrades and technical support at no additional cost for the defined maintenance service period. • Technical support by telephone and by email. Requests should receive a response within 4 business hours. 2.2.2 All work must be completed on a schedule mutually agreed upon by the contractor and the Government no later than one year from contract award date in base year or applicable option year. 3.0 PLACE OF PERFORMANCE 3.1 Services shall be performed at the following location: Special Media Preservation Laboratory (RDS-F) 3301 Metzerott Road, College Park, Maryland, 20740 Entrance will be via Metzerott Road 4.0 PERIOD OF PERFORMANCE 4.1 The period of performance will be for a base year plus four (4) option years. The base year will begin July 1, 2016 - June 30, 2017. 5.0 HOURS OF OPERATION 5.1 Work must be undertaken during regular business hours, Monday through Friday, unless mutually agreed upon by NARA. 6.0 MISCELLANEOUS 6.1 No transportation or travel expenses will be paid.
