Description
JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 2. Description of Action: The proposed action is for a firm-fixed price delivery order to be issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC) for the renewal of brand name Kroll Ontrack Power Controls software maintenance for the VA Office of Information and Technology, Service Delivery and Engineering, Enterprise Systems Engineering (ESE). 3. Description of the Supplies or Services: The proposed action is for brand name Kroll Ontrack Power Controls for Exchange software maintenance. The software license maintenance renewal is for eight servers. Kroll Ontrack Power Controls for Exchange is a forensically sound email management tool that helps Information Technology teams efficiently search, collect, and restore email messages, mailboxes, email attachments and other Microsoft Office Outlook items from any previous full backup. The software maintenance is required to ensure the software remains operational and up to date. The period of performance for the license is 12 months from date of contract award. The total estimated price of the proposed action is 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is 41 U.S.C. 4106(c)(2) as implemented by Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B) entitled, "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited Above: ESE's current infrastructure is based on existing Kroll Ontrack Power Controls software and VA requires support compatible with the existing infrastructure protocols and functionality for continued operational availability. Only Kroll or an authorized reseller can provide the necessary software updates because of the proprietary source code required to develop and implement software updates. No other source is capable of providing the required software maintenance that meets VA's unique functional requirements. In addition, a prior implementation of Kroll software licenses is currently deployed and in use within ESE. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D), the resulting contract award will not be announced on the Federal Business Opportunities Page, and this Justification for an Exception to Fair Opportunity will not be made publicly available since the estimated value of this action is less than $150,000. This Justification for an Exception to Fair Opportunity will be posted on the NASA SEWP V website with the solicitation. 7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government will continue to perform market research to determine if there are any new maintenance services available that will enable future requirements to be competed. 8. Market Research: Market research is an ongoing process which started in 2005 and is continuously being conducted, as recently as January 2016. VA Subject Matter Experts regularly review industry trade publications and conduct internet research to ascertain if any other brand name software is available that is similar to Kroll. Quest Power Controls manufactured by Dell was identified; however, research confirmed that the source code required to issue the updates is proprietary. Therefore, only Kroll or an authorized reseller are capable of providing the required maintenance and upgrades of the software. No other firm has the capability of developing and issuing software updates and fixes for Kroll software necessary to support existing ESE requirements. Additional market research was conducted in February 2016 by the Contract Specialist by utilizing the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC) Provider Lookup tool that identified one prospective Service-Disabled Veteran-Owned Small Business (SDVOSB) GWAC holder in Group B(2) and four Small Business GWAC holders in Group C that are resellers of Kroll Ontrack software maintenance that meet the requirements of this acquisition. Additionally, NASA SEWP V has a dynamic product catalog where line items can be added based on customer requests; therefore, as long as the required item or service is within scope of the NASA SEWP V GWACs, items and services can be added to a NASA SEWP V GWAC holder's catalog on a daily basis. 9.
