- Justification for sole source This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 -Synopses of Proposed Contract Actions. Defense Contract Management Agency - Headquarters, intends to issue a Firm-Fixed Price contract to Faneuil, Inc., located at 2 Eaton St Suite 1002, Hampton, VA, 23669 on a Sole Source basis. Description of Work- the Defense Contract Management Agency requires 7 E-ZPass Flex Transponders to include electronic collection toll service for Express lanes, High-Occupancy Vehicle lanes, and toll roads. Duration of the contract is 60 months from date of award. Authority-FAR 13.106-1(b) The Government's intent is to solicit and award this requirement to Faneuil, Inc. Competition has been restricted due to the proprietary nature of the requirement. No sources were located that were technically acceptable as Faneuil, Inc. is the only vendor through which the Virginia Department of Transportation uses for its E-ZPass program. It has thus been determined that it is in the Government's best interest to award this requirement as a sole source. A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this sole source action. The NAICS code is 485999 "All Other Transit and Ground Passenger Transportation" The size standard as defined by the U.S. Small Business Administration is $15 million. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. Oral communications are NOT ACCEPTABLE in response to this notice. A determination by the government not to compete this proposed requirement is solely within the discretion of the government.
