Description
1. 411th Contracting Support Brigade (CSB), Korea plans to issue a solicitations for Removal of Accumulate Sludge at USAG-Daegu and surrounding areas, in the Republic of Korea (ROK). The Project is operations and maintenance (O&M) funded, however market research has shown that the same or similar services are offered to the general public in the ROK, the Status of Forces Agreement (SOFA) precludes the U.S. Government from granting Invited Contractor or Technical Representative status to any offeror for this requirement. All sources submitting a proposal or quote, as applicable, including U.S. sources, must: already have the requisite business licenses directly from the ROK Government; and conduct business in accordance with all applicable ROK laws, including but not limited to, rules and policies regarding labor, taxation, and immigration. 2. The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform removal of accumulated sludge for Daegu Area, DPW, USAG Daegu as defined in this Performance Work Statement. The requirement is for the removal of accumulated sludge in septic tanks/grease traps/sewage treatment plant/sewage lift station from various locations in Camp Henry/Walker/George/SP #47 and dispose to off-base in compliance with ROK Environmental Laws & Regulations. Workload estimates requiring these services will be listed in an attachment in the released solicitation. 3. System for Award Management: The North American Industry Classification System (NAICS) code for this procurement is 562212, Sludge Removal Service. Please make sure that the NAICS code is listed in your SAM registration. In accordance with DFARS 252.204-7004, Alternate A, all interested offerors shall be registered in the System for Award Management (SAM) located at https://www.sam.gov. If you are not registered in this system at time of award you will not be eligible for award. 4. Basis of Award: Award will be made to the responsible offeror submitting the Best Value Lowest Priced, Technically Acceptable (LPTA) offer that satisfies all terms and condition of the solicitation. 5. The 411th contemplates award of a Requirements contract with Firm Fixed Price (FFP) CLIN Task Orders. The solicitation will be issued full and Open Competition however all potential offerors must have the requisite business license issued by the ROK. The solicitation package will be issued about May 30, 2016. This is a not a solicitation. Do not send proposals to the contract specialist. This is just a notice. 6. Period of Performance (POP): 12 months base period and four (4) twelve (12) month option year not to exceed 60 months. Specific dates will be listed in the solicitation. Technical Evaluation Factors: Factor A. Technical Capability: All sub-factors under Technical factor are of equal importance and shall be evaluated on an acceptable or unacceptable basis. A rating of unacceptable for any factor or sub-factor will result in technically unacceptable rating. Failure to provide documents addressed below will result in a rating of "Unacceptable". The experience of a subcontractor cannot be substituted for the prime contractor's experience. Sub-factor 1. Prime Contractor's Prior Experience Sub-factor 2. Prime Contractor Business License Sub-factor 3. Personnel Qualifications a: Contract Manager (CM) Factor B. Past Performance Factor C. Price. Each factor and sub factor will be rated either acceptable or unacceptable. A rating of unacceptable for any factor or sub factor will result in an overall unacceptable rating. If an offeror fails to meet the minimum requirements outlined in one of the three sub-factors below, the sub-factor, and overall proposal will be rated "unacceptable" and will not be eligible for award. Technical Acceptable/Unacceptable Ratings Rating Description Acceptable Proposal clearly meets the minimum requirements of the solicitation. Un-acceptable Proposal does not clearly meet the minimum requirements of the solicitation. FACTOR A - TECHNICAL Sub-factor 1 - Prime Contractor's Prior Experience: The offeror shall be evaluated on provided documentation demonstrating a minimum of two (2) years' experience within the last five (5) years from the issuance date of this solicitation in performing the same or similar type of services for sludge removal. The experience of a subcontractor cannot be substituted for the prime contractor's experience. The offeror shall provide evidence of prior experience in the following format: • The title of the Project or Contract No. for the Commercial or Government requirement • A clear description of qualifying work experience • Length of contract/project (From: year/month/date - To: year/month/date) • Value of contract/project in KW for total amount • Complete POC of employer (including name, phone no, and e-mail) and validating POC Sub-factor 2 - Prime Contractor's Business Permission Certificates: The offeror shall be evaluated on submitted copies of current and valid registration issued by the ROK Government as listed below. The registration of the sub-contractor cannot be substituted for the prime contractor's registration. Business License: for human waste collection and transportation business (분뇨수집/운반업 허가증) issued by Nam-Gu Ward, Daegu City, ROK. Sub-factor 3 - Personnel Qualification: The offeror shall be evaluated on submitted individual (Personal) resumes for the position title listed in the paragraph below. A resume must clearly identify in the following format: • Proposed Position Title • A clear description of qualifying work experience • Length of work experience (From: year/month/date - To: year/month/date) • Complete POC of employer (including name, phone no. and e-mail) and validating POC Contract Manager (CM): The offeror shall be evaluated on their submitted resume that demonstrates that proposed CM has a minimum of two (2) years of experience within the last five (5) years from the solicitation issue, as a CM on the same or similar services to this requirement. The CM shall be able to read, write, speak and understand English efficiently. FACTOR B - PAST PERFORMANCE The offeror shall have recent and relevant past performance in the removal of accumulated sludge services or similar services to this RFP's. Past performance shall be evaluated on an acceptable/unacceptable basis. The Government may ascertain past performance information on the Offeror from sources other than the references provided. Recent past performance is within the last five (5) years as of the opening date of the solicitation. Relevant past performance are those that are the "same or similar" services based on size, scope, complexity, and contract type. The past performance will be evaluated for all offeror's proposals by the Contract Specialist/Contracting Officer in the following manner: (1) Review of the detailed explanation submitted by offerors demonstrating the relevance of the references to the requirements of the solicitation. (2) References will be contacted by phone or email to verify contents in detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical and quality awards/certificates. (3) The Government reserves the right to obtain past performance information from any reasonable source available, including Government database in order to evaluate past performance. The offeror shall provide past performance information on past or current contracts (including Federal/local Government and private) for efforts that are the same or similar to the Government's requirement during the past five (5) years. Offerors are authorized to provide information on problems encountered on the identified contracts and the offeror's corrective actions. The offeror shall describe its past performance on contract it has held which are of similar scope and magnitude to that which is detailed in the solicitation. A maximum of three (3) references will be evaluated. Past Performance Evaluation Ratings Rating Description Acceptable Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown. (See note below) Un-acceptable Based on the offeror's performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort. NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a) (2) (iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, "unknown" shall be considered "acceptable" FACTOR C - PRICE Price analysis will be conducted for each proposal to ensure completeness, realism, reasonableness, and balance IAW FAR 15.404-1(b). The following applies to that evaluation. i. Completeness. The offeror shall complete the pricing information for all CLINs, Sub- CLINs and ELINs (as appropriate) identified for each year and option year (include total price for all five (5) years). Any underlying assumptions including proposed escalation rates between base and subsequent option periods shall be clearly explained. ii. Price Realism. Price Analysis in conjunction with Technical Analysis will be used to perform a Price Realism Analysis to determine if the price is realistic for the work to be performed. The proposal will be evaluated using price analysis techniques to determine whether the proposal reflects a thorough understanding of the PWS, and whether the price proposed is realistic for the work to be performed and is consistent with approaches described in the technical and management proposals. Price proposals, which are unrealistically low, will be deemed reflective of a failure to comprehend the complexity and risk of the proposed contractual requirement and may be grounds for rejection of the proposal. iii. Price Reasonableness. Price should also reflect fair market value and be reasonable when compared to the independent Government estimate, previous prices for same or similar services and/or when compared among other technically acceptable offers. iv. Unbalanced Pricing. As part of the price evaluation, proposals will be reviewed to identify any unbalanced pricing. IAW FAR 15.404-1(g)(3), Unbalanced Pricing, a proposal may be rejected if the Contracting Officer determines the lack of balance poses an unacceptable risk to the Government. v. Price is not scored. The Government will review the price proposal to determine the extent to which it is reasonable, realistic, and consistent with the technical proposal. The lowest price for award purposes will be the combined total of the effective period of five (5) years from the date of award. Price shall include all CLINs, Sub-CLINs as listed on the Price Schedule including option periods. The Government intends to evaluate proposals and award a contract without discussions. Therefore, Offerors are instructed that submitted proposals should contain their best pricing. vi. FAR Clause 52.217-8. As part of price evaluation, the Government will evaluate its option to extend services (FAR Clause 52.217-8 - Option to Extend Services) by adding one-half of the offeror's final option period price to the offeror's total price. Thus, the offeror's total price for the purpose of evaluation will include the base period, 1st option, 2nd option, 3rd option, 4th option, and one-half of the 4th option. Offerors are required only to price the base and four (4) options. Offerors shall not submit a price for the potential one-half year extension of services period. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. Proposal Period: The Government anticipates releasing the solicitation around May 30 2016. The solicitation will be issued via FedBizOps (https://www.fbo.gov/).
