This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. All prospective Quoters (Offerors) are responsible for monitoring the Federal Business Opportunities (FedBizOpps) website for the release of amendments (if any) or other information pertaining to this solicitation. This solicitation is a Request for Quote (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-87-2 effective April 06, 2016. It is the responsibility of the Quoter to be familiar with the applicable FAR clauses and provisions. The clauses and provisions may be accessed in full text at this address: https://www.acquisition.gov/?q=/browse/far/52. Prospective Quoters are hereby notified that the Government intends to issue a Firm Fixed-Price Purchase Order in accordance with FAR Part 12 "Acquisition of Commercial Items" and FAR Part 13 "Simplified Acquisition Procedures." The associated North American Industrial Classification System (NAICS) code for this procurement is 334519 "Other Measuring and Controlling Device Manufacturing" with a small business standard size of 750 employees. The NHTSA Office of Acquisition Management is seeking to purchase a series of a 3-D Deflection Measuring Device; hereafter referred to as "Measuring Device" or "Measuring Devices". (See Attachment 1 for a complete technical description). The Government intends to purchase a series of Measuring Devices from the awardee, after making a determination that the awardee's quote conforms to the solicitation and is the most advantageous to the Government, price and other factors considered. This resultant award is intended be a three (3) month Purchase Order to: - Allow for the delivery of the equipment (Measuring Devices) and; - Ensure that the Government is provided with adequate time to receive, inspect and accept the equipment. PRICES/COSTS The Not-To-Exceed Firm Fixed-Price Amount for the resultant Purchase Order is $ TBD at award. SUPPLIES/SERVICES See Attachment 1, Statement of Work. PERIOD OF PERFORMANCE The Period of Performance is three (3) months from date of award (inclusive of delivery and inspection). All equipment must be delivered within twelve (12) weeks from date of award. Inspection will be performed by the COR upon receipt and requests for modification to the equipment or acceptance will be within two (2) weeks from delivery. CONTRACTING OFFICER'S REPRESENTATIVE (COR) The Contracting Officer will designate a representative to assist in monitoring the work under the Purchase Order. The COR serves as the Contract Officer's technical liaison with the Contractor. The COR is not authorized to change the scope of work or specifications as stated in the Purchase Order, to make any commitments or otherwise obligate the Government, or to authorize any changes which affect the Purchase Order price, delivery schedule, period of performance or other terms or conditions. In the event any technical direction offered by the COR is interpreted by the Contractor to be outside of this Purchase Order, the Contractor shall not implement such direction, but shall notify the Contracting Officer in writing of such interpretation within five (5) calendar days after the Contractor's receipt of such direction. Such notice shall include (1) the reasons upon which the Contractor bases its belief that the technical direction falls within the purview of the "Changes" clause, and (2) the Contractor's draft revisions to the terms of the contract that it thinks are necessary to implement the technical direction. EVALUATION -- COMMERCIAL ITEMS (a) The Government intends to award a Purchase Order resulting from this solicitation to the responsible Quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes per descriptions as given above in INSTRUCTIONS FOR SUBMITTING QUOTES, Items 10, 11 and 12 (listed in descending order of importance): 1. Past Performance - Past performance shall be considered to determine the quality of the Schedule and the Quoter's past performance as it relates to the probability of success of the required effort. In the case of a Quoter without a record of relevant past performance or for whom information on past performance is not available, the Quoter will not be evaluated favorably or unfavorably on past performance. **NOTE: Prior to issuing any award, the Government will perform a search of Active Exclusions in the System for Award Management (SAM) to ensure that the prospective awardee is not on the list of parties excluded from receiving federal contracts and sub-contracts. The Contracting Officer (CO) may also identify and analyze the past performance of the Quoter on any other relevant contract that they currently have or had of which the CO has knowledge or obtains knowledge, including but not limited to projects listed in the Past Performance Information Retrieval System (PPIRS) and the Federal Awardee Performance and Integrity Information System (FAPIIS). When combined Technical Capability and Past Performance are more important than price. (b) A written notice of award or acceptance of a quote mailed or otherwise furnished to the successful Quoter within the time for acceptance specified in the quote, shall result in a binding Purchase Order without further action by either party. Before the quote's specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. Statement of Work ATTACHMENT 1: STATEMENT OF WORK BACKGROUND The making of instrumentation (e.g. load cells, accelerometers, angular rate sensors necessary, etc.) to record measurements within Anthropomorphic Test Devices (ATD) is a highly technical specialized endeavor with a very limited number of suppliers. The InfraRed - Telescoping Rod for Assessment of Chest Compression (IR-TRACC) is either a standalone 1-dimensional device, 2-D device or 3-D device. The 3-D IR-TRACC used in the THOR-50M ATD measures deflections of the thorax and abdomen via measuring linear displacement from front-to-back utilizing telescoping tubes and rotation about two orthogonal axes at the rear pivot of the assembly. The combination of these three measurements provides the three dimensional motion of the front attachment point of the instrument relative to its anchor point along the ATD's spine. The repair lead time for damage incurred by a lack of reliable durability on the 3-D IR-TRACCs for the THOR-50M has historically been a source of inconvenience and delay in testing. Because of concerns regarding availability and durability, NHTSA intends to evaluate alternatives to the 3-D IR-TRACCs. The procurement and evaluation of alternatives will support NHTSA research programs. SUPPLIES/SERVICES REQUIRED NHTSA requires a non-telescopic, 3-D Measuring Device capable of measuring deflection; which would function as a direct replacement for 3D-IRTRACCs as currently used in the THOR-50M ATD in the thorax and lower abdomen as specified in the Agency's Sept. 2015 RFC notice. The device should fit the IR-TRACC footprint within the dummy to avoid interference during deflection. Additionally, the device should interface with the ATD bib in the same way using a universal joint to prevent binding. For reference the assemblies and associated files are included in these drawings on the NTHSA website. The thorax has four IR-TRACCs and mounting assemblies using the same 90 mm deflection IR-TRACC and the lower abdomen has two IR-TRACC assemblies using the same 120 mm deflection IR-TRACC. The drawings can be provided upon request. NHTSA's Research program into alternate devices for measurement of deflection in the THOR-50M is pending receipt of new novel transducers and the project would benefit from using the IR-TRACC direct replacement sensor. These tests are expected to continue through the fall of 2016. To realize the maximum benefit from the procurement of the instrumentation, delivery must be expedited to meet the anticipated schedule.
