Criminal Investigations Advisor Guatemala City, Guatemala Issuance Date: 04/22/2016 Closing Date: 05/09/2016 SOLICITATION NUMBER: PSC-16-031-INL SUBJECT A solicitation for a Personal Services Contractor (PSC), Department of State (DOS), Bureau for International Narcotics and Law Enforcement Affairs (INL) The United States Government (USG), represented by the DOS, seeks applications from US citizens interested in providing PSC services as described in this solicitation. PRE-AWARD ETHICAL RESPONSIBILITIES OF PSC (JUN 2011) This solicitation may result in the award of one or more personal services contracts as defined in FAR 2.101. Prior to contract award, all offerors or quotes must advise the cognizant Contracting Officer if they have a personal conflict of interest, such as a financial conflict, that would prevent them from either meeting the requirements of the clause entitled, "Post-Award Ethical Responsibilities of Personal Services Contractors," or otherwise objectively performing their contractual duties upon contract award. HOW TO APPLY Offerors proposal shall be in accordance with the requirements stated in this solicitation at the place and time specified. A proposal will be determined non-responsive and ineligible for consideration unless all required documents and information are included in the submission. Offerors shall ensure their resume demonstrates their possession of the minimum qualifications outlined in this Solicitation, as well as their ability to fulfill all required duties. INL's Office of the Western Hemisphere Programs (INL/WHP) develops narcotics control and anticrime policy initiatives for countries in the Western Hemisphere who produce and transit narcotics. INL/LP provides overall program and policy direction for INL bilateral narcotics and anticrime assistance programs at overseas posts by developing and revising drug and crime strategies and coordinating program development with other U.S. agencies. In addition, INL/WHP is responsible for coordinating policy and programs with other U.S. Government (USG) departments and agencies who are involved in international narcotics control and crime activities, including the Office of National Drug Control Policy (ONDCP), the Departments of Defense (DOD), Department of Justice (DOJ), Department of Homeland Security (DHS), Department of Treasury, and the Agency for International Development (USAID). The purpose of this personal service contract is to provide a Criminal Investigations Advisor to the International Narcotics and Law Enforcement Affairs (INL) at the U.S. Embassy in Guatemala City, Guatemala. The Advisor will advise on matters related to the development and implementation of the criminal investigation model for the National Civil Police (PNC) and provide technical assistance to the Police Reform Commission. As well, the Advisor will work with civilian police units within the Government of Guatemala to advise, develop and enhance the effectiveness of criminal investigations. B.DUTIES AND RESPONSIBILITIES 1.Provides advice and assistance in planning, developing, and administering Government of Guatemala (GOG) criminal investigations, law enforcement, and rule of law programs. 2.Responsible for keeping INL Director, INL/WHP Guatemala Program Officers, and other U.S. personnel, as appropriate, informed and briefed on all matters relating to criminal investigations programs, advisory assistance, and training initiatives in the Guatemalan law enforcement and investigations entities, including, but not limited to, DIGICRI, DIGICI, INACIF, DEIC, PANDA, DIMEI, DIDAE, INTERPOL, GACRI, and DIP. 3.Assists the U.S. Embassy with institutionalizing GOG law enforcement investigative and justice sector capabilities to become self-sufficient and ensure USG priority goals of citizen safety, law enforcement, and institutionalizing rule of law reform are being met.. 4.Coordinates the implementation policies and strategies related to citizen safety, investigations, and rule of law. This includes strategic planning, setting priorities, and evaluating bilateral and trilateral programs. 5.Initiates studies and advises INL-Guatemala and GOG partners on strategic planning, leadership, management, and organizational requirements and reforms that affect the investigative process. 6.Identifies areas for independent, professional evaluations regarding the investigative process and justice sector of Guatemala. Design the scope of the evaluations and provide expert guidance to U.S. embassy personnel in contracting for the evaluations. 7.Provides training and expert guidance in the use of sophisticated investigative techniques against criminal organizations. Training areas include crime scene management, crime analysis, explosive incident response, tactical responses, undercover operations, source development, narcotics, criminal financing, tactical & negotiation skills, and the management of complex transnational investigations. 8.Assists U.S. Embassy on issues related to citizen safety, law enforcement, and rule of law, with special focus on seeking out synergies and avoiding duplication within the U.S. interagency. 9.Provides input to the INL-Guatemala Director regarding USG/GOG bilateral agreements on INL funded programs aimed at improving the investigative capacity of the PNC. 10.Assists the U.S. Embassy and INL-Guatemala in developing citizen safety, law enforcement, rule of law, and investigation strategies and programs, as directed. 11.Closely coordinates with USG federal law enforcement agencies, the Police Reform Commission, and where applicable, U.S. military representatives in Guatemala on matters pertaining to the investigative process in Guatemala. 12.Continuously evaluates and advises the U.S. Embassy on the performance of GOG agencies operating in conjunction with INL assets and resources regarding the investigative process to evaluate and recommend the need for training. 13.Tracks long-range planning of the Criminal Investigations Program activities, including assessment, training, certification and implementation. 14.Provides expert analysis and guidance in project procurement, budget preparation, and program planning pertaining to the investigation project. 15.Provides expert analysis and guidance in the development of a permanent Basic Criminal Investigations Curriculum at the PNC. 16.Conducts field surveys, evaluations, and special studies, as directed. 17.Resides in Guatemala City, Guatemala; travel and work in the field approximately 50% of the time. B.-1 TRAININGS & DISTANCE LEARNING COURSES 1.Completes the Contracting Officer Representative (PA296) distance-learning (DL) course through the Foreign Service Institute (FSI) within 120 days of arriving at Post. 2.Completes the Introduction to Working in an Embassy (PN113) distance-learning (DL) course through the Foreign Service Institute (FSI) within the first six (6) months of arriving at Post. C.RELATIONSHIPS The Advisor will receive general guidance from and report initially to the INL-G Director, and then to the Police Professionalization and Reform Program Officer when appropriate. Specific assignments originate frequently from liaison activities and the Advisor will negotiate the draft scope and objectives of investigation related projects independently with little input / review from the supervisor. The Contracting Officer's Representative (COR) is delegated the authority to act for the Contracting Officer in matters concerning technical clarification, inspection and, after concurrence by the Contracting Officer, acceptance of Contractor performance under the contract, including preparation of receiving reports, and the authorization of progress payments when appropriate. The COR will coordinate all work with the Contractor and review Contractor's performance at significant stages of its development. In no instance, however, shall the COR be authorized to alter or modify the specifications or the contract terms and the conditions or waive the government's requirement, price, delivery, or other terms and conditions. Such changes must be authorized, in writing, to the Contracting Officer. Since the Advisor is located physically in Guatemala, s/he will exercise independent judgment in developing new and improved approaches to analyze and review investigation-oriented programs in Guatemala. D.DELIVERABLES/REPORTS Deliverables are required under this PSC and shall include; weekly status reports, monthly evaluation of contractor performance, special reports when required and "Completion of assignment report," which shall be a compressive review of the projects in which the contractor was involved. Each report shall include a critique of and recommendations for the various projects. The completions of assignment reports are due no later than fifteen (15) days prior to the expiration of this contract. The Personal Service Contractor shall submit two (2) copies of each report as required to the following; 1.INL/POST Director(s) and; 2.INL/Program Officer Per FAR Part 4, the above referenced documents shall be incorporated and copies stored in the PSC's hard file under Section V.; Tab E - Receiving Reports. The Contractor shall prepare and submit two copies of each technical report required by the schedule of this contract (e.g., progress reports, final reports, etc.), to the Embassy INL Section and to the Program Officer, Bureau of International Narcotics and Law Enforcement Affairs (INL), Department of State Washington, DC. The title page of all reports forwarded pursuant to this paragraph shall include a descriptive title, the author's name(s), contract number, project number, and title, contractor's name, name of the State Department project office, and the publication or issuance date of the report. When preparing reports, the Contractor shall refrain from using elaborate artwork, multicolor printing, and expensive paper/binding, unless it is specifically authorized in the Contract Schedule. Wherever possible, pages should be printed on both sides using single spaced type. E.GUIDELINE Guidelines include basic legislation, in particular, Chapter 8 of the Foreign Assistance Act (FAA) of 1961, as well as other laws, including other authorities under the FAA, the Arms Export Control Act, provisions of DOD authorization acts, provisions of the annual Foreign Operations, Export Financing, and Related Program Appropriations Act, which appropriates funds for the INL programs, other supplemental appropriation laws, and the DOS Basic Authorities Act, also contain provisions relevant to the programs for which INL has responsibility. F.COMPLEXITY This position involves planning, organizing, and completing analysis and implementation of complex law enforcement projects. G.SCOPE AND EFFECTIVENESS The Advisor will perform broad and extensive assignments related to complex programs spanning the full range of the investigative process, citizen safety, and Guatemala rule of law programs, which is of significant interest to the public and to the Congress. H.PERSONAL CONTACTS The Advisor will receive general guidance from and report initially to the INL-G Director, and then to the Police Professionalization and Reform Program Officer when appropriate. The Advisor will also work closely with the INL-G Program Offices, and personnel in other U.S. Embassy agencies. In addition, the Advisor will maintain contact with the police, military, justice sector, non-government organizations (NGOs) and the Police Reform Commissioner. I.MINIMUM QUALIFICATIONS 1.U.S. Citizen, able to obtain and maintain a Department of State Secret security and medical clearance, ethics clearance-if applicable. 2.Graduated from a State or Federal Law Enforcement Academy. 3.A minimum of fifteen (15) years professional work experience in law enforcement, to include: a.Significant and demonstrated experience managing police units to include investigative unit(s). b.Proven experience advising executives at state, federal, and international levels on law enforcement/police issues and training/mentoring experience in anti-corruption and anti-extortion concerns processes, internal affairs and problem resolution methodologies. c.A minimum of two (2) years' experience supervising patrol officers and prevention activities; d.A minimum of two (2) years as a program supervisor in precinct and/or agency of law enforcement; e.Supervisory level experience in strategic planning for small, medium, and large police units; f.Five (5) years of demonstrated experience in planning citizen safety, law enforcement, and rule of law programs; negotiating and development of project agreements; implementing project proposals; reporting on program progress and analyzing program results. 4.A minimum of three (3) years of operational experience in identifying and applying investigative techniques. 5.Superior interpersonal and liaison skills in a multi-agency/multi-jurisdictional environment. 6.English and Spanish proficiency; oral and written. 7.Strong verbal and written skills, with ability to present, defend complex analyses and proposals concisely. 8.Proficient in Microsoft Office Suite. J.PREFERRED QUALIFICATIONS 1.Demonstrated understanding of prevention/community policing and investigative challenges in Guatemala. 2.Significant and demonstrated experience in developing and managing crime-specific initiatives. 3.Significant and demonstrated operational and managerial experience in investigative policing. 4.Demonstrated experience conducting inspections of law enforcement related programs and procedures. 5.Demonstrated experience evaluating law enforcement personnel performance in regards to expected norms and procedures. 6.Demonstrated experience in international training/instructing/advising of foreign law enforcement personnel. K.EVALUATION CRITERIA Factor 1Investigations(30 points) Demonstrated investigative experience developing and implementing investigation policing initiatives Factor 2Liaison(20 points) Significant liaison experience, including liaising within international law enforcement context. Factor 3Management/Budget(15 points) Significant experience managing, planning, budgeting, and conducting oversight functions in a permanent and full-time law enforcement capacity. Factor 4Law Enforcement(15 points) Demonstrated ability to work effectively in local, state, and national law enforcement settings. Factor 5Communication(10 points) Ability to communicate complex issues in a timely and concise manner, both orally and in written form. Factor 6Past Performance(10 points) Past performance of applicant's ability to perform under the contract. In conducting the evaluation, the Government reserves the right to utilize all evaluation information available at the time of evaluation, which is provided by applicant or obtained from other sources. COMPENSATION (BASE PAY) For award, INL will negotiate for this contract based on the market value as outlined above and overall experience relevant to the solicitation requirements.
