Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number is 0010816383, and is issued as a Request for Quotation (RFQ). The RFQ incorporates provisions and clauses as those in effect through Federal Acquisition Circular Number 2005-58, 18 May 2012. This RFQ is being conducted as a commercial item procurement using Simplified Acquisition Procedures (FAR Part 13). Contract financing will NOT be provided for this acquisition. The Government reserves the right to not make an award at all. Quotations are being solicited and a Firm Fixed Price (FFP) type Purchase Order(s) is anticipated. This solicitation is set aside for small business The North American Industry Classification System (NAICS) code is 325998. Size Standard: 500 employees Quotes to include shipping charges (Fob destination pricing required) Description of commodity: Hydrostatic testing and servicing of the following extinguishers (10) Amerex FE-690 125 lb Purple K Wheeled unit (15) Amerex FE-490 125 lb Purple K wheeled unit (20) Amerex FE-497 50lb Purple K wheeled unit Location of extinguishers are Camp Grayling 2450 N Down River Rd Camp Grayling, MI 49739 The following FAR provisions and clauses are applicable to this procurement: 52.203-3 - Gratuities (a) The right of the Contractor to proceed may be terminated by written notice if, after notice and hearing, the agency head or a designee determines that the Contractor, its agent, or another representative-- (1) Offered or gave a gratuity (e.g., an entertainment or gift) to an officer, official, or employee of the Government; and (2) Intended, by the gratuity, to obtain a contract or favorable treatment under a contract. (b) The facts supporting this determination may be reviewed by any court having lawful jurisdiction. (c) If this contract is terminated under paragraph (a) of this clause, the Government is entitled-- (1) To pursue the same remedies as in a breach of the contract; and (2) In addition to any other damages provided by law, to exemplary damages of not less than 3 nor more than 10 times the cost incurred by the Contractor in giving gratuities to the person concerned, as determined by the agency head or a designee. (This subparagraph (c)(2) is applicable only if this contract uses money appropriated to the Department of Defense.)
