FAR 8 - JUSTIFICATION FOR LIMITING SOURCES <$150K Acquisition Plan Action ID: VA262-16-AP-4546 1.Description of Action: Nature: 0 New Requirement 1 Follow-on Order 0 Mod to Existing Order Number Insert task/delivery order no. Order against: 0 FSS Contract Number: GS-21F-100AA Name of Proposed Contractor:Safe Check East, Inc. Street Address:2761 Biggs Hwy Ste 2 City, State, Zip:North East, MD 21901-1827 Phone:714-720-4672 2.Description of Supplies or Services: The estimated value of the proposed action is $ 88,951.90 Contractor shall provide all parts, labor and materials required to inspect, clean lubricate, identify, scan, and document all of the fire, smoke and combination fire and smoke dampers in buildings 213, 214, 215, 217, 300 and 500. The current inventory includes two thousand -two hundred ninety three (2293) Dampers. Dampers without a barcode ID shall be added to the inventory and barcoded as well as documented on the Life Safety Drawings. Damper indicators labels are located on the ceiling grid at the location of the damper. Contractor shall prepare and provide a full report electronically on a CD and in hard copy. 3.Authority: ORDER AGAINST FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception: 0 An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A); 1 Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; (FAR 8.405-6(a)(1)(i)(B)) or 0 In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures. (FAR 8.405-6(a)(1)(i)(C) 4.Rational/explanation to support cited authority: Safe Check performed these services in 2012 and this is a re-inspection of the previous work. During the previous period of performance Safe Check created a bar code system and installed bar code stickers at every damper in the inventory. These dampers are located in the air conditioning systems and in fire walls and smoke walls. It is not easy to locate all of the dampers since they are in the areas above the ceilings and in the interstitials. The equipment installed is proprietary to Safe Check. Without the inventory and the accompanying software the inventory is useless. If awarded to any other contractor a new database and inventory would be required to be created which will cost the Government an additional $25,000. It is in the best interest of the Government to award to Safecheck for the re-inpection and ensure the safety of the patients, visitors, and staff. This inspection is required by the Joint Commission and the Department of Veterans Affairs to meet Life Safety requirements. This inspection is critical to the facility which will safeguard lives in the event of a fire. 5.BRAND NAME ONLY: This buy is estimated to exceed $25,000 and this documentation will be posted along with the RFQ on e-Buy, as required by FAR 8.405-6(b)(3). 6.Note that this determination satisfies the requirements of FAR 8.405-6.
